      As a supposedly prestigious publication, you should know that no international court awarded anything to the Philippines over the South Chiina Sea.
      It was an arbitration panel, attended only by the Philippines, that made the award. And an arbitration panel has no jurisdiction to rule on anything unless the parties agree to submit to its jurisdiction, and China had not.

      The Arbitral Award is not a PCA ruling. It is an UNCLOS ruling. China has a right not to participate in the proceedings. Even without China’s participation, the Tribunal considered China’s position and claims, and made sure that the Philippines’ claimsare well founded in fact and law. On the other hand, China has an obligation to accept the final and binding ruling. Under UNCLOS, China’s non-participation is allowed, but non-acceptance is not.

      The Permanent Court of Arbitration (PCA) is a non-UN intergovernmental organization headquartered at the Peace Palace, in The Hague, Netherlands. Also, UNCLOS does not deal with matters of territorial disputes or to resolve issues of sovereignty, as that field is governed by rules of customary international law on the acquisition and loss of territory.

      The body of water known internationally as the South China Sea has different names depending on the country referring to it. In 2012, then-President Benigno Aquino III of the Philippines officially named parts of the South China Sea within the Philippines' exclusive economic zone (EEZ) as the 'West Philippine Sea.' Vietnam refers to it as the 'East Sea,' while other nations have their own terms. The primary issue is not the name, but the territorial disputes over the EEZs. Each country seeks to defend its own EEZ, while some aim to claim areas beyond their internationally recognized territories. For example, if territorial claims were based solely on the names of bodies of water, India could claim the entire Indian Ocean. This illustrates the logical fallacy in the argument that names determine territorial rights.

      I think Taiwan's claim to the SCS is related to the One-China policy - if Taiwan rescinds its claims, China will probably interpret it as a pro-independence move, going against the One China policy. This is also the reason why even today Taiwan claims not only Mainland China, but the whole of Mongolia as well as parts of countries which border modern-day China. Hence why no one really mentions it. Although it's interesting to note that Taiwan also has an outpost on the Spratlys, which I find interesting too.
      Arguably, this whole problem exists because of the KMT, which used to rule mainland China and are now based in Taiwan. The KMT Government were the first to publish the 11-dash line (note the map in the video which you're referring to) before the Communists reduced it to remove claims from the Gulf of Tonkin.

    Most people, including myself, were ignorant about the facts, both historical and present. The Republic of China, or ROC, which is the current government of Taiwan, claimed the 11-dash lines, which means all the islands are Chinese territories. That was under the auspice of the Allies, i.e., the U.S., after winning WW2 against the Japanese, who occupied all those islands. In fact some of the warships used to put the markers on the islands were U.S. The People's Republic of China, or PRC, inherited these claims after winning the civil war, and the ROC retreated to Taiwan. However ROC still claims the same territories as Chinese. The Philippines was not even a country at the time.

    • @Whitfield369
      @Whitfield369 5 หลายเดือนก่อน +1

      @user-oq1oc4qx4p I only state the historical facts, but you are only expressing your opinion. Taiwan is NOT the ROC, but part of ROC, after the WW2, rather you like it or not. PRC chased ROC to Taiwan in their civil war, which is still on, but took over all the claimed territories from ROC, which includes Taiwan. This is agreed by almost ALL the countries in the world, and the UN declaration. So you can argue all you want. The only way anyone can change the reality is to have the military power to do that, just like ALL the territories of ALL the countries in the world, since ancient time. And that is why Texas, New Mexico, California, Hawaii, Guam are U.S. territories. So wake up and smell the coffee.

If the Japanese believed it was their territory then let them protest and defend it. I am not sure why you are more eager than the Japanese to make such absurd argument for them. First of all, the Second Thomas Shoal, called "Ayungin" in Filipino language, is WITHIN the UN-designated Exclusive Economic Zone of the Philippines, being less than 200 nautical miles from Palawan Island. Article 55 of the United Nations Convention on the Law of the Sea signed on Dec. 10, 1982. We are not talking about the entire South China Sea here. There are many reefs and shoals in the South China Sea that many countries want to own, but Ayungin or Second Thomas Shoal should be beyond dispute. Do you know who was one of the first countries to sign the United Nations Convention on the Law of the Sea (UNCLOS) in 1982? China was one of the first to sign! Not only that, but China also ratified UNCLOS in 1996! I am just a simple Filipino student, but in my opinion people need to know the facts. I'm willing to be a fact researcher for Bloomberg.

      In a 1926 speech in Yokohama, Sun Zhongshan 孫中山 once invoked the idea of a kingly way 王道 which he contrasted to the rule by might 霸道 of European imperialism. If China is serious in its claim of a peaceful rise and earning the respect of their fellow Asians, then they should not stray from this kingly way of benevolence and not imitate the might-makes-right logic of past Western imperialism. They should follow mutually agreed upon principles of international law even when it does not favour them, not insisting on this and that as "indisputable" and still expecting others to come to the table.

    The territory of the Philippines is defined by the Treaty of Paris of 1898, the Treaty of Dissection of 1900, and the Boundary Treaty of 1930. The territory of the Philippines was defined by the Treaty of Paris and the Treaty of the Philippine Territory and Cutoff, signed in Paris in 1898 and 1900 between the United States and Spain. Philippine territory was further defined when the United States signed the final treaty with Britain in 1930 known as the Boundaries/Washington Declaration. The 1898 Treaty of Paris signed by the Americans and Spanish made it clear that the western boundary of the Philippine Islands did not include the Spratly Islands. The United States gave Philippine independence to the Filipinos in 1946. Maps of the Philippines are drawn with polygons to strictly define its territory and have been released to the world for decades.

      @@shawn5310Chinese claimed the whole Philippine EEZ back in 2012 vs. The recent U.S. bases in 2023. 11 years apart for China to rectify their stance or perhaps making friends with Philippines (least priority concern) yet they failed to do so 💀💀💀. The same case for China wondering why Vietnam, being a fellow communist country, fighting against China in Vietnam’s EEZ. 😂😂😂
      China is now being surrounded by angry neighbours from all directions except North, it’s a matter of time till China launch a war against a certain country (more like with Philippines than Taiwan).

      @@shawn5310 haha look at Vietnam now. Fully of excuses the reason is China is greedy for resources. Philippines removed the US bases after the fall of soviet union. Vietnam has no US base. Both are bullied by China. So its isn't really about the bases. The new bases in the Philippines are recent events before Marcos presidency their is no such thing.

    In reality,💡 if China will be successful on its 9 dash line - it will denote a very weak international Law, USA & the West are already weak, disruption on East Asian trade to the world, the Philippines and ASEAN are weak, others.. 💔

      because China had such claim since 600ad and internationally recognized since 1900s. China mapped the area first way before those tribes in the area became nationstate or independent, therefore it is their territory and they got to name it. if u deny this principle, US and EU are more obligated to give back away most of their land and oversea islands.

    What international court? That arbitration court is a private court and is not under the UN. Not all 'courts' that happen to be located in the Hague are part of the UN. Lol
