    Central govt should abolish the collegium system and form a commite to select the judges considering efficiency, honestyness and characters etc. since presently lot of discrepancies arised in SC.

      Collegium is not the perfect system, but far better than the government appointing a committee to select the judges.

      Could not agree more. However, in keeping with our penchant to try and cut corners/influence peddling and our political interference, pf which there seems no end. will committee who is beholden to some [person/political party etc., be expected to be fair in their selection. At the present moment, the Collegium System, where at least some form of fairness exists seems to me to be the best.
      The Collegium at present has no axe to grind. The canard being bandied about, that this system is archaic and non feasible, is laughable at best.
      Just read the remarks that the present government's ministers and the Prime Ministers statements made recently. They are trying to convert an Independent Judiciary to one that is beholden to its political masters.

      Definitely not. Indira Gandhi used to appoint judges according to her sweet will. She overlooked the seniority of HR Khanna and appointed Baig as the CJ because Khanna had given a couple of judgements embarrassing the government. Collegium system is far better than the executive meddling in their appointment. Montesquieu had a point when he observed that the three wings of the government should function separately.

    Citizens have no role in selecting judges, you cant question them ,you cant criticize them you can just surrender yourself in front of my lords 😅😅.

    What is extra power for CJI court on judicial side? Dave was shopping for it? Dave is welcome to enact some tear jerking as he did when Remana retired when his favourite forum also get dismantled by father time, unless collegium exercise their sky high powers adopt the American model of judges retirement age as till death. Cabels are forming in the courts and favours rule the roost 😮😮😮

    From the Government side any arguments between the litigation in respect of contract matters where one side Government and another side private persons, first should be fixed with affidavits of the concerned official along with oral arguments. The governmenhave to acts as a true person by way of affidavit to binding on words.

    Dushyant Dave is very serious and good advocate and a no nonsense counsel,, when another bench of CJI is already seized with similar case with larger issue involved, justice Shah must not have hurried, even if he belongs to Gujarat,, there was another Mohit Shah a CJ of Maharashtra HC connected with judge loya suspicious death case alleged to provide 100 crores if family of loya keeps mum ,,, things are not good in spaIn

    "Senior advocate" Dave needs to get off his high horse fast. Here, he wasn't putting forth his arguments when he asked, "Why are my lordships in a hurry to dispose of this...?" He was, in fact, casting implicit aspersions on Justice Shah's integrity by questioning his motive. Justice Shah, therefore, needs to be commended for his controlled outburst and for asking Dave to "argue on merits". Moreover, since when has it become a rule that if the CJI is hearing a particular case, other SC judges should delay pronouncing verdicts on similar matters? And if Dave wanted the current case delayed on that ground, he could have argued his case that way; instead, he started mud-slinging. I have often noticed that some of the so-called senior advocates (and Dave would probably score heavily on this front) resort to theatrics--like bullying the judges or trying their patience with caustic remarks--to hide their own inefficiency when going gets tough for them in the court.

      U are totally wrong, Justice Shah has publicly said that modi is a hero when he was a judge, Dave critisized this in one of his interviews. That is why Justice Shah was behaving rudely with Dave so as to settle personal scores........... which is totally unacceptable since a judge needs to be unbiased

    Lately Dushyant Dave seems to think that he has descended from above and can lord over everyone. He has been writing rude letters, delivering talks denigrating the judiciary. One cannot understand why the Supreme Court tolerates misconduct of seasoned lawyers who ought to be role models for others by their conduct. A couple of years back, Rajiv Dhawan had also quarrelled with the judges.

      Dave is criticised because he fights cases against the government unlike Harish Salve. Seasoned lawyers play psychological games to intimidate the judges. Ram Jethmalani was a pastmaster at this game. The judges have massive egos despite giving blatantly stupid judgements from time to time. It's necessary to prick it from time to time.

      Just like the executive and parliament, judiciary is also a pillar of democracy and is under constitution. If executive and parliament can be critisized, why can't citizens constructively critisize the judiciary? Even judiciary has specified that constructive critisizm is allowed. I am a supporter of collegium system, but I am against selection of incompetent judges to SC

    What is Dave's point?If he is worried for bigger cases and thinks this case to be apetty one then why does he accept this case.Usually vakils argue to dispose their cases early if there is 100% merit. Here Dave argues in different manner. What is harm if the case is heard early.

    Daves superiority comes from his deep learning and intent.He is the only lawyer who stakes everything when recent events show judges from session court, high court and even a couple of justices from SC buckle and succumb to unnecessary pressure tactics and plum posting offer post retirement from the govt. The present govt instead of minding 8ts own business influences and pressurises justices at all levels.
