    Good morning, I was given a summons to appear in court January 16 on a credit card debt with Discover in the amount of$4779.. I agreed to a monthly payment of $273. I can't afford to pay, Discover wouldn't go any lower I am in my 70S and on social security. The question is should I call the attorneys office and ask to lower monthly payments or wait until my summons hearing?

    Hi I have 3 credit cards that’s were maxed out the creditors closed my accounts due to not making minimum payment my question if I settle for like 50 to 70 percent and agree to pay can they still come back and try to get the rest???

      Get it in writing

      As long as you get the settlement agreement in writing (and sign it), they can't come back to get the rest! Be sure to fulfill your end of the agreement, and make your payments on time.

    Dealing with Gurstel law they haven't sent me an email saying how much we settled. Will have them recorded is good enough? They are telling me after I send my payment, they'll send me something. Im nervous since a judgment is pending in a few days. So im jusy playing with days and getting it settle before that time frame.

    Hi, your videos have been super helpful! I have a question now: how soon do creditors such as best egg sell the debt to the 3rd party, once the account is charged off (120 days)? And if I start a 6month settlement payment plan on or before that charged off date, will they still report the charged off information to credit bureaus? I lm hoping to make the settlement payment before it’s charged off, but what they offer is higher than I can afford.

    I rcvd a pre legal notice from a law firm that there office is handling my acct. They are offering 50% off balance, pay up to 13 mos of balance or schedule a one time payment for balance. Which settlement offer would benefit me.

      It totally depends on your financial situation. Note that a settled account will appear on your credit report for 7 years, typically.
      If they're offering to settle for 50%, that's a pretty good deal. Be sure to check the statute of limitations on the debt before you make any agreement though.     You know what kind of language I would use as I would like to talk on it on recorded line they'll never bother you again then they send Midland credit try to take me to court for some other credit company and I said I don't even know how to contact with them I went to the court and they dismissed it and he wrote the judge specifically wrote that I didn't have to pay it I was not responsible for it or anything I had to send that to the credit card companies and they were still putting it in every every month like every time Midland credit was still recording me all the time for years and I finally I think I finally got it off of there but it's wrong because I sent in my notice of the credit union I mean the credit companies you know the bills and I sent in the Judgment statement and everything and they wouldn't take it off they kept reporting it

    Oh they also manipulated me in my hearing with one of the tenants cuz the other one didn't show up they said I didn't have the the sheriff serve them that they sent a notice on the 1st I said well I can show you a picture right now on my phone showing you that I received them on the 28th from SPS cuz they always send me everyday what's coming in the mail so I show them proof of everything and they didn't default him they gave me another Sheriff's notice and told me I had to have him served in another three weeks this is ridiculous so he has three more weeks just for the first year hearing and then he won't show up again I can guarantee you then they're going to not do anything don't make another hearing date to get the eviction done and it's ridiculous. About anything from California I never find a lawyer on here on TH-cam that's from Massachusetts in the area at all it sucks so I'm having a hard time finding representation and I really don't want representation but I don't want to be treated like a piece of crap either and pushed around by their security guard and it got condoned by the judge it's just been really bad and I'm 60 and I can barely walk there were abusing me

    I found your page/video on doing some research on how to negotiate with my existing cc that has a high balance where the interest rate is so high my $500 payments are not making a dent. What advice can you give me on how to negotiate for a lower APR besides maybe getting a balance transfer? Thanks!

    If I had collections which are 4 yrs past & statue of limitations, has passed .. & I sell my primary house .. can the creditors , come back and try and sue or , they don’t have a case

    I'm in Massachusetts I really need a lawyer for a few things medical I want to sue the medical doctors I want it and get my records redone for my medical cuz they're ruining on my way to my gynecologist he asked if I'm still on methadone and I'm never taking methadone in my life they put I have addiction and drug problems and alcohol problems they gave me every site problem you can think of they diagnosed me and it's three doctors my circle of doctors and I only met this primary one time after 6 years of being with her.

    So if I have credit card debt for around 20K, live and work in Texas with no wage garnishment, live in a rental apartment and no assets at all, what are they going to go after if they sue me? Will they sue?

      I live in Texas and was sued by two third party debt buyers. I was able to beat the lawsuits on my own by conducting research on the topic. It maybe a bit more challenging to win an original creditor lawsuit but it’s still possible.
      Even if you end up settling ,you still have to fight to get them to give you a good settlement rate.

      All you need to do is release the credits on the statement the part that they give you that says the payment is due ya look it up on robots and Patriots you can look up Patrick Devine you can look up Christopher Houser and they'll show you how to do it also never talk to them on the phone don't ever admit you have a debt and if they send it to somebody else to collect it you don't have any affiliation with that company that they send it to collect their debt.

      @solosuit yeah I left you a bunch of messages lol I have a lot of legal battles going on right now I'm trying to get tenants out of my house they create extra hearings to take advantage of you and take money out of your you know Legacy account that's in the treasury and and when you find you know when you file in agency cuz you're broke they they go into your treasure your treasury account citizenship to get access to it so I don't have the whole number I'm not sure how it works and I sent out the negotiable instruments and they tried to cash them through my accounts my private accounts so they said there was insufficient funds on my kids are not checks what I sent you is not a check you have to go to the bank to the window and that the bank and cash it for the treasury and they're supposed to release the credits into your account. Well they all said they didn't get them even though I said certified mail and I know they got them and I got you know delivery receipts from the post office and they said they didn't get them. I talked to Xfinity and I talked to two different girls and both of them said they couldn't process it properly didn't send me a statement with me submitting it and then filing putting a refund to get back into my account and charging me late fees and bounce fees, Two months in a row. They never sent it back to me I said why don't you send them back to me oh we never got them yes you did because your reps talked to me about them now I have a statement showing that you got them and tried to process them wrong and then you send me to the billing department and that guy says they never got them .
      I wrote Aletter together Fina cial ceoof Comcast, someone tried to call me twice and it went straight to voicemail but I wasn't going to talk to them on the phone I want everything in writing. So they shut my service off for a few days before I could get it back on I had to make some arrangements to make a payment I said well I already sent you two and you didn't send it back so you must have processed them. And I guess when you send them cash again you're opening up your account you're opening reopening your contract with them which is ridiculous also the guy said I can't cancel my contract cuz I got a 2-year agreement which I never signed an agreement I never ever get an agreement and then what they did was they just took $170 out of my account without my permission and I don't know how I looked it up and they went in and they turned on auto paint because you can look at my account going back 10 years and you'll never see auto paycheck so they did that to get their money that was illegal what they did.

      @solosuit the electric company never heard of them never heard from them but I'll never would answer my calls like they just they just did not apply it and I sent them $10,000 twice for credits for the for the Federal Reserve and they never talk to me you know their reps just said no we didn't get anything they are denying it even though I got it went to a PO Box I got proof of delivery. And then at least they haven't shut me off yet and then the water company said they didn't get it and I said I have a proof of delivery I talk to them on the phone again. And I also wrote their CEO you know whoever it was the highest up at the water company and that guy's really mean and nasty I've met him before I'll never go back to the water company and they don't let you go there physically. So I called and called I had to go down to wayfinders and have them pay it and they never returned my negotiable instruments so obviously I'm missing a step here and I'm guessing that it's because I didn't file a 56 form a a UCC form.

      And another thing is I guess you got to lose your citizenship in order to collect your money so as a citizen you get robbed when you get a birth certificate they robbed you and they make you a bond and they sell you all over the world then you have tons of identity theft but they don't take responsibility for that they don't even tell you they're selling you everywhere I've got 99,000 in treasury in paper bonds series E, I'm not able to exchange it into digital or to take it and put it in another account or get access to it at all and that paid off my house get me right out of debt. Camper van or something so I can get out of here and get my house sold. And my taxes went up 34% this year 2.5% limit
