Israel Has Enjoyed Decades of Legal Impunity. Could the War on Gaza Finally Change That?

    We speak with two experts in international criminal law about the long history of Palestinians attempting to seek justice in global institutions and the “very grave crimes” for which Israel is being prosecuted regarding the country’s ongoing assault and siege of Gaza. Chantal Meloni, an international criminal lawyer who represents victims in Palestine before the International Criminal Court, lays out the history of cases brought before the ICC regarding Israel’s siege and collective punishment of Palestinians being denied justice for more than 14 years. “The fact that there was no accountability for the last decades of occupation and crimes related to the occupation has created a sense of impunity,” says Reed Brody, a war crimes prosecutor, who reports this new assault on Gaza has forced ICC chief prosecutor Karim Khan to confront Israel. “Will this be followed up by real action for the first time?”
    Ruth Ben-Artzi, the niece of Israeli Prime Minister Benjamin Netanyahu, joins Democracy Now! to call for the Netanyahu government to focus efforts on releasing Israeli hostages and to stop the bombing. A professor of political science at Providence College, Ben-Artzi recently joined prominent Rhode Island rabbis, Jewish leaders and Israelis demanding a ceasefire in Gaza. “A ceasefire is really the only way that any solution can be achieved,” says Ben-Artzi, who explains why military actions will never resolve this conflict and that “finding a political situation … is really the only way that the roughly 7 million Jews and 7 million Palestinians who live between the river and the sea will ever be able to find peace.”

    At 8:27: International bodies, the ICRC, the UN, the ICC, have considered that Gaza is still occupied territory (by Israel). This means that Israel bears very specific duties and responsibilites with regard to the civilian population of Gaza (instead there are grave violations of international humanitarian law and hence law of war). ~ Chantal Meloni

    Before October 7, there were violations, arrests, and killings of Palestinians, so Hamas, a Palestinian resistance movement, came to respond to these insults.
    But the Western media describes what happened as an attack and not a reaction to what the Netanyahu government has done since it took office.
    Netanyahu delayed the two-state solution because he wanted settlement out of the desire for land and for the Palestinian people to be subject to him at all times

      You would have to look at having AIPAC and other Israeli government lobbyist groups register as foreign agents, since they serve Israel, a foreign government. AIPAC claims to have funded most of the House of Representatives in both political parties. Look at their website. They are already funding the future opponents of those Progressive politicians who have spoken up in Congress and asked for a ceasefire. We need to make sure that we do not elect future politicians that receive money from AIPAC or the superpacs they contribute to. That is the only way we will get politicians are not puppets.

    The inability of the UN to actually seek justice for the Palestinians is evidence that it's obsolete and a dysfunctional entity. The people of the world must understand that it's up to them to effect much needed change. It starts with being very cautious about who we elect the products we buy. As an American citizen I believe its time to reassess our controlled political parties that are more preoccupied with keeping the donation hussle intact than they are with working for the people. Currently our politicians work for AIPAC this conflict makes it very clear at critical times of financial struggle most if not all Americans know we just cannot afford two wars when the entire United States is in decline. It's truly disgraceful being trillions in debt homeless poverty everywhere and we can spend money on War Crimes!     About the "240 hostages": I checked Ha'aretz that lists the photo, names and status of the hostages. I counted 196 persons. I counted 22 children under 18. The list also identifies the race or citizenship of hostages. As such I estimated 150 are Israeli military members or reserve.

Now social media has made it easier for people all over the world to find alternative media that is more honest in how they cover issues like this. Social media also makes it easier to organize a protest and feed the images to an audience much faster. That is why the protests are growing all over the world.

    I normally have watched this conflict fairly passively over the decades, but this time it is absolutely horrendous. I am extremely disappointed in the USA and the UK politicians, as they have demonstrated a total lack of humanity. I think we are actually seeing, what has been in plain sight for many years, and this is the totally uncaring nature of western politicians, which makes Putin look like an angel!
    This wester reaction is something I will never forget, and I actually think we need to find a different way, a more representative way to elect politicians.

    The Al Qasam Brigades which have a military style of fighting attacked on 9/7 with small arms in the first place military bases in Israel and killed a lot of soldiers. In addition, they took hastages to be exchanged for Palestinian prisoners in Israel. Many of civilians killed were victims of Israeli helicopters due to the turmoil of the situation and the difficulty to distinguish. The completely burned victims, for example, that were shown by Israel could not be the result of Al Qusam's light weapons.

    Israel has effectively put an end to a two state solution with the expansion of settlements - in fact, I would suggest Israel has never intended for there to be two states.

    I did not know what is going on in Palestine at all until October 7. Never saw or heard anything on the main news. Maybe once in a while there was a brief reference in the Western, national news but it did not wake me up. Now I used the time since October 7 to study and research why this massacre and all that followed happened and I can see the causes go way back. October 7 is rather a consequence of necessity. How else do you escape occupation, harassment, apartheid, random killings, land grab and so on. Maybe all the countless revolts, uprisings and revolutions since humankind began share moments like this where some people take matters into their hands and go up the barricades. Nat Turner did, too, fighting violently for the abolition of slavery and all for the better in the end. Those who rise up, will they be judged heroes or fanatics? I think Palestine will now re-awaken and Israel will lose. I hope it will work out this way. Palestinians deserve a state and nationhood. They will continue to fight for it. Israel must be punished. And so many so-called leaders in the US, EU and UK need to be put to shame and voted out.

    I was Listening to The Statement from these two legal experts. Reed Brody was Based. He gave many statements about the conduct of the IDF, He spoke about proportionality . However it did not say one positive Statement If the IDF was criminal. On the other hand ,When he started talking about Hamas, He gave a verdict, That Hamas committed war crimes. How could he do that? He should not be allowed to be a judge, He already surrendered and opinion. His neutrality is jeopardised
