Thank you! And now that my son has a 1:1 aide, can I request for her to be present at the IEP meeting? She is never "invited" and I feel that's why we keep on playing telephone!

Typically 1:1 aides do not go to IEP meetings, but you could ask for her to provide data to the teacher to share at the meeting.

From late elementary or middle school age up, I would encourage parents/guardians to request that their child be put with an aide who is of the same gender (or who was assigned the same gender at birth) as the child. Before anybody goes off on me, this is not meant to be sexist. This is just in case the child ends up needing to discuss certain things that the opposite gender (or those who were assigned the opposite gender at birth) most likely has never, and will never have to deal with firsthand. Now, in the younger grades (such as pre-K or early elementary school), it really doesn't matter whether or not the aide is of the same gender as the child, because unless the child has had precocious puberty, they most likely will not need to discuss certain issues that the opposite gender might not feel comfortable discussing.

My grandson has a one on one aide who has made tremendous strides with him! The teacher who has treated my grandson like a piece of garbage has had issues and we just found out this aid is being replaced. Is that legal per our IEP? My grandson is going to be brokenhearted along with all of us he was starting to engage with children for the first time in his life.

My grandson needs help in all aspects of the day…
He was missing school we could not get him to school. He was not engaging in any aspect of the day.

It depends. Is a one on one aide written in his IEP, or is this a classroom aide that is for all the children? If it's written in his IEP that he is to have an aide, then they have to replace this aide with another one. If they don't replace the aide, then that is an IEP violation. Here's the thing, if the school doesn't have a replacement right away, there's really nothing you can do. You would probably have to wait until one is made available. I hate to say this (as I truly understand your worry), but it's perfectly legal for aides to leave. I'm not an advocate, but I'm just a mom who had to deal with special education and IEP's for both of my sons. It was a never ending (and exhausting) battle trying to get the right supports for them. One piece of advice I'd like to give you: get everything in writing! Even phone calls from the school can be documented by emailing a summary of what the phone call was about to the IEP team. Documentation is your secret weapon! Best of luck to you and your grandson.

Are you supposed to ask for an iep meeting or write a letter to ask for assessments for data for the iep meeting first? And what assessments would help me build my case if so?

My daughter has been granted a FAPE in the amendment of her IEP to refelect additional supports in transitions. As the school celebrates her independence she is NOT eating her lunch. The aid showed in her data that my 5 yr old can open her ziplock bags at lunch, great she can do step one. Due to the chaos of lunch time noise, adults yelling children all over she is not eating her lunch resulting in meltdowns at pickup. I am at my wits end trying to show she NEEDS support during certain times and not ALL the time.. at pickup her behavior is pure HANGRY and malnourished. This is BEYONG frustrating as I have tried to compel she needs services i am not being heard or understood. Right now denial of a 1:1 aid . I am taking her potty as she refuses to potty with anyone else and is taken to a private bathroom. Can you assist me? ANY tips are greatly appreciated

If your daughter is being educated in the general ed setting with support, they can't take her out of that environment if she's not having issues and doesn't need assistance with feeding herself. If she needs to eat lunch away from her peers, she may need to be in a self contained SE class, which you can request at the ARD.

@@tiffanywatson8316 thank you so much for feedback its appreciated. Unfortunatly after my coment above, and two other iep meetings after I determined the school was lying to me about her needing constant redirection in the classroom setting, because you know if she "didnt do it its not documented" which i asked for documentation and communication and was met with full resistance. I unenrolled her with that district and tried a private school to be told this little girl needs a 1:1 aid for her redirection. The school was lying to me and clearly so based on her bahvior. i opted not to do an IEE for now but enroll in a separate district next year. thank god kindergarten is compulsery and we will keep her social via other enrichment activities for now 😞
