@@digitalsparky there needs to be institutions for those who have conditions that are not compatible with society. It needs to be done better, but there are people who will never comply with court orders willingly, and will remain psychotic and a threat to others. We simply dont have a cure for everything. But if you knew just how bad the circulating door is for some of these patients, you would understand it is a necessary function, just like prisons. It needs more accountability and regulation, but if a court declares someone unable to care for themselves and a danger to themselves or others permanently, they need a place. You can even have yearly court hearings if the person even has a capacity to appeal or challenge it, but generally these kind of people do not. Psych facilities right now can force you to take meds but in 2 weeks when you get better they are required to let you go. These people will immediately stop taking any medications or treatment. This has led to many murders or suicides.

According to Cornell Law School's Legal Information Institute: To prove prima facie defamation, a plaintiff (Acerthorn) must show four things: 1) a false statement purporting to be fact; 2) publication or communication of that statement to a third person; 3) fault amounting to at least negligence; and 4) damages, or some harm caused to the reputation of the person or entity who is the subject of the statement. After having read through the complaint, I am unable to find anything substantive in it. It is an amalgamation of pseudo legalize, conjecture, and opinion. Acerthorn's filing contains some of the most ludicrous, childish, wordy, and disturbing "examples" I've seen in a single document. If he represents himself, the judge and your lawyer are going to destroy him, and he'll likely be blacklisted as a vexatious litigant within the U.S. Circuit Court Northern District of California, requiring judicial permission to file any future litigation. You've got this Sid. Please get a picture of his face when he's told he has to pay your lawyer fees and court costs... it will be PRICELESS!! 😁

Definitely, he admitted to a psychiatrist that he fantasizes about kidnapping, torturing, and killing people who anger him. He also admitted to University of Arkansas faculty that he fantasized about hurting his father (which makes his claim that he didn't assault his father ring hollow). I'm pretty sure the only thing that's stopping him from lashing out violently at the people he's suing is that he doesn't know where most of them live, and he's too poor to travel.

His footnote on this is just the cherry on top of everything. Basically, some Super-Karen tried to sue a man for 10.000$, because of "intentional emotional damage", caused by him not showing up for a 2nd date. I’m gonna recommend that you file a counter suit against this fool. Not only is this fool, a vexatious litigant, but at this point, I would be contacting my lawyer and filing criminal charges against this guy. At which point will the courts say - Stop you are no longer allowed to file personal claims and must be represented by an attorney who will file motions and documents on your behalf. It does take a lot to annoy the courts to reach that point so I'm wondering how far along that path has already been travelled.
Seeing my experience with courts: A lot. Declaring someone as vexacious is a big deal for the courts, but if you poke the bear enough you'll have your head ripped off.

This court rules in favor of the defendant and the plaintiff is ordered to cover all legal fees for both parties, he is ordered to take back all DMCA strikes he has EVER made. And this court orders that this man be put into an insane asylum for the rest of his life. While we are at it. TH-cam is also ordered to no longer require that someone provide a full name and address to another in a counter claim as there is NO reason for it. And it is ordered to cease the use of AI in processing DMCA claims. As it is frankly incapable of properly doing what you are using AI to do.

This guy has filed far too many of these baseless lawsuits where he represents himself at this point. He has lost so many of them already, and continues to do this. The courts are slow on taking action on this because the rights, like the right to represent yourself are supposed to be upheld, and only taken away as a last resort. The time has come though. This is why the US system of paying your own fees is garbage. Here, Acerthorn would have been bankrupted 10 times over and paying off the debt he incurred for the rest of his hopefully short life. @@charlesfuzak The ability to file a lawsuit is an essential liberty, it must never be removed. Vexatious litigation registry means any lawsuit must pass inspection before it can be filed, such limitations are limited to only include terms where a history of abuse exists.

Over a million dollars in medical bills for that? Bullshit. Literally just got the bill for my fathers emergency surgery in December for his perforated ulcer and associated severe infection among other complications landing him in the ICU for 17 days and then normal care for another 6 in MASS which is one of the highest for healthcare prices and it didn't breach a million. Also he has to be just throwing everything at the wall to see what sticks right? I mean he can't really be that delusional right? What happened is that Creetosis, and his friends where covering a few of Acerthorns videos. Acerthorn showed up in Creetosis's chat wanting to debate him, so both of them had a back, and forth on Discord. What got Acerthorn mad was Creetosis, and his friends where making fun of him because of how bad he was at playing Fallout New Vegas saying that "People like Acerthorn are the reason why there is warning labels on Bleach not to drink it" this pissed Acerthorn off so much that months later he was complaining about Creetosis in streams that had nothing to do with him, and one of Creetosis friends where watching one of those steams where they had a debate that resulted in Acerthorn just talking shit to them simply because they made the Bleach joke. This is just scratching the surface though. SidAlpha is basically just a new scapegoat for Acerthorn due to Sids influence.

What this guy did (among many other things) is that he got really mad when Creetosis and his friends covered his video "Fallout: New Vegas Retrospective" and pointed out how it is such a bad review he hasn't even played the full game before he gave a "Retrospective" or "in-depth review". This reminds me of something Steve Lehto routinely says, "A person who represents himself in court has a fool for a client." 1. Malice Intent wording in most defamation laws is one of the standards used to decide if a particular bit of speech is defamatory. It's one of the tests the speech in question has to meet (or fail to?) in order to be deemed defamatory. It is not an "extra damages" clause to be triggered, as he seems to argue. Depending on WHOS statutes being used, there may be clauses for extra damages, but it's not if the intent behind the speech was malicious. 2.a. The Public Figure versus a Private Person clause in most defamation statues is also not a stipulation for extra damages to be awarded. It merely raises the bar for what a Public Figure need to show to prove defamation versus what an ordinary person needs to show. The idea is that a public figure is expected to be the target of criticism and shouldn't be using the statute to smack down legitimate criticism of them. 2.b. Depends on how the statute he's using was written (i.e. the relevant law in the jurisdiction he's filing in), as the head of and public face for a software development studio (even a studio of one person), it could be ruled that he is a public figure in this regard and needs to meet that higher standard to prove he's been defamed. Public Figure status isn't limited to just Hollywood celebrities and politicians. 3. Most defamation statutes do not include incarceration as a measure for relief. Incarceration is a penalty reserved for criminal cases, and this is a civil case. Now, a judge could order a person to jail for Contempt of Court, but that would only be if someone deliberately failed to follow instructions issued by a judge. No lawyer would ask for jail time in a civil matter. 4. Courts can't order mind control as part of the judgement. It's understood that generally the judgement to make an injured party whole is going to be monetary, especially since there is no "undoing" many injuries (both literal and metaphorical) a person could have sustained. The judge can order certain actions to be taken in order to limit the harm, such as publishing a public retraction of the offending statements. But in no way could or would a court ever order someone to "Make everyone believe" a certain viewpoint. The courts understand that, even if the defendant were to issue a full retraction and publish it in the top 50 newspapers in the country, the harm experienced by the plaintiff has happened and cannot be undone. "Sorry, Kid. You don't get your reputation back, but here's a pile of cash to dry those tears with." is pretty much how it goes. 5.a. People can argue that part of the injury sustained be actual injuries and illnesses, but it most be demonstrated that the events and the injury/illness are linked beyond, "I got sick during this time, so it must be linked." 5.b. There's a formula the courts use to determine damages. It's not, "Let's pick a number out of thin air." It's generally missed wages from loss of work and only the part of the medical bills not paid by other parties (i.e. medical insurance or, in this case, the Federal government as part of Medicare/Medicaid). For example, if I were struck by a car due to someone's reckless driving, I sustained a hospital bill of $30,000.00 USD, and my insurance paid 2/3rds of that bill, I can only claim damages of $10,000.00 USD, not "One Million Dollars" or even the $30,000.00 USD hospital bill. (Depending on the circumstances and the laws of where the injury took place, my insurance might go after the driver for their portion of the bill.) Likewise, the lost wages won't be some magical number picked out of air. It's usually based on some hourly rate multiplied by 40 hours per week. And with non-scale work, like gig work, contract work, and other non-structured pay, they look at the earnings from the previous year (or some set period of time) to figure out what you would have earned during the period of lost wages. Sure, I could claim as an aspiring writer that taking time out of writing to write this has caused me an injury in the form of lost work hours and sue both Acerthorn and SidAlpha for "One Million Dollars", but seeing I haven't made anything from writing yet and I wrote this outside of work time for my normal job, I can't ask for squat. 5.c. HIPAA WILL NOT PROTECT YOUR MEDICAL RECORDS IF YOU BRING UP MEDICAL ISSUES IN COURT! Should you bring up an illness and/or injury as either the plaintiff or defendant in a lawsuit, HIPAA will not stop the other party's lawyers from getting a subpoena for your medical records. Sure, it won't be for everything you ever saw a doctor for. For instance, if there's a claim that a SidAlpha video made you physically ill to the point of hospitalization, his lawyers can't ask for your medical records from a psych stay in 1996 because you thought Marge and Homer Simpson were trying to kill you by hypnotizing your cats. They can only ask for medical records for the time period around the video when the supposed injury took place. If you don't say anything about a medical issue as part of your legal pleadings, the other side can still ask for the medical records. But it's a much harder to ask, as they have to prove your medical issues (or lack thereof) are part of their case. But if you make your medical history as part of your case, you're basically making the other side's argument for needing access to your medical records. 6. You can't include "Unrelated Defamation and Harassment" in your case against someone. It's either related to the case and the other side had some culpability, or it's not and you're barking up the wrong tree. If tomorrow, SidAlpha were to produce a video about me and I sued him for defamation, I can't include the thinks the bully from my fifth grade class in Jacksonville, Arkansas said as part of the case. They're not related. Now, if SidAlpha were to put a video out about me, the same said bully saw it, looked me up, and started harassing me about the video's content, that's related. I'd be hard pressed to show that SidAlpha's video traveled back in time in order to encourage the bully to harass me in fifth grade. Looking at this, it's probably a good thing no lawyer is representing Acerthorn. Signing your name to this is a good way to finding yourself in front of a state bar's review board. I'm not a lawyer, and I can plainly see this thing is a stinking pile of horseshit. I don't know of any lawyer who would put their professional reputation on the line by signing this document and submitting it to the court.
For those who aren't yet aware, there is a very good reason why representing yourself is a very bad idea. It's very easy to lose control and say something that makes you look bad in court. First, a qualifier that I am by no stretch a legal expert, I am by no means qualified to give legal advice, and it would not take long to spot the details for this qualifier. With that done... From reading Acerthorn's argument, all I can think of to describe it is the Family Guy episode where Peter Griffin seceded from the US and later used the Geneva Convention to justify him annexing Joe Swanson's pool. To clarify: "Well, according to Section 3, Paragraph 4, Sentence 7, Word 8 of the Geneva Convention, 'the.' So tough luck, Swanson." Frankly, Acerthorn being blacklisted as a vexatious litigant should be the absolute minimum punishment issued. Given that he rather strongly implied a physical threat against you, SidAlpha, and/or others, he should be imprisoned for conspiracy to commit murder, terrorism, or whatever the appropriate crime(s) would be.
You know, when this whole situation was going underway, I was reminded of Digital Homicide and their lawsuit against Jim Sterling, but when we got to the bit about what exactly he wanted in the form of damages and things he wanted the court to force you to do, I now realize that he must have taken a look at what what Digital Homicide tried to do to Jim, and took that as a score sheet to try and one-up. I really hope that he gets served a harsh reality check because of this nonsense.

It needs to be done better, but there are people who will never comply with court orders willingly, and will remain psychotic and a threat to others. We simply dont have a cure for everything. But if you knew just how bad the circulating door is for some of these patients, you would understand it is a necessary function, just like prisons. It needs more accountability and regulation, but if a court declares someone unable to care for themselves and a danger to themselves or others permanently, they need a place. You can even have yearly court hearings if the person even has a capacity to appeal or challenge it, but generally these kind of people do not. Psych facilities right now can force you to take meds but in 2 weeks when you get better they are required to let you go. These people will immediately stop taking any medications or treatment. This has led to many murders or suicides.

Definitely, he admitted to a psychiatrist that he fantasizes about kidnapping, torturing, and killing people who anger him. He also admitted to University of Arkansas faculty that he fantasized about hurting his father (which makes his claim that he didn't assault his father ring hollow). I'm pretty sure the only thing that's stopping him from lashing out violently at the people he's suing is that he doesn't know where most of them live, and he's too poor to travel.

This court rules in favor of the defendant and the plaintiff is ordered to cover all legal fees for both parties, he is ordered to take back all DMCA strikes he has EVER made. And this court orders that this man be put into an insane asylum for the rest of his life.

Literally just got the bill for my fathers emergency surgery in December for his perforated ulcer and associated severe infection among other complications landing him in the ICU for 17 days and then normal care for another 6 in MASS which is one of the highest for healthcare prices and it didn't breach a million.

The example Acerthorn uses here makes me fairly uncomfortable. Why would he want to suggest anything about Kidnapping and murder in a defamation claim?
He's projecting his violent fantasies into SidAlpha. In one of his court documents he fantasizes about kidnapping, torturing, and killing people who anger him, Sid has angered him so he want's him dead.
This lawsuit has me looking at my drink and questioning if someone spiked it with LSD. I do not have the vocabulary to even remotely begin to describe my thoughts on this.
A lot of demands and ranting in his latest attempt but in reality he demands nothing and thus he will get nothing. Acerthorn is in a position to demand nothing.
I keep telling people who get this crap the same thing but no one listens. You need to make an example of him Sid.
Counter Sue him for harassment, for abuse of process, and for wrongful prosecution. Fight for every dime in damages you can get. And when he refuses to pay or cannot pay, you foreclose on him. Get the judge to order it. Show up at his apartment with a truck, and the police and just start taking things. Take EVERYTHING. You're not going to get what the court order says you're owed, who cares. TAKE EVERYTHING. His computer, sans harddrive cause that you can't have as it has his personal info on it and isn't subject to foreclosure, but the rest of the box is. (This stops him from filing more bullshit suits btw). Take his desk, his chairs, his bed. Take everything. The ice cube trays out of his fridge AND THE SHIRT OFF HIS BACK.
LEAVE HIM WITH NOTHING. Then... once the 'property' is yours. Go 500 ft from wherever he happens to be, and have a burn party, where you burn his former possessions and make a video about it. Make sure he can see you do it. And smile at him while you do.
MAKE AN EXAMPLE OF THIS SHITBIRD SO THAT HE UNDERSTANDS NOT TO CONTINUE DOING THIS AND SO THAT OTHERS ARE AFRAID OF LOSING IN THE FUTURE AND ABSTAIN FROM THIS SHIT.
Make sure that people say in the future that someone is going to get 'sidalpha'd' in response to abuse of the DMCA. That should be your goal.

What happened is that Creetosis, and his friends where covering a few of Acerthorns videos. Acerthorn showed up in Creetosis's chat wanting to debate him, so both of them had a back, and forth on Discord. What got Acerthorn mad was Creetosis, and his friends where making fun of him because of how bad he was at playing Fallout New Vegas saying that "People like Acerthorn are the reason why there is warning labels on Bleach not to drink it" this pissed Acerthorn off so much that months later he was complaining about Creetosis in streams that had nothing to do with him, and one of Creetosis friends where watching one of those steams where they had a debate that resulted in Acerthorn just talking shit to them simply because they made the Bleach joke.
This is just scratching the surface though. SidAlpha is basically just a new scapegoat for Acerthorn due to Sids influence.

@@mikebirks2336 Acerthorn is the kind of guy that sue Amazon for 100k billion dollars with a scam all involving him sending them 1 dollar and a contract. They have to send thgat dollar back to him within 2 business days or they accept the terms of the contract which allows him to sue for 100k billions or dollars in damage.
What this guy did (among many other things) is that he got really mad when Creetosis and his friends covered his video "Fallout: New Vegas Retrospective" and pointed out how it is such a bad review he hasn't even played the full game before he gave a "Retrospective" or "in-depth review". He never even encountered most of the factions you can join.
He also played Dark Souls 1 and was so bad at it he gave a review of it without even getting past the starting areas and blamed his audience for "lying to him" because they didn't watch him not getting past a unlocked door.

1. Malice Intent wording in most defamation laws is one of the standards used to decide if a particular bit of speech is defamatory. It's one of the tests the speech in question has to meet (or fail to?) in order to be deemed defamatory. It is not an "extra damages" clause to be triggered, as he seems to argue. Depending on WHOS statutes being used, there may be clauses for extra damages, but it's not if the intent behind the speech was malicious.
2.a. The Public Figure versus a Private Person clause in most defamation statues is also not a stipulation for extra damages to be awarded. It merely raises the bar for what a Public Figure need to show to prove defamation versus what an ordinary person needs to show. The idea is that a public figure is expected to be the target of criticism and shouldn't be using the statute to smack down legitimate criticism of them.
2.b. Depends on how the statute he's using was written (i.e. the relevant law in the jurisdiction he's filing in), as the head of and public face for a software development studio (even a studio of one person), it could be ruled that he is a public figure in this regard and needs to meet that higher standard to prove he's been defamed. Public Figure status isn't limited to just Hollywood celebrities and politicians.
3. Most defamation statutes do not include incarceration as a measure for relief. Incarceration is a penalty reserved for criminal cases, and this is a civil case. Now, a judge could order a person to jail for Contempt of Court, but that would only be if someone deliberately failed to follow instructions issued by a judge. No lawyer would ask for jail time in a civil matter.
4. Courts can't order mind control as part of the judgement. It's understood that generally the judgement to make an injured party whole is going to be monetary, especially since there is no "undoing" many injuries (both literal and metaphorical) a person could have sustained. The judge can order certain actions to be taken in order to limit the harm, such as publishing a public retraction of the offending statements. But in no way could or would a court ever order someone to "Make everyone believe" a certain viewpoint. The courts understand that, even if the defendant were to issue a full retraction and publish it in the top 50 newspapers in the country, the harm experienced by the plaintiff has happened and cannot be undone. "Sorry, Kid. You don't get your reputation back, but here's a pile of cash to dry those tears with." is pretty much how it goes.
5.a. People can argue that part of the injury sustained be actual injuries and illnesses, but it most be demonstrated that the events and the injury/illness are linked beyond, "I got sick during this time, so it must be linked."
5.b. There's a formula the courts use to determine damages. It's not, "Let's pick a number out of thin air." It's generally missed wages from loss of work and only the part of the medical bills not paid by other parties (i.e. medical insurance or, in this case, the Federal government as part of Medicare/Medicaid). For example, if I were struck by a car due to someone's reckless driving, I sustained a hospital bill of $30,000.00 USD, and my insurance paid 2/3rds of that bill, I can only claim damages of $10,000.00 USD, not "One Million Dollars" or even the $30,000.00 USD hospital bill. (Depending on the circumstances and the laws of where the injury took place, my insurance might go after the driver for their portion of the bill.) Likewise, the lost wages won't be some magical number picked out of air. It's usually based on some hourly rate multiplied by 40 hours per week. And with non-scale work, like gig work, contract work, and other non-structured pay, they look at the earnings from the previous year (or some set period of time) to figure out what you would have earned during the period of lost wages. Sure, I could claim as an aspiring writer that taking time out of writing to write this has caused me an injury in the form of lost work hours and sue both Acerthorn and SidAlpha for "One Million Dollars", but seeing I haven't made anything from writing yet and I wrote this outside of work time for my normal job, I can't ask for squat.
5.c. HIPAA WILL NOT PROTECT YOUR MEDICAL RECORDS IF YOU BRING UP MEDICAL ISSUES IN COURT! Should you bring up an illness and/or injury as either the plaintiff or defendant in a lawsuit, HIPAA will not stop the other party's lawyers from getting a subpoena for your medical records. Sure, it won't be for everything you ever saw a doctor for. For instance, if there's a claim that a SidAlpha video made you physically ill to the point of hospitalization, his lawyers can't ask for your medical records from a psych stay in 1996 because you thought Marge and Homer Simpson were trying to kill you by hypnotizing your cats. They can only ask for medical records for the time period around the video when the supposed injury took place. If you don't say anything about a medical issue as part of your legal pleadings, the other side can still ask for the medical records. But it's a much harder to ask, as they have to prove your medical issues (or lack thereof) are part of their case. But if you make your medical history as part of your case, you're basically making the other side's argument for needing access to your medical records.
6. You can't include "Unrelated Defamation and Harassment" in your case against someone. It's either related to the case and the other side had some culpability, or it's not and you're barking up the wrong tree. If tomorrow, SidAlpha were to produce a video about me and I sued him for defamation, I can't include the thinks the bully from my fifth grade class in Jacksonville, Arkansas said as part of the case. They're not related. Now, if SidAlpha were to put a video out about me, the same said bully saw it, looked me up, and started harassing me about the video's content, that's related. I'd be hard pressed to show that SidAlpha's video traveled back in time in order to encourage the bully to harass me in fifth grade.
Looking at this, it's probably a good thing no lawyer is representing Acerthorn. Signing your name to this is a good way to finding yourself in front of a state bar's review board. I'm not a lawyer, and I can plainly see this thing is a stinking pile of horseshit. I don't know of any lawyer who would put their professional reputation on the line by signing this document and submitting it to the court.
For those who aren't yet aware, there is a very good reason why representing yourself is a very bad idea. It's very easy to lose control and say something that makes you look bad in court. Having a third party that isn't personally involved with the case itself makes for a much better representative. I mean not even lawyers represent themselves in court; they pay other lawyers to do it for them.
This is what happens when there's no consequence for abusing copyright and filing spurious suits. Enough is enough. That guy needs to be sent to prison.

THEORETICALLY you can use the hospital bill as the basis for a 'pain and suffering' award, even if it was covered under insurance or medicaid. But first one would need to prove directly that Sid was the cause.
They really need a law that makes the party that sues someone pay the legal cost of the defendant if they lose, like Australia.

First, a qualifier that I am by no stretch a legal expert, I am by no means qualified to give legal advice, and it would not take long to spot the details for this qualifier. With that done...
From reading Acerthorn's argument, all I can think of to describe it is the Family Guy episode where Peter Griffin seceded from the US and later used the Geneva Convention to justify him annexing Joe Swanson's pool. To clarify:
"Well, according to Section 3, Paragraph 4, Sentence 7, Word 8 of the Geneva Convention, 'the.' So tough luck, Swanson."
Frankly, Acerthorn being blacklisted as a vexatious litigant should be the absolute minimum punishment issued. Given that he rather strongly implied a physical threat against you, SidAlpha, and/or others, he should be imprisoned for conspiracy to commit murder, terrorism, or whatever the appropriate crime(s) would be.
You know, when this whole situation was going underway, I was reminded of Digital Homicide and their lawsuit against Jim Sterling, but when we got to the bit about what exactly he wanted in the form of damages and things he wanted the court to force you to do, I now realize that he must have taken a look at what what Digital Homicide tried to do to Jim, and took that as a score sheet to try and one-up.
I really hope that he gets served a harsh reality check because of this nonsense.
Acerthorn has a long history of suing people, and demanding ridiculous things from the people, company's, states, and places he tried to sue, so he was doing this long before the Digital Homicide situation. He did side with Digital Homicide during that lawsuit, and made a video about it which is not surprising considering his history of using the court system as a weapon to silence, and extort money from people.
