I was arrested after failing a drug wipe in 2015, having been pulled over for alleged speeding. I have a phobia of needles and that is well documented in my medical records. It happened pretty much as you have described at the front desk , checked in etc. When blood was requested I explained that the last time my Dr tried to take blood I fainted and was in and out of fainting for 4 hours. As it was Christmas day I could see the idea of a person in custody having a similiar drama did not appeal to the officers. The desk Sergeant accepted this and I provided a urine sample. I was bailed and released after about two hours. I recieved a No Further Action letter three weeks later.
Well done Alien. I'm truly shocked.😱 Is that all it takes? I wonder if you're better off refusing the needle, or getting your solicitor to do his job later? If doing what you did works, it's a no brainer.😊 What did you fail for? Coke or weed, or both?
@@MrBollocks10 It was weed. My only vice these days. Point here is I had vaped the weed two nights before...and note I have no tats because...I have a needle phobia. So if you are tatted - it won't wash saying you have a needle phobia.
I was arrested an charged with failing to provide a blood specimen but I said no because I have a phobia of the needle going in the crease of the arm , not a needle phobia but I didn't refuse the blood test I offered to have it taken from somewhere else an the nurse never followed it up . I'm still waiting to see what happens now . So the way I see it at the moment is I'm not guilty because I didn't refuse it I just said not In the crease because I can't hack it but I did state straight away you can take blood from anywhere else .
How long ago was that , Anthony? Don't they have to charge you within a certain time frame? I don't know.🥴 If they've charged you, I'd get a solicitor. This one sounds on the ball.
What happens if the medical professional advises blood shouldn't be taken after medical exam and then the officer requests a urine specimen alternative. If the defendant does not consent to urine test and is charged with failing to provide a urine sample is there still a defence?
Btw I actually asked for a urine sample or breath alyzer test but the police declined. They suspected I had drank and fallen asleep at the wheel at 5am. I explained a family member had past away but my family kept it from me and I jumped in my car to go to my mothers house to find out what had happened and fell asleep at the traffic lights. I was 25 weeks pregnant and lost my baby at my hearing on the 24th October this year… I’m sooo angry!!
Failed to provide everything found two axes bb gun empty bags of drugs and various other things in my car cells for the night no comment the lot 600 quid fine and a year ban got of lucky I am 18 with a stable upbringing and alot of support
Would they want that? I would hope there's some sort of ethical guidelines, that would prevent him doing that. If not, just basic good manners. Let's not forget, these people are innocent.😀
Hello, please can you get back to me ASAP. My court case is on 16th January and my solicitor is messing me around. The police did not follow correct procedures and I genuinely have a needle phobia and I lost my baby at 25 weeks pregnant due to all of this stress the police have caused me. I seriously need help…. I’m a mother of 5 children which 3 of them are very disabled and need me to drive to get them around to have a normal life. I’m so stressed!!
My understanding, and I'm not a solictor, is that the law is absolute on this point. The standard for drugs in the system is much lower than that of alcohol, and medical cannabis taken for medical reasons still means you should not drive whilst cannabis is in the system.

Can you name the cases you've won claiming the needle phobia after providing the sample please?

The solicitor said, only blood can be used for drug levels.
Urine, wipes etc aren't enough to convict.

If you've got a prescription, you're fine.
As long as you don't admit you're impaired.
We have people driving around on Valium and Opiates.
..But because they are prescribed, it's hunky dory.😃
