A group of lawyers, legal academics and organisations aligned to or affiliated with the legal profession has spoken out against the front page Hobson's Pledge Ad placed last week in the NZ Herald. Here's the text of the statement (with very minor edits to fit character limits): The Hobson’s Pledge ad in The Herald on 7 August in relation to customary marine titles is likely to mislead, deceive or confuse consumers both explicitly and by implication, ambiguity, exaggeration and false representation. It is also likely to also fuel racism against Māori. Hobson’s Pledge are entitled to a 'robust expression of opinion' but are not entitled to mislead and deceive consumers and, in our view, The Herald should have known, or investigated, whether the information was misleading or deceptive before the advertisement was published. First, the advertisement calls for the “restoration” of the foreshore to public ownership. The foreshore has never historically been in public ownership: it is not owned by anybody, except for the areas of the foreshore that are currently in (mainly non-Māori) private ownership. Second, the ad implies, on the front page, that “customary marine titles” give iwi, hapū and/or whānau the right to own parts of the foreshore. This is not true. On the contrary, the legislation’s effective extinguishment of Māori property interests in the foreshore has been found to breach their human rights by UN human rights bodies that oversee New Zealand’s human rights compliance. Third, the ad implies that “customary marine title” will prevent NZers from accessing beaches, including to fish, to swim and to enjoy our coastal environment. This is not true. The legislation enabling the award of customary marine titles secures public access to the foreshore. Fourth, contrary to the impression created by the advertisement, there are very hard legal tests to be met before a wāhi tapu (including a rāhui) will be recognised. Moreover, wāhi tapu are subject to statutory restrictions, and cannot, for example, prevent fishers from taking their lawful entitlement in a quota or fisheries management area. Finally, in the light of the division and racism against Māori that resulted from the foreshore and seabed issue in the mid-2000s, we find the attempt to reignite that division and discrimination abhorrent. Signatories include the Māori Law Society, the Auckland Women Law Association, legal academics and lawyers - from King's Counsel, partners and barristers to junior associates, in-house lawyers and non-practising lawyers. yes, the problem is the term customary title [denoting propriety ownership... exclusivity]. If it were instead customary rights [of usage] no problemo.
In Australia- 60% of land now belongs to 3% of population. None of it has been even mentioned in any paper, any left wing media. Just one online Sky News Australia spoke about it. How good is that! This is getting pushed along after the referendum failed miserably. The Labor government does not represent 97% of my country! Good luck NZ, hopefully you are more vocal on these issues!
The media pool in NZ is quite tiny and owned by people who are not going to let anyone swim in that pool who are going to splash around too much. Those that do continue to bathe there know they only get to continue by only marginally disturbing the waters. A quite tempered style of swimming.
It's 2024, the Left says we aren't allowed to be just New Zealand erst. We must categorized by colour and culture. Not sure what will happen with all the immigrants National is flooding the country with , will think. They will probably get a new category, just for them.
And what is Labour whoops National doing about it - always get those two mixed up as same party different name. Not only do they do nothing National caused it. Can we have another election again soon please
Draw a distinction between right and title. Customary right is OK - because it does not entail exclusivity. A tribe has a right to use a stretch of coast while also allowing that others have a right [maybe the tribe has a right to catch more fish etc]. Customary title is not OK, if this entails a propriety title that effectively can exclude others from a stretch of coast.

Thank you, not enough New Zealand’s get to see your broadcasting of truths and common sense
Cowards, or were they paid off, like last time
With regard to expressing opinion. Ordinary new zealanders never have been able to. It's not a new thing. I always have been under numberous aliases on line. I have no profile anywhere, never have had. It's the only thing that allows me to say what I damn well please without nasty consequences visiting me in real life.
Same here.
The coastline belongs to not maori not pakeha , not any one! But MOTHER EARTH!!!
Who’s Mother Earth?
A. - ''China.'''
but their are stretchers of beaches where only access is through privately owned land which can be a worry for some
@@Duckz558 Can get there by boat though ....
@@susanpockett4314
most probably i would be ok with that i couldn’t deny anyone from going to the beach
but then again you wouldn’t like people going through your property without your permission? we’ve always asked 10 out of 10 has always worked
Boycott the herald- simple
Well done Michael, calling out the grifters and racists.
yes, the problem is the term customary title [denoting propriety ownership... exclusivity]. If it were instead customary rights [of usage] no problemo.
National had a mandate to change this maori a fication and they are gutless .
The Herald is not even fit for a fish & chip wrapper , it’s been that bad for years
New Zealand needs to embrace the concept of becoming a Constitutional Republic...
seriously..
What about what the same people did to Lee Williams for a satire video of NZs king of Super Racists, Rawiri Waititi?
Michael lays it out so well and with facts.
I thought we were taught to stand up to bullies... not capitulate to them. lol
All people who live in, or visit New Zealand are simply Custodians and caretakers of the Beautiful Coastlines for the next Generations
Oh please...was that on the minds of the white man that destroyed this country in the beginning!
Freedom of speech goes hand in hand with responsibility...... Unfortunately these days the latter is lacking.
Thank you Michael👋
The media pool in NZ is quite tiny and owned by people who are not going to let anyone swim in that pool who are going to splash around too much. Those that do continue to bathe there know they only get to continue by only marginally disturbing the waters. A quite tempered style of swimming.
When will this madness end !!!! We are all New Zealanders !
It's 2024, the Left says we aren't allowed to be just New Zealand erst. We must categorized by colour and culture.
Not sure what will happen with all the immigrants National is flooding the country with , will think. They will probably get a new category, just for them.
Bye Bye NZH go woke go broke
Is anyone surprised?
And what is Labour whoops National doing about it - always get those two mixed up as same party different name. Not only do they do nothing National caused it. Can we have another election again soon please
5 parties i get mixed up with all the same you kidding yourself if you think they ain’t the same
@@lifeliver9000 no point with an election they are all corrupt. Democracy doesn't exist.
good on ya Michael, it is shocking how one eyed they are
Draw a distinction between right and title.
And it's only going to get worse... 😢
100% correct, once again..
These days I never use NZ Herald, they became clickbait rubbish.
Thank Michael, hidden legislation passed under hush rules, just another point that needs to be addressed, our PM must face the people so how do we do this?have we access e mails to the Pm office.
Good one, Michael! Spot on!
