      you wouldnt just go to Japan and take thier beach and rivers why should you be able to do it here ..The chiefs agreed to retain the lands and resources. Govts then proceeded to take them and sell them to kiwis. Most of NZ is based on this and therfore Maori are not content and want thier true rights and lands returned

    Agreed. National need to rectify problem with herald rejection of hobsons pledge. National also need to disregard John key attitude and rectify the problem finnlayson created with his disregard for the queens chain law which allows nz citizens access to any beach in nz. Now with Māori predominance they can selll beach front to huge developers to make exclusive projects and fenced off access to the beach.       Queens chain? This is however a fallacy! Also, today there are properties adjoining waterways where the land was not reserved by the 1892 Act that enjoy “riparian rights”. That means that the adjoining landowners effectively own all of the land to the middle of the river and the general public does not have access over the land or riverbank.

      A group of lawyers, legal academics and organisations aligned to or affiliated with the legal profession has spoken out against the front page Hobson's Pledge Ad placed last week in the NZ Herald.
      Here's the text of the statement (with very minor edits to fit character limits):
      The Hobson’s Pledge ad in The Herald on 7 August in relation to customary marine titles is likely to mislead, deceive or confuse consumers both explicitly and by implication, ambiguity, exaggeration and false representation. It is also likely to also fuel racism against Māori.
      Hobson’s Pledge are entitled to a 'robust expression of opinion' but are not entitled to mislead and deceive consumers and, in our view, The Herald should have known, or investigated, whether the information was misleading or deceptive before the advertisement was published.
      First, the advertisement calls for the “restoration” of the foreshore to public ownership. The foreshore has never historically been in public ownership: it is not owned by anybody, except for the areas of the foreshore that are currently in (mainly non-Māori) private ownership.
      Second, the ad implies, on the front page, that “customary marine titles” give iwi, hapū and/or whānau the right to own parts of the foreshore. This is not true.
      On the contrary, the legislation’s effective extinguishment of Māori property interests in the foreshore has been found to breach their human rights by UN human rights bodies that oversee New Zealand’s human rights compliance.
      Third, the ad implies that “customary marine title” will prevent NZers from accessing beaches, including to fish, to swim and to enjoy our coastal environment. This is not true. The legislation enabling the award of customary marine titles secures public access to the foreshore.
      Fourth, contrary to the impression created by the advertisement, there are very hard legal tests to be met before a wāhi tapu (including a rāhui) will be recognised.
      Moreover, wāhi tapu are subject to statutory restrictions, and cannot, for example, prevent fishers from taking their lawful entitlement in a quota or fisheries management area.
      Finally, in the light of the division and racism against Māori that resulted from the foreshore and seabed issue in the mid-2000s, we find the attempt to reignite that division and discrimination abhorrent.
      Signatories include the Māori Law Society, the Auckland Women Law Association, legal academics and lawyers - from King's Counsel, partners and barristers to junior associates, in-house lawyers and non-practising lawyers. This little newsletter hereby adds its wholehearted endorsement.

Don Brash and the Herald also had legal teams review it prior to being published. Sadly the Herald has caved due to trying to be woke. In my opinion there is nothing in the advert that is misleading, and this point has also been argued on the platform. Although I accept people will read into things and may see them differently, I feel Mikes interpretation to be non offensive and highlights why people should be concerned. Especially if term title is used which is a legal phrase to mean ownership.

    Thank you for raising the issue which isn't about the advertisement by Hobsons Pledge, but the refusal of advertising space. It seems to me, the New Zealand media still hasn't read the memo that a different party is running the country and have therefore cut off all the freebies the previous frivolous government threw around with gay abandon.

    The media in this country is engaged in a huge coordinated social engineering exercise. At exactly the same moment, Aderns government began bestowing Maori names on every new public building, every government department and every governmental inquiry. The media and every other organisation that accepts money from the government carried the flag for that social engineering project. Why else would RNZ, The Herald, Stuff, TVNZ and TV3 insert Maori words into sentences framed in English.

    Don't even have to be non Maori to be censored. Even Maori with differing viewpoints from Te Pati Maori are now being called 'dirty bloods'. It's disgusting.     Within the UK, at the present time, there is "loud calls by many, that there is a 2 Tier Police System, across the Country". Not new, but has been building for some time. It is now very obvious that here in New Zealand we now have a 2 tier political system, on Maori, for which they have been working for some time, a 2 tier MSM who have "bent a knee", to matters Maori, and that the rest of New Zëaland is now "silenced", just as Michael has alluded to, for the Pakeha to now speak out has the potential for the NZ Police to now " implement (their) Hate speech Legal actions" (currently being implemented, thru internal training). When that happens, we also have a 2 tier Policing System.
    It will be interesting to see what our South African immigrants will now do. I know of one Family seriously thinking of returning to South Africa.

    The media pool in NZ is quite tiny and owned by people who are not going to let anyone swim in that pool who are going to splash around too much. Those that do continue to bathe there know they only get to continue by only marginally disturbing the waters. A quite tempered style of swimming.

    Draw a distinction between right and title. Customary right is OK - because it does not entail exclusivity. A tribe has a right to use a stretch of coast while also allowing that others have a right [maybe the tribe has a right to catch more fish etc]. Customary title is not OK, if this entails a propriety title that effectively can exclude others from a stretch of coast.
