    Thank you for highlighting this Sean. It is a huge concern and needs to be heavily pushed back on. The Justice system is a mess already and this will do nothing to improve it. Either Justice is delivered on an equal basis or people who feel betrayed by the Justice system will deliver their version of it on their own. Not a good place to be for any society.

    New Zealand is in real trouble, almost all aspects of our generally normal, happy & cohesive society has declined to levels I never thought I’d witness in NZ. The country is broke, violent and desperate to appease one race over another at any expense. The tax payer has now become the enemy of the state and yet are forced to continue funding those that hate us. No longer patriotic and would love to see a large movement of taxpayers refusing to work, and registering for the dole together to send a message to weak government, those who refuse to work, who expect race based handouts, and to those who refuse to feed their own children-there will be no more funding, enough is enough.

    Thank you, Sean, for having the guts to confront this issue of our failed judicial system. My brother in law was shot dead by his estranged partner and walked free. She then came after his estate, and we ended up having to pay her out $250k. We have also had 5 years of other legal battles as a result of her action, the lawyers' inadequacies, and misrepresentation.
    Our judicial system is designed to favor the persecutor! Where's the justice in that!

    As a retired police prosecutor I am discussed . The crown law generally only takes on inditeable offences ie serious criminal breaches. The criterion should always be the seriousness of the offence and the strength of evidence. Any matters of mitigation are for the sentencing judge in the high court and should be applied fairly to the offender no matter what their ethnic background.
    If a particular ethnicity is over represented in offending that should be addressed politically not through the justice system.

    A two-tiered justice system is the last thing New Zealand needs. This proposal is more than likely driven by the left's rhetoric about maori being overrepresented in the prison population in this country. If maori leaders are worried about it, then they should be speaking out to the younger ones and teaching there are better ways to behave and obey the law. You don't end up in prison unless you have committed a crime, and the expression "Do the crime, do the time" holds true.

    My car was stolen by a young Maori girl and her friend. In the "restorative justice" meeting, her lawyer said " Just admit it, it doesn't really matter" I'll never forget that day. I also remember her standing up halfway, thoroughly bored that she had to listen to her many crimes. NZ "justice"

    This is insane. I am Māori. I come from good parents who raised us to study hard, work hard, to be responsible, to be grateful, to be generous to others. We were raised to go to church and give service to others. My father was the first Māori in Aotearoa to be registered as a Dentist back in the 1960’s. We still had to work hard and do our share. Nothing came by way of a silver spoon. Mum and dad taught us right from wrong.
    Committing a crime is just that - committing a crime. You commit a crime by way of choice, not because of colonialism or how you were raised. Those factors may have an impact on your decision however, if you commit a crime, that’s your choice and we all have something inside of us all that tells us right from wrong.
    Commit a crime - you pay for it to society. No free pass. This woman is crazy. She’s not helping.
    Be responsible. Be honest in all your dealings with your fellow men.
    Get an education. Get a job.
    My son graduates this year with a Bachelor degree in architecture and my girl will graduate with a Degree in Medicine.
    I’m over the free passes for our people. I’m over the discounts for whatever they suffered.

    Thank you Sean. Your report has shown me the current Minister of Justice, with all her knowledge and degrees does not have your skill to deliver clear, concise and factual information. I agree with other listeners, she should be relieved of her position immediately so as not to further taint this government department and even better, live with victims of crimes committed by those she clearly wants to absolve from any responsibility due to their actions.

    No! The "Justice System" is there to enforce legislation coming down from Parliament - legalists are not to be activists and the interpret Parliament within a light that they, as unelected individuals, decide according to their own ideology or feelings. In Parliament, as is their job, these factors have been considered by the ELECTED and the legislation written accordingly. She Obviously does not understand her job or her role AND BECAUSE THIS IS SUCH A SENSITIVE POSITION SHE SHOULD BE REMOVED.

    If you rely on governments or others to have a decent life, then you are unlikely to have a good quality of life.
    Maori are not victims or weak. Why do so many in this counrty expect others to change so they can be successful ?
    If you don't find a way to overcome adversity of all kinds then who do you think should on your behalf.
    Please show me what rights one person has over another in this counrty. Did someone work really hard at school then denied marks because of race? Did someone go to Uni and reach and pass all standards to then be denied the qualifications because of race? Show me these things and will help you expose this " Racism ".
    I did neither of those things and now I am paying the price for MY CHOICES. It's called personal accountability.

    But my Scottish relatives lived through the 'Clearances' which were dreadful inhumane history but we get no special break. And have loads of white mates whose lives were dreadful (alcoholic parents, severe physical discipline at schools in the 1960's here) and get no breaks. By the way the Scots solved this issue by a strong belief in educating your way out of poverty (look at the uni's in Scotland, look at the Presbyterian schools in NZ, look at the medical and scientific inventions from Scots, and on it goes)

    Why does nothing surprise me anymore? Because this is New Zealand.
    My car was stolen a year or so ago, miraculously the police got it back for me , and the ar...hole got seven months. I was supposed to receive reparation for cost of repairs, salvage etc. Still waiting, and will probably never see a dollar of it either.

    Entrenching racist favoritism in the justice system is a disaster that must be turned around. Not only does it breach article 3 of the treaty but it risks increased maori dislocation from a civilised law abiding society. Surely none of us wants deep state aparthied to take root here. Are we to allow maori to descend back into lawless anarchistic savagery while trying to live side by side with the rest of us? We all know where that will lead. More resentment, more division and hightened racial tension.

    Appalling. I've seen pre-trial forbearance and mitigation at work in the US and it's bad. That kind of perversion and corruption is not a sliding scale - it is in itself an injustice. Ask the victims. Ask the others charged with similar offences, and convicted, but without the mitigation of race. Ask everyone else who winds up in the dock wondering whether justice really is blind and who was let go pre-trial. It also arrogates to pre-trial a core function of the judge - to weigh evidence and mitigation in forming and judgment. It arrogates to pre-trial lawyers a pre-emption of trial process. Lawyers are not judges. They cannot and must not render judgments and verdicts. This must be kept clear and clean.

    Thanks for uncovering the blatant racism in our justice system Sean. Judges should only consider the seriousness on the offence and strength of evidence. As Shane Jones said, most Maori criminals actually victimise other Māoris so any Leniency will result in more disproportionate outcomes for Maori.

    You would think all the years she has spent as a public servant she would know by now how to follow a government directive ? However a simple instruction from effectively her boss seems to elude her and it's carry on as per usual, basically instructing others to do the same. I think she should be fired or to save grace resign as she is also instructing legal representatives of our judicial system to bend the laws of this country to suit the offender. The coalition have already been having problems with a few other government departments not following instructions so it's time to make an example out of one of them and this one is a serious two finger salute to them. Sack her and set an example to the rest. We can't rely on mummy's boy Luxon but the Deputy's have got a good pair of balls.

    So basically the message is that if you're Māori your behaviour is out of your control and you shouldn't be held as culpable for your crimes. But - hang on - aren't Māori meant to have "superior DNA" - according to Rawiri Waititi?
    Māori are over represented in the justice system for one reason only - gangs! Only two days ago in Waikato Times was this headline (google it if you like): "Teen turns witness against mum in Mongrel Mob gang siege murder trial". Ten people likely to go to prison all at once for a murder - all Māori!
    Waititi thinks TPM should be running the country. If he gets rid of the gangs I might be convinced!

    I can only assume that New Zealanders and ministers have not seen the outrageous new Prosecution Guidelines released quietly at the beginning of this month. They cannot possibly have seen them because they contradict both Coalition Agreements and the promises the Government has made to end race-based policies.
    A defence lawyer has expressed surprise at the blatant race discrimination.
    The new guidelines quite literally provide a 'Get Out Of Jail Free' card to New Zealanders with at least one Māori ancestor.

    OK but the system is flawed.
    I know of a case locally where an individual would have faced the following; day in court, lose of license, impoundment of vehicle. But, daddy had the right contacts, it all was made to go away right there on the side of the road.
    I spoke with two lawyers and both acknowledged this happen(s).
    Another person of lets say different skin tone, faced similar charges but no lawyer was prepared to assist, there was no duty solicitor at court, the judge and police had already decided the outcome prior, during court recess the police prosecutor and police verbally layed into them. They were refused any right to make a statement. Complaints about proceedings only resulted in suggestions that involved money.
    The system is bent in more than one direction.
    If you want to comment on it Sean look at the bigger picture, which actually makes it all so much worse.
    The bloody system manages to have racism working in both directions.
    Thens the apathy of judges towards crimes involving pedophiles. Thats a crime in itself.

    I wish people would learn to know what Apartheid was and stop misusing the term. Apartheid was a system of separate development not a two tiered justice system. Like with all western nations everybody that committed crime was treated the same under the law. Like all systems it was not perfect but it was the only system that would allow for the most peace and economic prosperity in South Africa. Since Apartheid was abolished and the communists took charge South Africa now has over 100 race based laws, crime is rampant and the South African RAND has lost most of it value.
