Unless the violation is especially egregious it's more profitable for Twitch to simply turn a blind eye and have the streamer keep receiving donations/subscriptions/etc that they can take a portion of. On the other hand if somebody isn't generating that revenue stream and is only a viewer you can expect the ban hammer to fall swiftly.

Nino, out of his free will, accepted the money that led to him getting banned. Rob, knowingly or unknowingly, influenced Nino to do something against Twitch ToS. While not legally wrong - since Nino could've ignored the gifted subs - he still would have lost the moral high ground if he ever tried to dispute it.
