      She did a terrible job, which is why she was removed from the bench in her other capital case by the FL Supreme Court, publicly reprimanded by the state bar, and essentially forced to resign. Specifically because of the extreme appearance of bias she allowed to fester. Literally *hugging* the prosecution team and victims' families. It is so beyond inappropriate it sounds made up, like an actual joke. Can you imagine being a defendant who is accused of something by the government, but presumed innocent, walking into that courtroom and hoping to get a fair trial? From the judge that's publicly _hugging_ the prosecution? Good luck! Judges like her get people like Cruz *let out* of prison -- because their convictions get vacated on appeal. Whether or not she was actually biased doesn't matter, the mere appearance of bias violates judicial standards and _the Sixth Amendment_ . Good riddance to her, I wish her well in her legal career but she's not fit for the bench.

    • @emakelley6807
      @emakelley6807 8 หลายเดือนก่อน +9

      The defense wasn’t giving the judge a choice but to react. Was her reaction perfect? No, but I have seen judges react to defense counsel in a similar way when they are “pulling stunts” to try to get a mistrial in a difficult case. I’ve seen a judge in my city snap on the defense who were doing less blatant acts of disrespect to the courtroom (in 2 murder cases). Judges and lawyers are imperfect people like the rest of us. Especially in a case where many children died, I think it was not possible for her to be impartial when this is one of the worst acts the world has ever seen committed by an individual. She might have been doing her best so I definitely understand the inability to be neutral even when it’s your job. Jobs are hard. I think all around the prosecution was incredible and the most professional. He was the best. The prisoner should have been sentenced to death, its a shame that the jury has to be unanimous. The families did not get justice! I hope justice IS served somehow.

      @@jes6628a judge also needs to be professional and e.g. not give the appearance of bias (such as by hugging the prosecutors). A judge also has standards they are experienced to live up to, not just lawyers. I’m fairly sure anyone who has been to law school would have notices clear issues in how she behaved. (Just like the report concluded). Public defenders also play an important role in the justice system, and her treatment of them in this case was quite alarming. At minimum, she should have intervened to stop the victims impact statements from attacking the Public defenders for simply doing their job.

And there role is to protect and promote their clients interests above all else (I’ve simplified that a tad - they also have to follow certain court rules etc, which they did do in this case). There’s a reason the judge was reprimanded and not members of the defense team. Eg if any lawyer had in fact remotely threatened the judge’s kids like she accused them of, they would probably lose their licence. If Melisa McNeil’s conduct really was as unprofessional and disrespectful as Judge Scherer claimed (in front of her client), she would have faced consequences.

She defended herself to obnoxious defense attorneys who didn't care one bit about anything about the trial, or what happened at the school, with the middle finger scene, and the killer laughing about it with her was extremely rude, disrespectful to everyone involved. We know that Cruz didn't care less what happened in court, he was not wanting to die. He didn't care one bit when the families were giving their last remarks about the impact of what he did. He gave expressions when the Guttenburgs were talking...Did anyone see the expression from his face, "Oh, really?" I certainly did. Granted, the defendant did horrific things. But a judge shall remain neutral and behave in a manner that commands honor and respect. Plenty of judges have presided over high profile cases. She isn't the first. Yet, she's the one who got reprimanded by an appellate group of judges for her conduct. She still has an attitude about it, and clearly has trouble admitting she's wrong. I think it's probably good for her own mental well-being that she stepped down because she was just a bit too easily set off. Judges are gonna have all kinds of emotional and horrible things in the courtroom, including disrespectful people, and they can't let it get under their skin like that or it will mean it's that much easier for others to set them off, so it's probably for the best that she stepped down. Also just for the integrity of the bench and the cases. If this had actually been a real trial with a verdict, her conduct could've led to an appellate issue for sure -- thankfully it ended up not mattering in this case.

    She was a terrible judge who deserved every reprimand the state supreme court gave to her. She showed blatant favoritism to the plaintiffs and disgracefully permitted the victim impact statements to include vile words against the attorneys. The attorneys were doing their job. They were appointed by the court to represent the shooter and had no choice in the matter. I will not excuse the one attorney's poor behavior in giving the middle finger to the cameraman (and she is being investigated for that), but the attorneys otherwise did a fine job. They had a duty to defend the shooter, that is how this system works. The state is better having this judge off the bench.

The public Defenders were terrible and beyond disrespectful and completely non professional. That women should never practice law ever again or the other attorney who was completely rude and refused to maintain decorum. She is and always will be a great attorney.

    The Judge was totally unprofessional and leaving the bench was the best thing. I see a lot of people defending her, but that is because this is about a very unsympathetic defendant. She was very wrong is so many things. She allowed the families to insult the defendant’s attorney’s, falsely claiming one of them was threatening her children, hugging the victims (which showed a lot of bias) and just disparaging the attorney for silly things like resting early.
    The truth is that this Judge looks like someone who has lived a very privileged life and does not know how to handle stress. I hope she finds happiness in private practice. But she is not qualified to be a Judge. She doesn’t have the emotional stability to handle the job.

  • @moonchildcollective

    Personally, the way she handled every situation thrown at her…. it only made me look at the defense team even more at how asinine & unprofessional they were - especially in regards to such a profoundly heinous crime where the defendant lacks remorse. And the defense team was all cozy with a mass shooter! It was the judges JOB to address these concerns head on. People love to play monday morning quarterback & look at situations hindsight 20/20, but who on this planet could have the patience of a saint when she was being bullied from moment one. Considering the circumstances were what they were…. what i witnessed was a contempt for the law & the court system. She was 100% baited. Calling her “impartial” is an attack on her character… because that’s simply not what happened. I applaud her.

      So if an attorney is disrespectful in a trial or let's say he did threaten her daughter (but wasn't even close but we'll pretend) the Judge in the trial should be just as respectful or should Judges know how to respond to chaos etc ... I love how the defense was so wrong but a Judge can be the same way during a trial of the attorneys start it🙄🤔 So wrong & absurd bc Judges are suppose to handl any type of situation & not respond out of anger or emotion & stay above situations & be able to handle it. Darrell Brooks trial is a prime example, that trial was 10 x's worse than the school shooting &'there were times aaI couldn't watch bc of how he was crazy, disrespectful & rude but Judge D kept it so professional & not once stooped to his level👍. That's why they are Judges & no matter how much a Judge hates the la yers or defendants they aren't suppose to show it.....your "well the defense attorneys started it" & even if that's was true....... a Judg doesn't & shouldn't get a pass to be equally disrespectful back. Oh & keep rewatching the child care mm not wasn't even close but I'm sure it's the best excuse to think of to why she said get out for threatening her child. 👎😞

    The Florida Supreme Court unanimously reprimanded Elizabeth Scherer for a reason. Sadly, she is unable take responsibility. "What if someone were talking about your children" - her perception about that remark is concerning. The early motions involved her impartiality to the prosecution after working in their office for so many years. She would have wise to seriously consider them. She doesn't have the temperament to sit on the bench.

    She loves attention. I would never have cameras in my courtroom. She wasn't that experienced period and it shows. She made it worse by allowing cameras in the courtroom because she wanted the attention. She showed her demeanor to everyone and it wasn't the most professional. People who think she did a good job obviously have never seen a good judge who doesnt try to get the limelight like this former judge does. I was shocked to hear Elizabeth received a reprimand from the Florida Supreme Court. Maybe her conduct wasn't 100% professional in this trial, but considering the inept, disrespectful and at times horrible behavior of the defense team, I don't blame Elizabeth at all for the way she handled things. This is why, in my opinion, there should NOT be live TV coverage of courtroom trials, especially murder trials. Because lawyers will become more interested in playing up to the TV cameras rather than arguing their case. Shows like Judge Judy have their place, but a trial like this isn't your typical "my ex-boyfriend trashed my apartment and I'm suing for damages" case. This was MURDER of 17 KIDS, and a community that will never be able to totally heal from what happened.
    Elizabeth was an excellent judge and if I lived in Florida and needed a good attorney, I would hire Elizabeth in a heartbeat.
