I am s 11:25 o relieved to have stumbled upon your videos and websites. I am widowed 75 with health problems and credit card debt that is causing increasing stress, worry and guilt over my situation. My only income is social security and a pension from my late husband. My home has been in an Irrevocable Trust for 3 years. I'm going to spend more time reviewing the information available on your websites. I wanted to thank you for providing these videos. I'm socially isolated and feel like I don't have anyone that is able to provide any support as I work through how to deal with this situation. I am so grateful for the resources you provide.
You're very welcome. We hope you're a subscriber!
How is it legal for an attorney who is hired by a senior to go to court against a debt lawsuit, NOT TO TELL THE CLIENT his or her RIGHTS, or that he or she doesn't have to pay that debt? This is FAILURE TO REPRESENT YOUR CLIENT and MALPRACTICE!!
Debt collectors are some of the lowest lifeforms next to politicians, lawyers, and used car salesmen on this planet. Stay strong everyone.
Well at least they serve an underlying purpose. The debt collector I mean
@@wlonsdale1 Well said. 😄
You have really help my mom for me. My dad a veteran over 25 years. He has passed away. She gets his retirement and her SS. Told her everything you have said about some debt😊
Thank you -this information is a huge relief since I have a debt collector harassing me.
Good luck. Let us know how we can help.
actually, i called several attorneys recently due to debt issues as a senior, every one of them told me i was 'untouchable' and safe from prosecution. i was told to NOT pay the debt, and to NOT speak to any collectors, and to NOT respond to any mailed papers. i am still interested in filing bankruptcy, to clear my 'record' and give me some peace of mind.
Crooked local justice court judge ignored the binding arbitration clause from a credit card company because they claimed, in a court filing, that it would be too expensive for them and he then signed a judgement against me This was 2014. I flat told the judge and the credit card company that I had no money. The judge refused a face-to-face hearing on the merits of the case so I filed for bankruptcy. Funny thing was the amount I owed was about the same as what the banksters stole from me in the '07-8 economic meltdown. I have a 'Poor' credit rating at age 75. I have cash on hand for 3-6 months and a minimal amount in a bank and credit union. I have enough money for 3 squares and a warm/dry cot so I am wealthy.... I have a pickup with a camper with solar and can tow my 4x4 and park it for free in many areas. Life is good.
This is a great video for seniors
Thank you, For Your Counsel !!
You are so welcome. Thanks for watching our videos!
Thanks
Jeff, I think you can explain everything better than Eric,
Also, many states have time limits that creditors can collect debts. Look up yours.
Come on now. Today most seniors know how to look up words on the Internet that they don't know. They even have dictionaries!
I’m 60. Am I considered a senior? We live off my husband’s Social Security disability check alone. He is 66. My name was on several credit cards that we have shredded months ago, but I don’t know if I fall under senior protection. Thank you for your help.
I have the same question....on disability younger than 65. Is that protected Income?
Social Security income is protected regardless of a persons age. Eric HELPS
what if a sr has to work?
Discover's debt collector ne er informed me of my court date. Discover threatened to get a judgement against my home and car. I am not 65, I am 55.
call the HELPS Nonprofit Law Firm at 1-855-435-7787. Perhaps they could help.
What is a damage sum a senior can sue for if a debt collector is in violation of a federal act - like a copy of the phone discussion if threaten with suit and no e is ever filed . Tom
$1000 per violation plus attorney fees Eric HELPS
What about taking their home or car ? I have a mortgage but my car is paid for
HELPS has videos with Senior Living that discuss this. Bottom line is that different state laws called exemption laws protect certain amount of equity in a persons property like a home or car. However it is not the practice for consumer judgment creditors to attempt to take a persons home or car even in instances where there is equity over the state protected amount. HELPS videos with Senior Living discusses this.
What about a parent plus loan
Is it federal?
Parent plus loans are federal and have different more strict rules that apply Eric HELPS
Can they put a lien on your house if you are in Texas? Thanks.
Did you hear what he mentioned at 13:15 listen again, he specifically mentioned TX.
@@murphyrod4839 Thanks!
Um I'm being sued by a loco credit union, who was constantly messing up my power bills and other things and when I stopped going to that credit union and started going to a bank instead, the credit union started harassing me and calling me making all kinds of threats against me, and on Sunday I get a deputy at my door with a summons to court ,um am I protected against them,
Try calling the HELPS Nonprofit Law Firm at 1-855-435-7787.
@@SeniorLivingOrg thx I think I will get with them and see if they can help me.
If a senior on social security has a part time job to supplement his SS, can that money be garnished etc?
Yes.
I think that would depend on what state you reside in.
Are unemployment benefits protected from debt collectors?
Call the HELPS Nonprofit Law Firm at 1-855-435-7787
Can't you block numbers and text on your cell phone?
Yes, you should be able to.
Collectors call from hundreds of fake numbers that can’t be blocked. You can’t block a fake number.
You can always change your number. That’ll work
you never address the person that might have to work etc
There are federal and state laws that protect certain sums of money from a job from garnishment. Eric HELPS
What about their domicile, home or car?
Ditto. I hope they answer these come comments.
They can only put a lien on those
"HELPS Non-Profit Law Firm" DOES charge for their services. I tried helping a friend by sharing this info and they told her that it would be $40 a month for two years, then $20 a month for four years. I called to verify that she understood correctly and they confirmed it. They are going to help seniors by billing them for SIX YEARS??? This was sooooo disappointing - I feel they (HELPS) are just as bad as the creditors. Seniors need to show up to court and handle their business, just like everyone else - bad move to allow others to make decisions against you because you were intimidated and didn't show up for YOUR court date. Please do your research seniors.
Thats a very low price for hiring an attorney. Some seniors need services like this to lessen their stress that is hurting their health.
You may want to get your facts correct before making accusations and conclusions. At least one out of five HELPS clients receive our services at no charge. For those that pay it is based on household income. The most a person would pay to enroll in HELPS would be $40 for 24 months and then $20 for 24 months, then free thereafter. Not sure where you come up with six years. Many HELPs clients pay $10 or $20 per month over four years then free thereafter. We never turn any qualified person away. You might want to look at out reviews also. Seniors who receive protected income and who owe debt don't need to show up in court. They are judgment proof. Their income is protected. Seniors need to do their research and there is a HELPS website where you could spend hours and TH-cam channel with scores if not hundreds of videos on different topics.
