  • David Swift is accused of murdering his wife, Karen Swift, in October 2011, after she was found dead in an old Tennessee cemetery. David was allegedly the last person to see her alive after she returned home from a Halloween party. When David was arrested, he had remarried and was living with another woman in Alabama. David has been charged with premeditated first-degree murder and could face life behind bars.

      Prosecutor wasn't much better. She was a great mom but out at a Halloween party but Dad is home with the young children. I'll make my final conclusion after closing statements

    Oh my. That was the worst opening statements Ive ever had the displeasure of suffering through. The states was disjointed enough, but pure gold next to the defense's....he might as well have said "just flip a coin...I don't know."

      He was not indicted and arrested for over 10 years. Some say it was because they were collecting evidence...those of us from the town this happened in know there is a lot of behind the scenes shenanigans going on...various "important" people including local businessmen, politicians, law enforcement are involved in the case. Lots of shadiness.

    Just heard about this case. I'd love to know why it took this many years to prese charges on him? Also he was found not guilty on all charges but jury couldn't decide on manslaughter. So they are trying for a new trial. But clearly I'm finding out the prosecution must have added those lesser charges later on in this trial because I only heard first degree murder in this video.

    $20 says one of the jurors eventually comes here. I know i would. Just wanted to say i think you guys nailed it. I personally think he most likely did it. But not beyond a reasonable doubt. There was no evidence to make it beyond a reasonable doubt. Theres no way my mind would ever rest easy if i had to convict him on a hunch rather than beyond a reasonable doubt.

    The prosecution’s opening was a disaster. They straight up admit that they have 0 evidence that the defendant committed the crime and present a narrative that requires much more evidence than they say they have. The defense’s opening was far and away better.

      @@IWillNvr4Get Coming from later in the trial, it is even worse. The prosecution’s narrative has no forensics to back it up at all. They say he killed her in the garage and then transported her body in her car, but they brought up no detectives or forensic laboratory technicians to say that he did either of those. The fact is, the police found no evidence of her killing in the garage or being transported in the trunk of her car because there was no evidence of that found in the first place. Given that the prosecution’s story is that he stomped her head in the garage, threw her body in the trunk, drove out to the dump site, placed her car and popped a tire, walked back home, and within 15 minutes the car was seen, that leaves basically no time to even clean the car properly and as we have seen in much older cases, even a deep clean with plenty of time will leave some sort of trace evidence behind. The fact is, the prosecution has no evidence that the defendant committed the crime, in fact, the complete lack of evidence seems to completely discredit the prosecution’s narrative.

      @@IWillNvr4GetIt’s pretty much impossible to get useful DNA evidence in a case like this where the defendant and the victim are married and live together. Because both of their DNA is going to be in the house, in the garage, in the car, on each other’s clothes… they’re constantly in close proximity so the fact that his DNA is on her or her DNA is on him is meaningless.

    Soooo basically the prosecution has zero evidence...just a story? SO he is a liar and not a very nice guy. If they convict this guy on literally no physical or circumstantial evidence, I would suggest those in TN think about moving.

      Opening statements are not evidence. The trial begins with the first sworn in witness.

      I was divorced back in 2012 it did cost me more than 2k to get divorced it's because of custody that cost so much on attorney fees

      My divorce cost me $7500 thanks to my ex’s shenanigans during the process. My ex was ordered to pay it all. 😂

      That’s a totally normal INITIAL retainer deposit where I practice. It’s not the total cost, almost no divorce attorneys work flat rate. The attorney would ask for David to pay interim attorneys fees as the higher income spouse

    I sure hope the state has more proof against the Defendant especially, after not finding any evidence, where they claim a brutal murder took place !! Keeping tabs on a wife, who's committed adultery, isn't out of the ordinary & it certainly isn't sufficient to prove he's guilty!! Another politician who's willing to do anything to win!!

    The defense sounds like he's making up a story as he goes along. He is really weak with his opening statement. As a juror, that opening would be a red flag for me.🫣
