  • A case summary captures the essential legal principles enunciated by the court in the exercise of adjudication. Lawyers read and summarise cases in their everyday duties. in the preparation of clients' cases for advocacy, they search for the principles that they may use to bolster their own arguments as well as develop counter arguments in defense of their clients' positions. Attorneys (solicitors) and advocates (barristers) also read judgments of the cases which they have defended in order to vindicate the rights of their clients, identify argumentative flows of the courts so as to note and pursue appeals against the judgments. Law students also read and summarise cases in their search for understanding of the proper application of rules of law. Reading and summarising a case is thus one of the most daunting tasks that any law student has to endure in their studies. The student must find the case, read the case, find the most important elements of the case and then write a comprehensive summary of the elements. In our video we make a case summary based on the S v Zuma & Another Case of 1995. This video takes you through a step by step guide of the main elements namely, the summary of facts, the legal question facing the court, the reasons for the judgement as well as the findings of the court. It applies the FIRAC structure of legal reasoning whereby facts, issues, rules, the application of rules are viewed against the validity of the conclusions reached in the case.
