As a result these guys get ideas that they're somehow being let off because the arrest was bad or something like that, just like how sovcits get the notion that their nonsense works when a cop doesn't show up for traffic court and the charge gets dismissed. When the system fails, criminals begin to think they can win. On the flip side, Cody has enough of a record that they might actually start taking notice of him.

      Or did he read a Supreme court ruling. “1. A municipal ordinance that makes it unlawful to interrupt a police officer in the performance of his duty is substantially overbroad and therefore invalid on its face under the First Amendment.”
      “...the ordinance in question is not limited to such expressions but broadly applies to speech that "in any manner . . . interrupt[s] any policeman" and thereby impermissibly infringes the constitutionally protected freedom of individuals verbally [482 U.S. 451, 452] “
      “3. Although the preservation of liberty depends in part upon the maintenance of social order, the First Amendment requires that officers and municipalities respond with restraint in the face of verbal challenges to police action, since a certain amount of expressive disorder is inevitable in a society committed to individual freedom and must be protected if that freedom would survive.” Pp. 471-472.

    Just to add to your excellent research, Texas defines "criminal negligence" under Section 6.03 as: "A person acts with criminal negligence, or is criminally negligent, with respect to circumstances surrounding his conduct or the result of his conduct when he ought to be aware of a substantial and unjustifiable risk that the circumstances exist or the result will occur." Since anyone with any sense would know that yelling at a cop during a traffic stop was interfering, I think Cody Lintroller needs to go back to TH-cam college of law. Entertaining as always D.K..

The MOMENT a crime is over then he can’t be arrested for the crime. “Officer, I am NOT robbing the bank.” “But you were.” “But the robbery is over NOW, officer!” “But it wasn’t when you were robbing the bank!” “I have it on camera, the bank robbery was over!” “I have YOU on camera robbing the bank.” “But the bank robbery is over now, officer!” Sure, this works.

  • @derekallen3979
    @derekallen3979 ปีที่แล้ว +1

    Why aren't the cops being schooled in this ? Don't debate with them , that's what they want to stretch out the video for money from YT. Ask the basic questions ( driving license or whatever three times ) and then arrest them if not produced. In this case, as I see it, if the officer had told him to back off because he was interfering with the traffic=stop, then he could have arrested him immediately after the stopped car drove away, instead of the five minute plus to-and -fro. Poor management by the old cop.
    I really am surprised that officers who have so many years of service allow themselves to be sucked in.
