    I am one of the unfortunates who were targeted by the CMS for fictitious arrears from 25 years ago. I lost three years fighting them, all my evidence including bank statements and HMRC documents ignored, no response to any of my letters, bank account frozen for two years, refusal to act on my complaints. With the help of my MP I was finally listened to and my case closed, only to find that my ex had asked them to close the case two years earlier but they didn't tell me and carried on anyway. The damage to my mental health is likely to be lasting, and they claim it's all for the good of the 'child', who happens to be nearly 40. UK law says innocent until proven guilty, the CMS say guilty, and don't bother trying to prove innocence as we won't bother looking at your letters. They can take money from your bank or wages without having to go through the legal system at all, and now want to increase their powers to take your property and liberty as well.

      Totally feel your pain man !! I have the same thing !! It is sick and the whole world just ignores it even when fathers kill them selves because they have lost all hope !!! Why will no one do anything about it !!

      @@thecobbstar , things are beginning to happen, check out the group called split the difference, who represent the paying parent just as gingerbread support the receiving parent. They have Ann Widdecombe as a patron and she has just written an article in the Daily Express showing the other side of the story.

    The figures are absolutey fictitious. The CMS do not highlight THEY CANNOT ADJUST ARREARS FIGURES from paying parents who have wrongful been placed on a DEO and then changed back to direct pay. Those figures that then sit on file are false and remain.
    I also find it fascinating how this man states that service users who pay should provide evidence for all arrears. This is totally impossible when the CMS cannot provide the evidence of what they are chasing. Then, try and fob you off with an account breakdown that still doesn’t provide evidence of alleged missed payments. What a broken system.

      Indeed they do mate. No change from what the CSA was doing , I have heard the CMS is worse than the CSA - the CMS has the same nasty old vindictive staff from the CSA, same pig but with lipstick.

    I have been told I owe over 12k in arrears.. Now if these LO are processed in bulk, They are obviously not real. I have asked the court for the Memorandum of entry regarding the LO. I will fight this and get these arrears wiped.

      @@warlock1969 I have looked at that and I am disgusted by it. I have sent a SAR to DWP - CMS requesting information regarding these arrears. I have also sent a request to the court for the Liability order as they ceased in 2003 and the MOE from the court regarding the Liability order. I will just have to wait to hear back.

      @@ClairMarie74 , the information from the SAR will not include any evidence of how the arrears came about or how they were calculated. They admitted in a letter to my MP that they couldn't prove that I owed them anything as they had destroyed the records, that they had received my evidence that I had paid in full but they had told me that as far as they were concerned I owed nearly 12k and they were going to take it from my bank account.

    There must be an immediate change to the CMS system or it should be decomissioned to the level that the CMS only get involved if it goes through the court process where the Paying parent can apply for access to the child/children. The % should be reduced or calculated on NET salary (not gross).
    This will remove the incentive to go through the CMS, allow paying parents to see their children (remove alienation) and pay a fair amount.
    ONE SUICIDE is enough for action/ change.

    Minimum wage gives you the lowest common denominator. You know exactly how much money people don't have. There is no excuse for getting things wrong. It's quite deliberate it is not mistakes.

    Cms is an absolute joke. I used to pay child maintenance before cms got involved so I do not have a problem supporting my child and feel for mums who receive nothing from the fathers. But the system is mentally damaging to those on both sides stressful and is not for the kids best interest. I was ignored for 2 years constantly asking questions and not receiving any info back. It destroys fathers who want to pay and doesn’t back up mothers who receive nothing from fathers who don’t care

      That’s the standard argument - paying parents want to avoid maintenance. That’s not the case. The reality is the stress and nonsense that comes from being a service user is the root cause of it all.

    If you are asking whether it is lawful under the Magna Carta for the government to seize all of someone's money without compensation, then the answer is no. The Takings Clause of the Fifth Amendment, which derived from the Magna Carta, is a right against the uncompensated takings of property. In simple terms, if the government takes one of your property interests away-like the right to exclude others from your land-it must immediately pay a fair price for the value of that property interest.
    If one person wants a baby but the other dosen't.
    The UK and USA are the only places on earth that unlawfully force a person with a Y chromosome into farther hood.
