      I don't watch every tv court show but I think she's the only one who consistently gives detailed explanations of the law, in many episodes, that is relevant to the case and that's why she rules the way she does in a case which I think is one of the many reasons viewers like her show. It's like law 101 in many episodes combined w/she's personable and attractive.

      I’m not some sort of protective Doug-fan, but fair is fair.

      he seems kind afraid of most black people. it makes me laugh when you can tell he's a little intimidated and not going to mouth off about wether or not they learned anything at all from this for a change. I have an idea for a show where we reunite doug with the litigants he mouthed off to. that would be good fun.

    He is right, you can not tell if a brand new baby puppy will bond, with her dog. When at home and time for the puppy growing, they most likey, will bond, if not, the older dog will ignore the other. Most dogs generally, are all about you.

      True, for my first rescue was a year-old puppy and there was a family that was looking at her before me. They had an older dog and with a young puppy, it did not work out. I got the puppy, and we were together for 12 of her 13 years of life, she was well taken care off. Died from a serious infection from a tick or flea bite. She was very much loved and cared for. And then 5 days later, at the same shelter, I got another rescue, who was 4 1/2 years, owner surrender from Lousanna and brought to KCMO. We have been together for 3 years,

    She needs to stop saying "adopt the puppy". She's BUYING it. That man isn't a shelter. He's a breeder. Huge difference and you don't adopt from breeders. He's selling it.

      You're exactly right, She had already, on a previous litter, decided not to purchase. I allowed her all the time she needed to visit and she knew I had numerous other buyers that could attest to me allowing other pets to come visit the litter. I have other buyers who have had the same concerns and they tell me their dogs are now inseperable. I am the breeder.

    I don't understand why people feel so entitled to getting any deposit back. You're not special, a deposit is a deposit. If you back out, that's your choice. Deposits by default are not refundable. Even if he did agree to a partial refund at one point he's entitled to change his mind because he doesn't have to actually refund it.

      depends what kind of dog. the way rescues & shelters are anymore you either don't know what you're getting or it's a pit-guaranteed. used to be better years ago, one of many reasons why people are going to breeders

      @@Anglynn74 I have zero pitbulls. Honestly, I'm kinda scared of them. I know some lovely ones, but would never adopt a pittbul, or pittbul mix. Among the 6 I have total mutts, and dogs rescued from puppy mills and so technically a breed. Except no papers offcourse. If you search, you can find any dog you like. Big or small... And any breed, if that's your thing

    Not even 3 minutes in and she's driving me nuts by calling it an "adoption" as opposed to bUyiNg a dog... 😒 that's not the same as adopting.
    Edit: The guy even says she's buying a dog from him - who is a BREEDER. You're not even close to the definition of adopting ! It's like she just wants to make herself look good. Adopt, don't shop.

      The state of Florida Statutes say in order for a deposit to be refundable it has to be stated in the contract. So the judge correctly determined I could have said virtually anything in a text, and not be held to account because the contract is the governing document. And lets be clear, I did offer her a $750 refund which she rejected. By the way I am the breeder

      That's because she never rulse based on law. She rules on her emotions, which causes opposing rulings from her ALL The Time! She doesn't deserve the title Judge, because she ignores the law in at least half of her cases. It's sad that people don't know they can appeal her rulings when she is blatantly disregarding the law. She got it right on this one though, surprisingly.

    To anyone that this may help... your current dog(s) is not going to acclimate and get to know a new puppy that quick, let alone in an unknown environment. I'm hoping that was just an excuse on her part and not a legit reason. It can take up to 6 months for some dogs to accept a new dog, and that is in THEIR safe environment.

    The only time you can get a refund of the deposit is if you can prove that there is a defective puppy. Otherwise, refunds are non-refundable. Plaintiff assumed too much.

    I think rescues / shelters should take a minute to realize they often necessitate a need for breeders, and unfortunately, puppy mills. Has anyone ever looked at the self indignant rules for some of these do gooders? You have to have: specific breed experience, a home inspection, agree to feed a certain diet, no children under X age, a fenced yard, a veterinary reference, etc. That last one kills me - where do you think you drive first time owners too??? - - - you may as well make them an appointment with the local puppy mill!

      It does seem a little crazy in some cases. I have friends who treat their dogs like royalty who were trying to rescue a dog they found out of state. Among many other things, they were going to have to agree to feed her all homemade food with very specific ingredients-not because of any health issues, just because. The lady could do surprise visits and take the dog back at any point if they were breaking any rules. They also would have to switch vets to someone this lady approved of. Needless to say, my friends found another dog to rescue.

      Exactly. I understand the shelters want to set the animals up for success, but I’ve heard people getting rejected for ridiculous reasons. I knew a woman that got rejected from trying to adopt a second small dog to keep her first one company. The reason? She didn’t have a yard. No matter that she walked her current dog twice a day. No matter, there are millions of happy dogs in cities where most people don’t have a yard.

      We weren’t approved (or told of denial) by three different shelters. The amount of info they want and they still deny you.
      We hadn’t had a dog for over 5 years so no vet, but we did get a reference letter from our previous vet (who doesn’t even work at the old place we went). It felt like being punished for having my heart hurting for that long after our baby was gone and not feeling up for it again until recently.
      One dog they wanted to do an interview with the previous vet! Who has the time?
      Luckily we just happened upon a situation to where we got a rescue. He was found on the side of the road with two litter mates, a couple took him from the first person but couldn’t keep the pup due to their apartment not allowing pets. We had inquired about the littermates and they offered us him instead.
      They gave him to us for free even though we offered to pay them. He’s just 15 weeks and is such a good boy. He was so scared. Poor guy, but he’s so happy now. It’s very fulfilling.
      I guess my point is just that it is so stupid how shelters work, especially ones who don’t kill (which is good don’t get me wrong), but have such limited space yet they drag their asses and get overly picky in who gets a dog.
      I understand some people have ill intent but good grief there had to be a better way.
      I wanted one girl, filed an application, went to see her, wanted her and was willing to pay more but they hadn’t approved me yet and someone else who had been considering her for weeks was going to come see her 5 days after so they refused to consider me at all. They’d rather a dog spend more time in their hell hole smelling bad and being dirty than give them a chance at a home sooner, and fill that space with a new dog.
      But it worked out at least. Dobby is precious. But I can’t imagine doing that crap again if I ever want another dog.

      The insane requirements is only scratching the service of what is wrong with the shelter/rescue industry. I have worked closely in the industry as a veterinarian. I have colleagues that have been maimed to nearly killed by dogs that shelters refuse to euthanize for behavioral problems.
      Most shelters don't employ people that actually know anything about dog behavior, when they say the dogs have "passed behavioral assessment" they mean the random teenager/college student they hired (or volunteer even) did a half ass evaluation and decided the dog could be adopted. I have watched insanely dangerous dogs pass through to adoption with statements as "dog selective" when the reality is "will unalive any and all other animals." I have seen dogs with severe resource gurading to the point they are attacking anyone that even walks by go to the adoption floor with "protective of food". The reality is the dog will attack anyone that gets near any resource- food, water, toys, a human they like.
      I have worked with new owners who have adopted dogs that have such severe aggression they are being bit constantly, but society blames people and judges them for "giving up" when the reality is the dogs can't be fixed. You can't cure aggression. The owner spend thousands of dollars on seeing actual veterinary behaviorists, medictions, training only to many times come to me for behavioral euthanasia because it is the only option. It should have happened in the shelter, but yanno "no kill" is more important than the safety of the public now.
      I hope to see the day people start holding shelters accountable for the dogs they put into homes. One of these days I will convince someone to file a lawsuit and start to get shelters to end the insanity. "No kill" is dumb. "Adopt don't shop" is dumb, find a dog breed that fits your lifestyle and what you want in a dog, it will set you and the dog up for success. Not every home is suitable for the random pit/shepherd/chihuahua mix from the shelter.

    The judge is so inconsistent, I've seen other cases of People's court where the person is made to abide by their offer in a text, but either way I am sure glad he was not made to give her anything back...

    I understand this guy is a hobby breeder, but he’s got no business acumen. Either say no refunds, give refunds, or tell people they can use a deposit towards another litter. I learned those were the three most common options within two hours of researching how to find a breeder.

      Thank you for responding. I am the breeder and I too did a lot of research. Florida law CLEARLY says in a contract the deposit is NON refundable unless other wise stated. So under Florida Law there is no need to put the language in the contract. Here are some other points in my contract...How would you think if you know the breeder wouldn't sell a puppy to anyone unwilling to spend time with the litter before purchasing? Or the breeder REQUIRES all pups to be spayed or neutered? or the breeder can reclaim the puppy if the family is found later to be unfit? or the breeder doesn't allow the sale or transfer of the dog without approval and in no case can a dog be transferred to a shelter or scientific lab? What would you say if you knew the breeder regularly tells people seeking a "specialty" dog like a golden doodle, cock a poo or other hybrids, read that mutt., to seek the best traits of the dog you are looking for in a pure bred dog? By the way, I am the breeder.
      My contract also spells out very clearly when deposits ARE REFUNDABLE, so be deductive reasoning, if the reason you are seeking a refund is not mentioned in the refundable section they are by default non refundable.
      And we did add language to the contract saying the deposits are not refundable IF CANCELLED BY THE BUYER.

    In my lifetime I've had multiple rescues and a couple pure bred dogs, so I don't judge people for wanting a specific breed because of personality traits of those specific dogs like those of Yellow Labs or Golden Retrievers, but there really needs to be a law on the number of litters individuals have. My most healthy and longest living dogs were muts, and my "designer" dogs usually all had some type of health problems, even if it was chronic allergies. 🐾

      I don't care how cute the name, they're still mutts. I wouldn't pay for a mutt at any time in my life and won't start now. I require at least a 3-generation pedigree to even look at puppies. I keep my dogs as long as they live, which has ranged from teen to fifteen; the first was an unregistered Flat-coated Retriever that I took on sight (the only unregistered dog I've ever had and honestly the best) & the latter was a German Shepherd that we rescued from an abusive house and kept her the next 11.5 years of her life.

Mutts that are rescues are better bred and pampered for they are more behaved and caring than you think. We people who do to rescue are better people and do more for our pets. And it does not mean we have to be rich to have one of them. And I only pay for the spay and shots when I get a rescue BBF.

Also, what about all these people who get their pets from shelters and return them for stupid reasons? I was watching a TH-cam video just last week about a dog that got returned to the shelter three times - all for stupid reasons. Just because you rescued, doesn’t mean you’re actually helping an animal. In many cases, they are just traumatizing it even more.

      ​@@trekgirl65 As a veterinarian, you are wrong. People who own well bred, purebred, ethically bred dogs take exceptional care of their dogs. I see all walks of life adopt from shelters, including those that straight out neglect the dogs-- they come in matted to the skin so badly the dog has open sores, nails overgrown, teeth literally rotting from the head, masses that have ulcerated and are infected.
      Also rescues are far from "more behaved" the most aggressive, asshole dogs I see are "rescues" because shelters have stopped euthanizing dogs with severe aggression and instead dump them onto the unsuspecting public. I have colleagues with permanent severe scars from the dogs that shelters refused to euthanize. And if a dog does attack in the shelter, they change its name and ship it off to another shelter to lose the bite history. I have a colleague that nearly died in an attack because the shelter decided the dog was more important than staff safety.
      You might think rescues are there to "save the animals" but rescue has turned into a profitable exchange. "Adopt don't shop" created a want for rescue animals and now I watch shelters literally buy backyard bred dogs in other countries and import them in claiming they "saved" them from the meat industry. No floofy, small breed is being "rescued" from the meat industry, but the general public are fools. I watch shelters ship dogs around because some shelters are literally out of dogs.
      The rescue/shelter industry is currently valued at $2.6 billion dollars, most of these places are laughing their way to the bank, while you are stuck with Cujo who has to be the only pet, is terrified of plastic bags, has severe allergies, won't let anyone in your home so has limited your friendship circle, you can't leave without him destroying the crate, walls, floor and trying to jump through the glass windows.
      Meanwhile the ethical breeder has bred for dogs with friendly, sound tempearments (they literally get kicked out of show/sporting rings if the dogs don't have good temperaments). The ethical breeder has spent over $1000 on both mom and dad of puppies for radiographs, cardiac exams, eye exams, genetic testing, etc. The ehtical breeder can literally tell you your dog's lineage going back at least 3, if not even 5+ generations.       And you scratch your head and wonder why someone would rather spend $2500 on the ethically bred puppy vs $700 (price around me for a shelter dog) for an unknown health history, potetinally behavioral trainwreck?

    I purchased a puppy last year. The purchase price was $1600 and the required deposit was $200. I put down $400. The deposit was not refundable it said so on the contract.

      I bought a puppy as well. The deposit for Kylo Ren was $200, ($1200) however she did offer a refund for the deposit in her contract & this lady was so detailed & I was able to watch her & the puppies until he was allow to go home with me. She did sensory stuff & some other things that help them to adjust better for their new home. She fixed her momma dog after this litter. We keep in touch.

    Just another young and entitled person that is used to mommy and daddy giving them everything and yet never having to earn it. This isn’t how the world works lady….. You don’t get things for free. The world doesn’t revolve around you! He was super nice and reasonable to even offer to give you anything back. Stop thinking everyone owes you. That’s not how the real world works. If anyone is ever fair and kind to you don’t go and sue them! Be grateful that someone was kind!

    As a breeder, we take deposits because that’s 8 weeks we have to find a home. Placing older pups is a lot harder and it’s a lot harder on the pup because they begin to develop bonding and routines after littermates go home. These bonds and routines should be built with the new families and not the breeders family.
    Also, she says her dog didn’t warm up to the puppy. I have 5 dogs who have all lived around litters and helped with socializing over the years. It’s rare they like them at that age because they bite hard, try to nurse on them, and are annoyed by them, and some might warm up at 7 or 8 weeks to pups if it’s their first time meeting them. But all our adult pups came at 8 weeks and it took a week-1 month for them to get used to them and accept them as part of the pack. My oldest girl loves puppies but not another females pups until after 6 weeks (sometimes; depending on the mom of the pups). None of my dogs would like pups in a different home though cause it’s a strange environment.
    Before paying a deposit, you should always make sure you want a puppy and are willing to be patient with them. They are babies! Adult dogs won’t always accept them in right away. Consider existing dogs can get jealous of the new pup. Or that the new pup might try to nurse on them and they will get mad. You need to be willing to be responsible for your pup’s adjusting before you place money down! If not, you’re accepting the risk that you might lose the money if you didn’t do enough research to prepare or determine if you had time for a pup. Whether your adult dog likes the pup is the least of your issues if time is your complaint. Puppies are ALOT of work. 24 hour work. Like toddlers who destroy everything and don’t know how to communicate with you.

      I am the breeder, thank you for your comment, in the state of Florida you have to have a HEATH CERTIFICATE signed by a Licensed Veterinarian who has examined the puppy. this includes stool samples and a regular shots. Once the pups get to 7 weeks and 1 week before their go home date I get the entire litter re-examined, in addition to their previous visits to get the HEALTH CERTIFICATE. The certificate is only valid for 30 days, so if you have an 'unsold" puppy they still have to go for regular visits and shots and when that happens the certificate has to be updated.
      This pup was born on Nov 5 with an expected go home date of Dec 31, she cancelled December 23. She signed her contract on Dec 3 and placed her deposit on the same day. That makes it a confirmed sale. I can no longer sell that pick to anyone else.
      Yes it does seem stupid, but you have to keep the certificates current.

    people who are spending that kind of money want a cute little puppy.....they don't want one that's months old. Not to mention that you have to get the pups shots at 8 wks, 12 wks and 16 wks.....so if she hadn't taken the pup, HE would have to pay the $125 for the shots, more for worming, etc. It would cost him a lot, and he would get less money for the pup.

      Breeders do pay for the first boosters and they generally will let the pup go at 8 to 3 months. The Plaintiff did not read the NO REFUND POLICY very well. And the pup was not sick, just the Plaintiff's older dog and the pup did not get along. Big mistake for the plaintiff, for she should have had a meet and greet for both of them.

      The case is different. This is a puppy sale gone wrong from the Plaintiff who broke the contract and wanted her refund. Nothing was wrong with the puppy, just her full-grown dog did not like the puppy. You should always make sure they can get along and the plaintiff failed that. So partial refund is what the plaintiff deserves. Different kind of case, for this puppy was not sick and was not dead.

    I don’t think that the breeder and that’s exactly what he is even though he’s not doing it on a large face because I have a large face operation. She lied a lot being a person that has purchased dogs from breeders that first six months or six weeks. I’m sorry is responsible is responsible of the breeder that health certificate that he’s talking about, if she told him on the 23rd if she went on the 30th you’re supposed to take it to do that stuff when you go and meet the person who you’re sending the dog out whether they go out or playing you actually meet in person he chose to get multiple of those certificates anticipating the dogs going. I don’t think that should be her responsibility. One price if they want to get her for one of those sausages guess that’s another thing And as far as the three month shots and a four week shots she’s not responsible for that he is. He has a dog in his possession if you’re a responsible owner even if you’re just trying to get rid of the dog or sell the dog however, you want to put it he’s so responsible of maintaining the dogs house I reiterate this breeder is it very he lies a lot and he’s trying to get over a People.

    Why buy a puppy when thousands are available for adoption and thousands others will be euthanized because no owners could be found? The fact that the defendant made a point of insisting that his puppies are for sale not adoption tells me that he thinks of them more as commodities than someone's loving companions.

A lot of breeders run puppy mills where animals are poorly cared for and where a significant chunk of puppies never make it to market because they die first. And breeders often keep bitches perpetually pregnant, which isn't great for the dogs, then put them down when they're no longer productive. I'm not saying this defendant is running a puppy mill, but the very idea of raising dogs for profit makes me ill.

      He is in the breeding business, so yes there is money involved. Breeders often do request a deposit for a puppy sale. This case goes further, the Plaintiff did not make sure the dog of the home and the puppy could get along. For older dogs do not like the energy of a puppy. And they did not, and she forgot that the deposit was non-refundable. And the defendant did offer a partial refund.

      Not all people want to adopt a dog that they know nothing about, no clue where it grew up, how it grew up, what it’s been thru. Some people want a puppy that they can train from the beginning, have it grow up with them and be accustomed to their household and family and weather they have children or not. Of course it’s nice to say let’s adopt a dog and save it from being euthanized and let’s just hope it’s a friendly dog and going to be friendly around kids and hasn’t been thru any trauma that’s going to trigger it one day and hurt someone at no fault of the dog but bc of something in its past that that person has no clue about. And 9 times out of 10 the adoption places do not have puppies, it’s super hard to find a puppy at those types of places esp if someone wants a certain type of breed because of their known personality traits and what’s going to suit them and their family. So saying that is nice to say but it’s always practical….esp someone with kids and/or other animals.

    I think it's pretty sad that a man of his age apparently can''t afford or is too greedy to give a college student back her deposit. Yes, the law is on his side. So make the young woman lose every penny of what is probably a sizable chunk of money at her age. Make sure she learns her lesson. Go ahead a create awkwardness for the two sorority sisters, one of whom is his own daughter. Clearly, he can't afford to spend around $700 of his own money on his own business as close to retirement as he must be. If I were his daughter, he would be an embarrassment to me.

      By law, the breeder does not have to give back a NON-REFUNDABLE DEPOSIT unless the pup is proven to be a sick or genetically defective pup. He does not have to refund the deposit due to the contract she signed.

      So first, you are assuming a young, college-aged woman has limited funds, you don't know her financial situation. So making assumptions about her financial situation is silly.
      But, let's say she does have limited funds like you are suggesting. She CHOSE to put a deposit down on a puppy despite having limited funds. No one, absolutely no one, is responsible for her poor life choices, except for herself. If you don't have the money for a puppy, don't put a deposit down on one and then expect it back. He was kind to her, he offered her back over half of the deposit, she declined. She spat on his kindness then learned a hard lesson about deposits and how they actually legally work.

      She was right, following the law, the breeder does not have to refund the deposit if the pup was healthy at the time of purchase. If the pup was sickly and proofed to be defective at the time of purchase, then a refund can be done if proven sickly or genetically defective.
