That is the exact reason she did this entire thing. Disgusting. There is absolutely no reason she did not notify them she found or had their dog, other than to appear better than them or whatever her motives are. Ridiculous. All the plaintiff did was lose her dog... a complete accident became a situation for a psycho to take advantage of.
I live in FL and I have lost my dog an when we went to the animal shelter they don’t even fill out paperwork they just tell you go check and good luck. All this lady needs to do is wait till the dog runs away again and call it to come to her house she found her property.
I adopted a stray Chug called Chester, he was the love of my life and about 3 months after I got him we him drove through an area with horses (we lived in the city) and he was usually really chill, but he went nuts. He made shrieking noises and basically attacked the window. It occurred to me he may have come from a similar rural place. He was found a few miles from farm area but he had signs of being outside a long time (cracked pads on his feet and hypothermia). It troubled me so much, I couldn’t tell if he was reacting to past abuse or trying to get home so I started putting out feelers for his previous owners, vowing if he seemed happy with them I would let him go, even though I would be devastated. I never found anyone looking for him but for 17 years he always got so happy and excited to see horses.
I was just saying in my comment that in my neighborhood on our street if a dog gets loose we return it to the neighbor. We look out for each other. Not many neighborhoods or neighbors like that anymore. The defendant sounds like a bored housewife whose husband and kids don't give her enough purpose.

The plaintiff had a difficult time articulating her case. I believe she was trying to tell the judge that she went to the shelters within the first 3 days and he wasn’t there. The defendant held the dog for 5 days before taking him to the shelter. So, the dog would not have been there when the plaintiff went. Also, the defendant ABANDONED her kids to rescue a dog😒....ok...
But plaintiff didn't have any paperwork filed with animal control. Also, defendant never mentioned how old the kids are. If they are 10-12 years old, they usually can be 'abandoned' for a few minutes without harm.
She got that point across but like the judge said if she immediately went to the shelter and reported her dog missing then weather it was 3 days or 5 days later they would have a report that dog’s owner already came looking for it

Wrong, the plaintiff abandoned the dog, and only cared when she thought she could sue for $5,000. She had 0 paperwork from the shelters and didn't even have one of her supposed flyers. The proof is right in front of your face whether you choose to see it or not. Thankfully the judge saw the truth.

She would have been able to foster the dog if it had past the adoption checklist for the shelter. Shelters will foster animals out if they are adoptable and the shelter doesn't have room. The Plaintiff should have had something from animal control or the shelters that she actually stopped by. I wouldn't leave until I had something in writing stating that I stopped and left my information with the shelter just in case something like this happens. If there was paperwork with the shelter/animal control, and they allowed her dog to be adopted out, she needs to sue them.

Yes, she did save her dog. If she hadn't adopted the dog it would be dead. Personally, even though I had done all she did and was now the legal owner of the dog, I would have given it back....unless I knew the dog wasn't being looked after properly.

I'm for the plaintiff, she should get HER dog back. Dogs escape all the time, knowing good and well that the owner was looking for her dog, I have a gut feeling the defendant purposely kept the dog on the down low. The defendant seems like one of those types of people that think no one else can take better care of dogs. This is just sad.
There is also a special name for pet "owners" who let them run the neighborhood and don't even make the effort to go check the shelters when they are missing.

I'm pretty sure the defendant stole that dog. The judge made the ruling based on the law. It's just sad for the plaintiff that the law isn't in her favor and let a woman that knows that the dog belonged to the plaintiff keep it. It's really suspect that the defendant has all these amazing interactions with "abandoned" dogs. To even leave her children unattended to chase one down the street? I don't know what kind of owner the plaintiff is, but I really don't like the defendant.

My sentiments exactly!! I've heard of folks like the defendant who think THEY are the best parents for the dog and everyone else is doing a horrible job. They think they're God/savior to dogs. She's going to steal the wrong dog one day and find herself in a world of trouble. I can see if the dog wasn't claimed for months at a time or the owner wasn't putting in any effort to find their dog, but there wasn't enough time for the defendant to just adopt someone else's dog. People LOVE their dogs. She's just wrong and Florida needs to change their laws. On another note, this is why I don't allow strangers to watch my dog and if I'm moving, my dog remains in her crate or at my parent's house just to ensure she's not lost.

My dog ran off late at night. The next morning we called all the local animal shelters and they all said they didn’t have a German Shepard. We decided to go check and sure enough, he was there. If she only called the animal shelter, the same situation could’ve happened. This makes me super sad.

Since she knew who the owners were, there was no reason to refuse to give these people their dog back. Some animal rescuers DO steal other people's dogs and cats. The dog did NOT live next door to the defendant. The lawn cutter Giles reported the plaintiff's dog at HIS next door neighbor's house some distance away. The plaintiff could have avoided this mess by having the dog chipped, having a collar with owner identification on it and CHECKING THE SHELTERS DAILY. My city shelter does take reports from people who have lost their pets and the information is shared between the shelters so a person has little difficulty tracking down their pet taken to the shelter. I had a friend who’s cat got out of their house. They put up flyers and called/went to the animal shelter multiple times and was told they didn’t find the cat. 2 months later her daughter found it up for adoption at Petsmart and they had to adopt their own cat!
End of the day even if you deal with dogs on a professionally if the dog was lost and the owner is still around and the owner wants the dog back, give the damn dog back!

The defendant stole the dog, hid it for almost a week, then called animal control and pretended she just found it. Then instead of telling her neighbor where the dog was, she let it sit in a shelter so she could legally steal it.
Not how that works. She turned the dog over to the shelter, the shelter held the dog on a stray hold for 7 days (to allow owners to come in, claim their dog and pay to get them out). Once the stray hold is up anyone can adopt the animal, she could have just left her number and told them to let her know when the hold was up if he wasn't claimed.
It’s definitely possible that she saw the dog roaming and hid him until she could legally take steps to adopt him. If not why wouldn’t you just give the neighbors their dog back??

Because the neighbor was NOT caring for the dog in the first place...she found the dog wandering the streets, and he "was deemed unadoptable at the shelter and was going to be euthanized"! SHE saved the dog's life!
Definitely believe that the defendant hid the dog. The fact that she knew the dogs owners and didn’t try to return him speaks volumes. She’s probably still taking dogs now and leaving her kids.
The problem I find with JM, is she talks over everyone. She'll ask a question, not wait for the response, compose her own misguided response, then she has to have clarification. It wastes so much valuable time in her courtroom. I think that is partially what happened here, the plaintiff could not get her side of the story out. Having said that though, there's no need to explain that one time they knocked on the door, the next they rang the bell, that is a waste of time as well. Both judge and the complainants need to be more succinct!
The judge says 'so you knocked at the door' and if they had just gone along with that, then later if they had said they rang the doorbell, the judge would have then said 'Oh I thought you said you knocked at the door' there is no winning with this judge...

I get where all these commenters about how they should have given the dog back are coming from but honestly, the plantiffs didn't take care of their dog in the first place. If my dog, while walking out on a leash got loose "which ever way", then I'd keep looking, call the shelter, gve them a description, maybe put up flyers. Look on Facebook in my area, post about my missing pet with pictures and the area last seen.. not wait over a week and hope it comes back. This dog was not chipped and didn't have its shots. It was a pit bull, everyone and their mother knows the unfair reputation they have. You know *someone* is gonna get scared a "dangerous pitbull" is roaming free. The dog is lucky the defendant was kind enough to take the dog out of the shelter the day it was going to be uthanized. Plantiffs didnt do enough for their 4 legged family member; truth of the matter is, if it was left up to just them, the dog would be dead. They sadly, but rightfully lost it. Take care of your pets, people, same as your kids. We're all family here.

OMG 😮 I had a similar incident happen. Neighbor KEPT letting his dog, (puppy/5 mnths old), run the neighborhood AND beat dog upon its return to owner. Long story short, I got her, (Luna), vaccinated, heart worm checked, etc., etc. Neighbor tried to fight me on it. I've got her, TO THIS DAY, and she's approaching 5yrs old 💕 NEVER should ANYONE let their dawgy's run amok. PERIOD 😮😢😢
Believe me it has a better home now. How do you steal a dog that is running the neighborhood? It didn't even have tags on it or a chip in it. It took them 4-5 days to even check the shelters or kennels. People like that should be banned from owning pets.
How is it that 3 dogs just somehow showed up on her doorstep... Kind of weird. I think she is intentionally seeking dogs to take. Perhaps she wants the best interest for them, sure but she is enticing the dogs getting to come to her house somehow and she's going out searching for them. I think she's keeping food out for lost dogs and then claiming them when she "finds" them.

The defendant is crazy and the plaintiff is irresponsible. What tips the scales for me is that the plaintiff sued for the small claims maximum and not for the return of the dog. If the plaintiff truly cared about the dog, the lawsuit would have been for the return of the dog.

So she is actually allowed discretion concerning what "more likely than not" occured here --in which she chose not to exercise. She repeatedly cut the plaintiff off while speaking; which put the plaintiff on the defense, resulting in her inability to adequately articulate her case properly.

People like the def will take the collar off and throw it away. Thats what the woman did that kept our dog. The garbageman opened the gate at our house and our dog took off. He followed a bunch of kids to my elementary school. The woman lured him with food. She lived behind my school. We advertised everywhere. The thiefs neighbor heard about our dog and tried to get her to return him. They refused so the neighbor called us and turned her in. She had dug the collar out of the garbage can as proof.
Both parties seem sketch to me… had I lost my dog/cat best believe I’m tearing the whole city/county upside down. I’m calling everything and everyone making records, flyers you name it. So the fact the plaintiff had no evidence of filing any records is suspect to me. Now the neighbor… she seems to be an opportunist. She saw that the plaintiff was possibly a neglectful dog owner and used the law to her advantage.

We thankfully were able to find homes for the kittens and let Mama Cat be an outside kitty (after spending over $1000 for her & kittens' shots & spay, Mama Cat refused to be indoors). I one day found her with a sweet old lady neighbor. They were Puuurfect for each other. Elderly lady just lost her hubby (who was allergic to cats) and fell in love with Mama Cat/aka Rita as her name tag stated that I made for her... I let her keep the cat/no cost. The cat obviously felt better at her place being a one cat household as oppose to my 5 cat household. It was a beautiful love story.

This lady kept speaking upon how she was noticing the dog eating out of garbage, about how the lady didn’t keep the dog up & all of these other complaints… This lady was watching and waiting for her moment to take this dog away from the rightful owner. I believe she definitely withheld the dog from the owner & the shelter and she let it be known that she’s close with the people inside of the shelter and she “rescues“ dogs, she knew exactly what she was doing!

That’s dangerous and careless, and not safe for dogs or people. I just think that it can be hard for a person to know if a dog was carelessly let out to roam vs if the dog accidentally escaped. Sounds like the defendant assumed that the plaintiff’s dog was carelessly mismanaged. According to the testimony, the dog accidentally got out and couldn’t be found. Once the defendant knew who the dog belonged to, it would’ve been proper to at least speak with the owner to find out what happened first, before making moves to adopt it. This case was exhausting to listen to. I live in a neighborhood where almost all of us are dog lovers. Most of us have dogs and we pretty much know what dog belongs to who. When one get loose we all pitch in and look for the dog. None of us wants anything bad to happen to any of our precious dogs.

Well, this is kind of an interesting thing personally, my dogs are never without of my eyesight, but my dogs are chipped but when I tell people they tell me I need to get that thing out of there because it causes dogs to get cancer. I have yet to remove the tooth, but knowing that it makes it does make me nervous.

I adopted a stray Chug called Chester, he was the love of my life and about 3 months after I got him we him drove through an area with horses (we lived in the city) and he was usually really chill, but he went nuts. He made shrieking noises and basically attacked the window. It occurred to me he may have come from a similar rural place. He was found a few miles from farm area but he had signs of being outside a long time (cracked pads on his feet and hypothermia). It troubled me so much, I couldn’t tell if he was reacting to past abuse or trying to get home so I started putting out feelers for his previous owners, vowing if he seemed happy with them I would let him go, even though I would be devastated. I never found anyone looking for him but for 17 years he always got so happy and excited to see horses.

The plaintiff had a difficult time articulating her case. I believe she was trying to tell the judge that she went to the shelters within the first 3 days and he wasn’t there. The defendant held the dog for 5 days before taking him to the shelter. So, the dog would not have been there when the plaintiff went. Also, the defendant ABANDONED her kids to rescue a dog😒....ok...
But plaintiff didn't have any paperwork filed with animal control.
Also, defendant never mentioned how old the kids are. If they are 10-12 years old, they usually can be 'abandoned' for a few minutes without harm.

She would have been able to foster the dog if it had past the adoption checklist for the shelter. Shelters will foster animals out if they are adoptable and the shelter doesn't have room. The Plaintiff should have had something from animal control or the shelters that she actually stopped by. I wouldn't leave until I had something in writing stating that I stopped and left my information with the shelter just in case something like this happens. If there was paperwork with the shelter/animal control, and they allowed her dog to be adopted out, she needs to sue them.

My sentiments exactly!! I've heard of folks like the defendant who think THEY are the best parents for the dog and everyone else is doing a horrible job. They think they're God/savior to dogs. She's going to steal the wrong dog one day and find herself in a world of trouble. I can see if the dog wasn't claimed for months at a time or the owner wasn't putting in any effort to find their dog, but there wasn't enough time for the defendant to just adopt someone else's dog. People LOVE their dogs. She's just wrong and Florida needs to change their laws. On another note, this is why I don't allow strangers to watch my dog and if I'm moving, my dog remains in her crate or at my parent's house just to ensure she's not lost.

My dog ran off late at night. The next morning we called all the local animal shelters and they all said they didn’t have a German Shepard. We decided to go check and sure enough, he was there. If she only called the animal shelter, the same situation could’ve happened. This makes me super sad.

The dog did NOT live next door to the defendant. The lawn cutter Giles reported the plaintiff's dog at HIS next door neighbor's house some distance away. The plaintiff could have avoided this mess by having the dog chipped, having a collar with owner identification on it and CHECKING THE SHELTERS DAILY. My city shelter does take reports from people who have lost their pets and the information is shared between the shelters so a person has little difficulty tracking down their pet taken to the shelter. I had a friend who’s cat got out of their house. They put up flyers and called/went to the animal shelter multiple times and was told they didn’t find the cat. 2 months later her daughter found it up for adoption at Petsmart and they had to adopt their own cat!

This is why I don't deal with neighbors at all. I stay to myself. Better off like that. If you have animals make sure you follow all the rules with chips because you never know if you'll end up in a situation like this or not.

I don’t think the judge understood what the plaintiff was trying to say. The defendant held the dog until she knew she could legally adopt the dog
Not how that works. She turned the dog over to the shelter, the shelter held the dog on a stray hold for 7 days (to allow owners to come in, claim their dog and pay to get them out). Once the stray hold is up anyone can adopt the animal, she could have just left her number and told them to let her know when the hold was up if he wasn't claimed.

Definitely believe that the defendant hid the dog. The fact that she knew the dogs owners and didn’t try to return him speaks volumes. She’s probably still taking dogs now and leaving her kids.
The problem I find with JM, is she talks over everyone. She'll ask a question, not wait for the response, compose her own misguided response, then she has to have clarification. It wastes so much valuable time in her courtroom.
I think that is partially what happened here, the plaintiff could not get her side of the story out. Having said that though, there's no need to explain that one time they knocked on the door, the next they rang the bell, that is a waste of time as well.

I get where all these commenters about how they should have given the dog back are coming from but honestly, the plantiffs didn't take care of their dog in the first place. If my dog, while walking out on a leash got loose "which ever way", then I'd keep looking, call the shelter, gve them a description, maybe put up flyers. Look on Facebook in my area, post about my missing pet with pictures and the area last seen.. not wait over a week and hope it comes back.
This dog was not chipped and didn't have its shots. It was a pit bull, everyone and their mother knows the unfair reputation they have. You know *someone* is gonna get scared a "dangerous pitbull" is roaming free. The dog is lucky the defendant was kind enough to take the dog out of the shelter the day it was going to be uthanized. Plantiffs didnt do enough for their 4 legged family member; truth of the matter is, if it was left up to just them, the dog would be dead. They sadly, but rightfully lost it. Take care of your pets, people, same as your kids. We're all family here.

OMG 😮 I had a similar incident happen. Neighbor KEPT letting his dog, (puppy/5 mnths old), run the neighborhood AND beat dog upon its return to owner. Long story short, I got her, (Luna), vaccinated, heart worm checked, etc., etc. Neighbor tried to fight me on it. I've got her, TO THIS DAY, and she's approaching 5yrs old 💕

Perhaps she wants the best interest for them, sure but she is enticing the dogs getting to come to her house somehow and she's going out searching for them. I think she's keeping food out for lost dogs and then claiming them when she "finds" them.

So she is actually allowed discretion concerning what "more likely than not" occured here --in which she chose not to exercise. She repeatedly cut the plaintiff off while speaking; which put the plaintiff on the defense, resulting in her inability to adequately articulate her case properly.

There is no case. The dog had no id...was not registered with the county, didnt have shot and wasn't chipped. It is a street dog at that point.

Both parties seem sketch to me… had I lost my dog/cat best believe I’m tearing the whole city/county upside down. I’m calling everything and everyone making records, flyers you name it. So the fact the plaintiff had no evidence of filing any records is suspect to me. Now the neighbor… she seems to be an opportunist. She saw that the plaintiff was possibly a neglectful dog owner and used the law to her advantage.
I agree. I had found THE MOST GORGEOUS STRAY cat once that had a litter of 6 kittens. We thankfully were able to find homes for the kittens and let Mama Cat be an outside kitty (after spending over $1000 for her & kittens' shots & spay, Mama Cat refused to be indoors).

That’s dangerous and careless, and not safe for dogs or people. I just think that it can be hard for a person to know if a dog was carelessly let out to roam vs if the dog accidentally escaped.
Sounds like the defendant assumed that the plaintiff’s dog was carelessly mismanaged. According to the testimony, the dog accidentally got out and couldn’t be found. Once the defendant knew who the dog belonged to, it would’ve been proper to at least speak with the owner to find out what happened first, before making moves to adopt it. The fact that she didn’t show that amount of consideration tells me that she just assumed and didn’t care.

This case was exhausting to listen to. I live in a neighborhood where almost all of us are dog lovers. Most of us have dogs and we pretty much know what dog belongs to who. When one get loose we all pitch in and look for the dog. None of us wants anything bad to happen to any of our precious dogs.

Well, this is kind of an interesting thing personally, my dogs are never without of my eyesight, but my dogs are chipped but when I tell people they tell me I need to get that thing out of there because it causes dogs to get cancer. I have yet to remove the tooth, but knowing that it makes it does make me nervous.
