Then other people "Email her Barrister". It's just madness. They really think they're the first person to think of anything. Desperation.

    Ben Myers seems like a nice man and if I am not mistaken Nick Johnson has a light Yorkshire twang there, which I wasn't expecting, in my imagination the 'Lee Cooper Leisure Suit' was said with a posh London accent ;)

    How can anybody claim that Letby was not 'properly represented' when one sees Myers KC's Application here.

      Myers worked his socks off. He had nothing to work with. He’s a brilliant KC but nobody can defend the indefensible.
      Letby lovers endeavor to make it everyone else’s fault that the baby killer was convicted.

      Because of the evidence regarding the potentially catastrophic risk of patient harm from the lack of staff, skills, failing infrastructure in the unit and how unstable the babies were plus other deaths due to infection revealed by the Thirlwall Inquiry that was not presented at the trial.

      @@neilross5509 No - the Thirwell Inquiry has NOT contradicted Letby's trial. The other matters are being rehearsed because Letby took advantage of the chaotic management of the unit and the Managers covered up for her as part of covering up the problems they caused on the unit.
      NOW DO YOU GET IT!

      @@neilross5509Because those would only incriminate her further and prove her guilt . The only witness brought forward by defence was a plumber speaks volumes as any other expert witness would have confirmed her guilt.

      @@uingaeoc3905Why the need to “shout” and be rude though? Surely we can all have a civilised debate without resorting to that? Your entitled to your opinion and so is everyone else. She was found guilty and as it stands she will spend the rest of her life in prison, the harshest punishment the English justice system can impose. For everyone who believes she is guilty, she is being punished in the only way the English courts allow. People are allowed to question that, as there have been many miscarriages of justice in the past. At the end of the day she was found guilty to the standard that was required but the only person who truly knows what happened is Lucy Letby herself. Please let’s voice out opinions but do it without being rude to others who think differently. If you don’t want to read about people who think she could be innocent, it’s probably best you stay away from the comments section.

      @@CrystalGlow-mu4bf They're not worn in juvenile courts to avoid intimidating minors, but barristers and judges actually like them. I think they see it as a symbol of their expertise and profession that sets them apart from laymen, like a uniform they've had to earn the right to wear.

      @@Lonna_Loves Originally, to make them all look the same and also to anonymise court personnel a little. I've read comments from barristers who say they've walked out of the courthouse right past people involved in the trial and been completely unrecognised. The wig and robes change their shape and appearance enough.

    Nick Johnson is much more laid back here than how he is in court. He probably knew the defence didnt stand a chance in getting this approved

      I watched part of the trial. From what I saw Ben Myers became extremely frustrated with Letby at times. Johnson was always the polite, patient one. And nailed her - every time 😊
      Letby quickly learnt that she isn’t as clever as she thought 🤭

      It is a completely different situation for the KC's. They submit their arguments in writing, and the Judges will hear oral arguments, allowing them to ask questions. So the KCs are providing argument only & answering the judge's questions, so yes they are much less dramatic. The argument is everything. Mr Johnson KC would not approach his argument, thinking that the defense would lose as a matter of course. He provides an argument including reference to the law to counter the defence's argument to be allowed to appeal. It's just as serious as the trial for both Barristers.

      Both Barristers are only giving summaries of their arguments in their oral address to the Judges. Their written submission will be more detailed.

      It's because they only allow really narrow points to be used for an appeal. You can't re-try case. You need to scramble to find reasons to have the case looked at again.
      I'm convinced there's a problem in this case. I said it long ago. It will probably take years to come out, if past cases of injustice are anything to go by, but it will come out. The British legal establishment don't like to admit mistakes and have a track record of leaving people in prison for years before facing up to their mistakes.

      @@lesley9989 This appeal is leave to appeal against the trial judge's decision to reject the defense motion to not proceed with the re-trial due to excessive publicity, as the defendant would not get a fair trial. Because they had the trial, conviction, and sentence, the appeal court accepts the jury's verdict. So, the appeal can only be on if the defendant had a fair trial. In that case, did the judge err by rejecting the defense motion to not proceed with the trial. It may not seem much, but this is how sometimes people get retrials, to be resentenced or even rarely have the verdict vacated, it has to be based on very serious error of the court trying the case. It has to be on the law not on guilt or innoceent. Its all about fair trial on an appeal. Its why defence put in so many motions & objections before or during the trial, otherwise they will not have a reason to appeal.

    There was the Re-Trial of the Baby K case and there was an Application to Appeal which was REFUSED by Goss LJ. This is an Application to overturn Goss LJ's decision and allow an Appeal. So this is an Appeal, to Appeal to the Appeal Court!

      ​​@@johnkeating4221her own testimony was evidence enough ..I've been a nurse for years and she was dangerous and entitled at the very least . Not signing for medication. Not finishing paperwork and coming back in on her nights off to finish it. Taking home all those notes etc. . One of the things said in the
      Trial that really struck me . Was when she said she didn't know how the insulin got in the babies bags. So if she didn't do it who did. Stalking the parent on Facebook for years shows she is sick and dangerous.

    Regarding the police speaking to media using various adjectives to describe Letby and her crimes post first conviction, it would have absolutely no influence on me as a member of the next jury.
    I think most reasonable, intelligent people understands that any jury member can only make any determination by the facts brought forward in the case. I could not care less what any pro Letby or anti Letby proponents stated in the media post first conviction. Just give me the facts.

      He is superb but he is also a defence lawyer, one of his defence cases was a teenager girl who was on trial for killing a 7 year old
      He would of had the same struggles as Myers if he was defending lucifer but he was meticulous in the 2 trials of lucifer

    This was broadcast by Sky news courts . If Jon wants to put it on his channel thats his perogative.
    Great insight to the appeal by both lawyers for both sides. The defence argument fell at the very first hurdle as they agreed to no media restrictions after the first trial sentences. To argue after the second trial was always going to fail.

    Am i right in thinking that this appeal hearing is saying that she was prejudiced at the baby k re trial due to the fact that media etc said those things after her main trial therefore she could not get a fair trial at the baby k trial?? Thanks for posting this extremely interesting

    But remember…whilst almost certainly Letby was rightfully found guilty, the legal system in England hasn’t changed much for centuries. The more money you have the more likely you are to win your case. The saying “justice within English Law is open to everyone just like the doors of the Ritz Hotel” is true. Moreover our class ridden Society often means that those in positions of power are often able to avoid appearing in Court for criminal acts. English Law and our system of government belongs to the 18th Century and both protect the rich. If you want to seek justice in English Law be prepared to spend many years fighting the system and make sure you are willing to face the possibility of losing many thousands of pounds. This nonsense of wearing silly hats is to demonstrate that they are above ordinary people. Don’t ever imagine that we English are all equal under English Law. Look at our politicians in the House of Commons. They don’t represent the people.

      ​@@TheNerd-Yusually when there's public interest. it's unusual but does happen. i think they've said she has the highest number of child victims in the uk & she was an nhs nurse on a high risk ward so they are probably all factors that they consider to be in the public interest. seeing as there has been a lot of discussion regarding the trial itself, they may have decided to put the video out as a definitive close to the case as she now cannot appeal again. they talk about the media coverage in the judgment section, so i guess this is their way of asking the public to have faith in their decision to refuse this appeal, and to stop debating her guilt🤷🏻‍♀️

      It's a public stage. Justice must be seen and heard. The clothing reflects the gravity and traditions of the UK justice system.

It is more symbolic of the people delivering justice to the people rather than a historical relic. I have no doubt that when citizens are deprived of their liberty or even their lives, the gravity is well and truly felt.

    So at the start of this, let me understand, because she was found guilty in the first trial, the publicity in the second trial is why she was convicted? So the same principle would apply then to pretty much anyone tried for more than one crime and had second third or 4th trial whose name is in the public domain? I'm confused.     It’s strange seeing the proceedings of a uk high court, I love watching trails but only ever get the chance to watch them based in the us due to the uk laws. It seems things are changing and maybe soon we might get to watch uk trails
    I haven’t followed this case , is there anyone who has followed it in great details that feels lucy is not guilty of these charges ?

      @@juenothing5432yes I agree. There was definitely a lack of evidence proving her guilty. All they had were the notes she write after years of being bullied and harassed and called names by so called doctors. Her friends all stand by her to this day as do many other nurses who were threatened with dismissal if they spoke up in her defence in court. She put blame on herself for something that she wasn’t guilty of and under the circumstances she was in it’s easy to see why. A complete cover up of the failings of the hospital is what is was, and she was the scapegoat.

      And? British Court trials are not recorded to protect witnesses and jurors. Very often the Judges sentencing remarks and the sentencing of a defendant are recorded and broadcast.

You could have answered it in a nicer way, taking into account that not everyone may be aware of the protocol surrounding recordings in British courts, or just kept your mouth shut.

    If it was me, I would have thrown every evidence, I could find and think of. She declined a couple clinicians that, were willing to give evidence, on her behalf

      I can guarentee the very people proclaiming her innocence will not view this in full, where Nick Johnson KC states very clearly that Letby had the opportunity not just once but TWICE to call medical experts to establish she was innocent of the charges in the original trial and she chose not to call anyone. I don't know what more needs to be said about her proclamation of innocence when she is choosing not to fully deploy a defense, and one can only surmise that had she done that it would have established once again that she was guilty.

      Listen to him....heinous previous convictions....he is such a waffler, oh we must be fair no matter previous convictions.

    The Judge should have some medical knowledge given the amount and complexity of the information. He obviously didn’t have a full grasp. Infection kills one of the instances where less attention was paid to this also nutrition and hydration was lacking in instances delays in administrating certain medication essential to life for prem babies.

      Yes but it’s part of the trial. Every criminal is entitled to lodge an application for Leave to Appeal. It was never going to be granted but her KC had to go through the motions or her fanclub would be screaming “Unfair!” Weve heard that once or twice haven’t we? 😂

    3 months may seem like a short time however a 'nurse' taking over the care of a child like Lucy Letby would probable be more than grandmas and grandpas who are often slow with fixing up enough meals every 3 hours 24 hours per day when left with caring for 2 infants. They didn't call that generation the greatest generation for nothing. What could people do when living in a war zone. Like for a while in the U.K. too.

    Where is the evidence? They were under skilled, understaffed, over subscribed above their level of competence. Neonatologists who would be a constant expert presence should have been on that unit given the condition of these fragile babies and not paediatricians visiting occasionally and leaving specialist interventions to junior doctors who were unsuccessful and resulted in additional suffering for these tiny babies. The unit was full of bacteria too. The Judge was wrong when he directed the Jury that infection or similar words to the same effect would make no difference . I have made so many observations over the period of the trial that I can no longer at present. Someone had to be the Scapegoat for incompetent care.

      Your delusional. Where is the evidence? Did you follow the trial? Yes there is such a thing as circumstantial and co-incidence. However, it is not a co-incidence in her circumstances, it is an established pattern. She was the only individual present at every single incident, including when her shifts were then switched to days! The event of unexplained collapses was totally unprecedented, it was not something that happened regardless or staffing levels it has not happened before and since Letby left the ward. She even wrote a note admitting her guilt, collected medical records and searched the dead babies parents. THAT is your evidence, don’t be so naive.

I myself am guadually working through the available information First up was baby A Where Lucy came on duty did hand over in nursary 1 nurses and babiea all around and about 20 minutes only in this settling to inject air before baby A collapsed. I was amazed when I realised the circumstances, I wondered if the accused ever tried a set up with an reenactment how it could be done.. Now finding all sorts of things about the insulin cases. I was amazed to why the hospital never did any serious investigating at the time. The way the information came to light never made sense at all. And the more I find out the more rediculous of pinning Lucy for this supposd crime is not on. This court of appearal hearing will take me a lot of time to figure out what is going on. I need to be able to stay awake first. Haha.

      Trials cost the tax payer so much money,thousands each day, if they did not have a process in order, every man and his dog, that are bang to rights.would waste time and money putting in place appeals through their Barristers, just for the Hell of it, even though their convictions are air-tight.

    I've said for some time. There's something very wrong about this case and I firmly believe it will eventually come out.
    The problem is, the British legal system don't like to admit to mistakes and tend to allow people to languish in prison as opposed to admitting getting it wrong.
    It's happened so many times. Far more often than people think.
