Nintendo is Suing the Yuzu Emulator

    DISCLAIMER: I am not a lawyer. I'm a regular person who is providing his thoughts and opinions about legal matters in the United States. Take everything I say with a grain or two of salt.
    I learned this morning that Nintendo has filed suit against the group responsible for the Yuzu emulator. That's about all we know at this point. We'll all have to keep a close eye on this as it unfolds.
    I talk in the video about the general legal status of emulators and ROMs.
    At one point I say that playing ROMs is illegal. I meant playing ROMs downloaded from the Internet.
    I want to be clear that I do not think playing ROMs is illegal. I am merely pointing out that it is very questionable/debatable and still involves you needing to dump your own ROM files. I believe that just because something isn't illegal on the books, that doesn't necessarily mean that it is perfectly legal, unless there is established law stating so in a clear and understandable manner.

    I think emulation is fine but to think everyone in the world is playing legal backups from games they legitimately own is being naive. Also the Switch is a current console so I think that is crossing the line

      I can certainly agree with you on the naivety of thinking everyone only plays games they own. Even if you have a law that says it is very plainly illegal, it will still happen. No laws on the books can stop piracy as long as people exist. I think the worst case scenario for lawsuits like this one is that existing rulings around emulators are overturned and the number of developers and contributors to emulator projects gets reduced significantly out of fear of prosecution. But yeah, most individuals are going to continue to do what they do regardless of any law.
      To your second point, I think emulating a current gen console in lieu of purchasing the console and games is wrong. I understand not everyone shares that philosophy and that probably the majority of people emulating current consoles don't own the console or games. C'est la vie, I guess.

      @@eldermillennialvideogames I agree, I just don’t understand why so people and those that feel entitled to free pirated games are so surprised and angry about Nintendo wanting to stamp piracy out. Like Sony and Microsoft, Nintendo are a business and have every right to protect their IP’s. If it was the PS5 or Xbox I’m sure Sony or Microsoft would react in a similar way

      I suppose it's just the world we live in. I for one, would gladly pay a premium for a service or services similar to Steam in which I could purchase console games for play on my PC from the libraries of those companies. I'm also the guy who thought a couple years ago when movies started releasing day 1 on streaming services for $20 - $30, it was the greatest thing ever...then they stopped doing it (mostly). I can dream though.

    After reading through the document, I see that Nintendo actually has a good case. Multiple cases of technological circumvention are need to hack a Swich then to illegally rip the game, then the emulator itself has to decrypt the game while running it.
    The ninjas🥷 did their homework and I'm all here for it. The best part is the precedent it will set for other developers to protect their works.
    Pirates really got too cocky.
