I watched the whole thing. Legally, nd5 has a leg to stand on, but it's a technicality. When you stream something, that thing is no longer an "unpublished work." Technically, if Fed did "access [his] FTP" that's illegal, but if Fed had, say, recorded the original stream, everything Dom said would still stand. I'll give Nightblue credit, he's learned from his past blunders, and he's handling this better than he did before, but ultimately, he's still using every dirty trick he can find to try to discredit Dom. If he was actually sorry for what he said and did, he would apologize and that would be the end of it, but he's pursuing legal action against Dom and Fed. On a side note, why isn't he trying to DMCA the reuploads of Cut the Western Sh#t? Personally, I think it's because his problem is with Dom and Fed, not with the manner in which the clips were obtained. While many people think Dom was a "bitch" for leaving this call fairly quickly, it makes sense if you think about it. Nightblue was clearly trying to "get" Dom; he claimed to want to avoid legal talk, and yet his whole argument was based on legal issues. Dom left when Nightblue insisted on discussing the very topic he claimed to want to avoid. Did Dom obtain the clips illegally? Maybe. But he did make valid points that would have stood regardless of how the clips were obtained. Nightblue spent a lot of time arguing technicalities instead of the actual issue. He claimed to want to talk it out with Dom, but the only substance he had was legal loopholes he likely heard from his lawyer(s). If you want to defend Nightblue, and paint Dom as the villain here, you're more than welcome to your opinion. However, if you look at this situation objectively, Dom is in the right, Nightblue is just pulling out as many dirty tricks as he can to try to come out on top, instead of simply owning up to what he did wrong, and leaving it at that.

I think Dom was correct to leave when he did. Nightblue clearly was trying to "get" Dom, in that he claimed to want to avoid legal issues, yet he spent the vast majority of the time speaking about legal issues. Dom clearly entered this call in the hopes that it was going to be an informal, man-to-man conversation where they would hash out their differences. Nightblue entered with the clear intention of discrediting Dom, and he had also clearly had legal counsel, as he was prepared to talk about legal issues. With this in mind, I commend Dom for staying as long as he did, even though he was not prepared for such a discussion. As far as the boosting allegations, I'll agree that Dom doesn't have much of a leg to stand on there, I have to side with Nightblue on that one. Also, credit to Nightblue for actually apologizing, though I don't believe he's sincere. I think Nightblue was just trying to do damage control, and he only invited Dom in order to refute the accusation that he tries to bury anything that makes him look bad. He clearly didn't want to have an actual conversation, he only wanted to speak his peace and be done with it. Do you understand the situation? There is no hard proof that can be provided over a stream that what the video was taken down for legitimate reasons. As Dom even stated he knows why the video was taken down but he doesn't know if it's true or not. To find that out they would need to bring it to court (which would cost lots of money). In the meantime this is a he said this but he said this situation. Also any lawyer would tell Dom to do the same thing he did. -He was pulled into a call and was not prepared, clearly NB3 was prepared -Dom clearly stated multiple times he didn't want to talk legal, NB3 continued to do so regardless. -Dom asked multiple times to continue to talk off stream, NB3 continues to talk and even claims that Dom didn't want to talk after he hung up On top of that (this is completely my speculation here) this all seems like a setup by NB3 to make himself look better. The only points he brought up was his apology to the other player, why the video was taken down, and then he proceeds to pretty much bash Dom for the rest of the video.

Anyone can claim a take down on a video. It happens all the time to many youtuber's since the system is mainly automated. Then they can get into negotiations with youtube to potentially get it back (with an actual manual review on the take down). A youtube take down is no proof at all.

I watched the whole thing. Legally, nd5 has a leg to stand on, but it's a technicality. When you stream something, that thing is no longer an "unpublished work." Technically, if Fed did "access [his] FTP" that's illegal, but if Fed had, say, recorded the original stream, everything Dom said would still stand. I'll give Nightblue credit, he's learned from his past blunders, and he's handling this better than he did before, but ultimately, he's still using every dirty trick he can find to try to discredit Dom. If he was actually sorry for what he said and did, he would apologize and that would be the end of it, but he's pursuing legal action against Dom and Fed.
On a side note, why isn't he trying to DMCA the reuploads of Cut the Western Sh#t? Personally, I think it's because his problem is with Dom and Fed, not with the manner in which the clips were obtained.
While many people think Dom was a "bitch" for leaving this call fairly quickly, it makes sense if you think about it. Nightblue was clearly trying to "get" Dom; he claimed to want to avoid legal talk, and yet his whole argument was based on legal issues. Dom left when Nightblue insisted on discussing the very topic he claimed to want to avoid.
Did Dom obtain the clips illegally? Maybe. But he did make valid points that would have stood regardless of how the clips were obtained. Nightblue spent a lot of time arguing technicalities instead of the actual issue. He claimed to want to talk it out with Dom, but the only substance he had was legal loopholes he likely heard from his lawyer(s).
If you want to defend Nightblue, and paint Dom as the villain here, you're more than welcome to your opinion. However, if you look at this situation objectively, Dom is in the right, Nightblue is just pulling out as many dirty tricks as he can to try to come out on top, instead of simply owning up to what he did wrong, and leaving it at that.
to be honest i havent done any research on what you said so i will not try to prove you wrong since i dont rly have any knowledge about the law on this topic. although what he said on the video is that fed downloaded his stream illegalily and thats what dom tried to avoid so he left the call. I think Dom was correct to leave when he did. Nightblue clearly was trying to "get" Dom, in that he claimed to want to avoid legal issues, yet he spent the vast majority of the time speaking about legal issues. Dom clearly entered this call in the hopes that it was going to be an informal, man-to-man conversation where they would hash out their differences. Nightblue entered with the clear intention of discrediting Dom, and he had also clearly had legal counsel, as he was prepared to talk about legal issues. With this in mind, I commend Dom for staying as long as he did, even though he was not prepared for such a discussion.
As far as the boosting allegations, I'll agree that Dom doesn't have much of a leg to stand on there, I have to side with Nightblue on that one. Also, credit to Nightblue for actually apologizing, though I don't believe he's sincere.
I think Nightblue was just trying to do damage control, and he only invited Dom in order to refute the accusation that he tries to bury anything that makes him look bad. He clearly didn't want to have an actual conversation, he only wanted to speak his peace and be done with it.

There is no hard proof that can be provided over a stream that what the video was taken down for legitimate reasons. As Dom even stated he knows why the video was taken down but he doesn't know if it's true or not. To find that out they would need to bring it to court (which would cost lots of money). In the meantime this is a he said this but he said this situation.
Also any lawyer would tell Dom to do the same thing he did.

Anyone can claim a take down on a video. It happens all the time to many youtuber's since the system is mainly automated. Then they can get into negotiations with youtube to potentially get it back (with an actual manual review on the take down).
