A Trifecta takes scotus power away with term limits instead of packing the courts. Congress is key. They can literally make scotus ineffective. Even a sitting President can "ignore" their rulings if it goes against the people's majority.

Ahem, due to violations of the US Constitution, Amendments 5, 6, and 14, I'm pretty sure they HAVE to be involved. WE are NOT counting on one-sided DumboCrap opinions any longer.
A Grand jury of his peers heard evidence and decided he should be indicted, a jury of 12 were fairly picked by the prosecution and his defence team. That jury found him guilty on all charges. He had a fair trial. And he had the chance to answer questions on the stand in his own defence, he chose not to.
That the jury asked to have testimony read back to them indicates that they took seriously the judge's instruction that they could not ignore Cohen's testimony if it was corroborated by that of another witness.
Trump chose not to testify because his lawyers begged him on their knees not to and for once he listened.
If they do that, then they're guilty as he is, and no one should follow the law anymore.
When the democrats say "nobody" is above the law, what they're actually thinking (for real) is "No Republican is above the law".

in 99% of these E class felonies there is no prison time, especially first offenses. Also it was dismissed as a nothing burger by federal investigators in 2017 but NY changed the statute laws in order to put it on trump. this needs the supreme court to rule in on it based on LAW.

Trump can be given four years for EACH charge, not just four years in total. It's up to the judge whether he sentences Trump to serve those sentences consecutively, or concurrently. Theoretically, he can be sentenced to serve a total of one hundred thirty-six years.

In my limited experience, judges often set sentences to run concurrently, but Trump has been convicted of 34 counts. I do not expect the judge to order that they run at the same time. Instead, I think that some sentences will run consecutively.

The only mitigating factor for sentencing is technically first offender. Aggravating factors include no admission or remorse, multiple contempts of court, no expectation of changing behavior. There is not reasonable argument for not giving jail time. It would be a pointless case otherwise. The whole point is deterrence.

@roberthunter6927 As much as I would like to disagree with what you said, I simply can't, because it's very much true now. In the past, SCOTUS was viewed as impartial, nonpartisan, and unwavering. Statistics showed how they only took up maybe 1 or 2% of the cases brought before them. Their decisions were trusted and accepted, no matter what. Today, a lot has changed, and unfortunately for the worst.

It's a non-violent offense. Sadly, the NY courts let people out before sentencing and while a case is being appealed. However, it's possible he could be locked up for violating his gag order - although I assume that can be appealed too. Not sure.

Trump could raise various issues related to due process, such as the fairness of the proceedings, bias of the judge, et cetera. More likely, he would argue that the New York election law that he was prosecuted under to turn the false business records misdemeanors into felonies improperly relied upon alleged federal election law violations. There is also an argument that Trump did not violate federal election law, for example, if his payments were personal and not campaign related. If the Trump team wants to argue that his actions do not amount to a violation of that federal law, the Supreme Court would have the power to decide on the proper meaning of FECA. Because it’s a federal law, the Supreme Court has the power to resolve the proper interpretation of that law.

Trump was convicted of state felonies, not federal. Unless there is a substantial federal issue at question, the federal courts don't have any jurisdiction. Trump has to have his appeals heard and upheld by the NY Court of Appeals and the NY Supreme Court before he can file a direct appeal from the NY Supreme Court to the US Supreme Court, it's unlikely he will prevail at either level.
@@RaRad530the easiest path to get the supreme court involved would be new york's violations of Trump's 6th amendment rights. It's unconstitutional to not inform a defendant of what crime they are being charged with. Trump was never informed of the "underlying" crimes he allegedly committed, therefore it would be impossible for him to make a defense against them
