      The only Skyblock I've ever played is Gregblock, which is a modpack that uses Gregtech and Ex Nihilo and a lot of other mods to enhance Skyblock.
      You don't get water or lava, just a tree and an island. You need to collect rain or heat spare saplings to make the water, and compost spare saplings into dirt to sift for pebbles to make cobblestone, and use wooden crooks to get extra saplings and silkworm eggs, and use those silkworm eggs to infect a few trees for string, and slowly but surely work your way up to a full set of iron crafting tools (hammer, saw, file, bending cylinder), a bucket, slime boots, water columns, full-scale mob farms, followed by getting bronze and diving into steam-powered machinery.
      Oh, and that machinery is where the real Gregblock starts.

      💀 And the worst part is that it's true. Like seriously they forced the physics mod pro to become free yet they are doing this like this... JUST MAKES ME MAD and more than i normally get at stuff like this but this... oh this... is freaking insane like this should be illegal on a MASSIVE level like if that judge rules in the favor of the companies then that judge was definitely paid off if they did know the history and context.

      i feel bad for bedrock players, java players get mods and datapacks for free, and its easy to create them. meanwhile bedrock players have to use a stupid marketplace and have to pay money for everything

    It's crazy how instead of having a long lasting legacy for his contribution of one of the greatest minecraft maps of all time, noobcrew's work is instead just being exploited, with the "creators" of the game actively encouraging it because money. The minecraft community has a rich history that's unfortunately overshadowed by the exploitation of it's popularity, really sad

      It's really sad to see just how exploitative that marketplace has become. As soon as I realised "minecoins" were a thing I was appalled, considering Mojang themselves had an April Fools update that jokingly introduced the same concept as a point of satire- seeing them go from making fun of microtransactions to being forced to put microtransactions into their game because of Microsoft's greed is disgusting, and it's been like this for years.
      I haven't enjoyed Minecraft in a while because it feels like all the passion for the project died behind Mojang's closed doors years ago... and Microsoft is puppeteering the body to squeeze as much money out of this dead horse as they can. And it works. Because Minecraft is the most popular videogame of all time.
      I'm honestly just gonna sit by and wait for Hytale if that EVER comes out. In the meantime I always got Terraria! The difference in attitude towards development that Terraria's dev team has over Minecraft's is night-and-day. Terraria still stands as a prime example of what passion and good consumer practices can look like in the big Indie game success scene.
      Because remember, Minecraft was an indie game at one time. Oh how the mighty have fallen.

      @@KaiwalaPersonally I've been playing Vintage Story as of late, I think the only time I have fired up Minecraft in the past couple years is to try out a new mod or modpack, like Create. I just wish combat in vanilla VS was a bit less basic than it is right now.

      Yup, I pirate most of my addons. All you need is an .mcaddon or .mcpack file to install it on pc or android. If you want to get the addon on an xbox or playstation, you can upload those addons to a Realm and download the mods on the other device that way

    0:41 $7.45 for Skyblock is insane!! Every random map costing about a quarter of the price of Minecraft is stupid. At least on Java, we can download mods that change the entire game for free.

    The marketplace is basically selling what was popular free content for java, slowly getting close to producing a watered down version of the classic mods available on java like tinkerers forcing those original modders to create the "port" for themselves first to secure ownership and provide quality to the best od their ability with limited tools. The big incentive for getting addons is the ability to play with console players due to the majority of Minecraft players playing on consoles instead of ever jumping over to PC.

      It is entirely possible to just create and install resource and behavior packs for free and the same would presumably go for mods, if one were to actually mod the game(Which is not really a thing at the moment). Bedrock is more restrictive than Java in a technical sense, but there is nothing physically stopping players from engaging with it the way they want to. On PC and to a lesser degree phones at least. Consoles are sadly screwed, but that's not particularly diffrent from how it was in Console Edition.

    this shit is why i stopped being a modder.
    years ago I saw this happening, people making work for free, then companies taking that work and profiting from it, then the original creator not only gets nothing, but accused of being the selfish ones because they dont want people stealing their work and making money from it.

The marketplace isn't a direct port of mods, its a cheap copy of them made to sell to bedrock users, its not made to be a 1:1 replica but instead a close enough copy to gain the favor of people interested in the original mod/map

      The way TheMisterEpic narrated was misleading. In the image that was shown on screen, it clearly says that the term is understood by the *relevant considering party* as a type of Minecraft world which has islands of blocks in the sky. What this is pointing at is that the name sky block has become generalized to encompass offshoots of the original map such that it’s become a genre of Minecraft map and therefore, is generic and not trademarkable

      marketplace is set up to target children and less tech savvy bedrock players who might not know how to import their own maps, mods or skins to bedrock. it specifically lets trends, stolen work and stolen concepts run the front pages cause it becomes a money printer when children who don't know better buy it.
      this has been a long running issue and debate ever since the microsoft store launched in Minecraft and it just continues to get worse with Microsoft turning a blind eye unless they're forced to act, pushing smaller creators aside and even going so far as to make it a legal battle like in this case.

      If you think that's how that works you really understand very little.
      If you ask the average Minecraft player what company is associated with Minecraft most will know it's Mojang or Microsoft. The term hasn't been watered down by dozens of games calling themselves "Minecraft" and the companies can easily show a history of defending the Minecraft name from misuse.
      Meanwhile if you ask the average person playing ANY version of Skyblock where the original idea came from most will not know, and the original creator never did anything to even imply he didn't want others using the name. Now Skyblock in fact IS a term used for more maps than just his... I mean FFS dude one of the companies disputing his trademark is a ROBLOX GAME CREATING COMPANY.
      And by the way this was about Trademarks, not copyright. Quite a difference.
      And this creator that is supposedly an angel by everyone else's descriptions... by his own admission started filing DMCA's and such BEFORE his Trademark was ever accepted AND also tried to trademark the term "SkyWars" despite literally not having anything to do with the creation of Skyblock Warriors (created by Swipeshot) because and I quote "I did coin the term "SkyWars""...
      so the same guy we are supposed to be all up in arms defending because Microsoft supposedly is stealing something he never truly owned... also basically tried swiping something else right out from under another old mod creator... with the reasoning that he made up a better name for it.. Mind you Microsoft was fighting that trademark too before Noobcrew gave that one up.

      I don't feel that bad for him and I feel many people are being FAR too charitable to him.
      Dude made a map that he didn't defend the name of for almost a decade and then when he realized other people were making money off it SUDDENLY it's important that his is recognized as the original and others cant.... aka he just wants some of that money too by having the only one labelled as "Original Skyblock" on the marketplace.
      Mind you, no he doesn't own Skyblock and it doesn't take much legal knowledge to figure this out. I mean first off to have a copyright or trademark on anything you have to have a history of defending it from other's misuse... which again there was almost a decade where he never tried to do ANYTHING about skyblock ripoffs and clones.. so he's already lost that. Secondly you can't OWN a game mod/map/etc that you've made... I mean even outside of the ToS that usually says so, the law says so. Your rights cannot supersede the rights of the original game creators IF your mod/map requires THEIR game (Code/assets/music/etc) to function. Considering Skyblock is quite literally just arranging Minecraft assets in a specific layout... yeah good luck on arguing that's enough to qualify as not copyright infringement.
      Now you can say it's a dick move on Microsoft's part to oppose his trademark but uh guess what... that's part of the law. They aren't going to let him trademark something that is mostly THEIR assets and if they did they would start losing their trademarks.... remember that part where I mentioned HAVING to have defended your property for it to be trademarkable? Aka dude 100% opened himself up to this by going after a trademark because he wanted in on that marketplace money others made without understanding at all what he was doing. Being angry at Microsoft is pointless, as they are literally just doing what they have to. That entire part where this creator points oh "Oh look they are using him doing nothing about these copies as evidence against him, how mean" Like yeah dude... that's how you prove someone hasn't defended their work. It's EXTREMELY basic trademark/patent law.
      If there was even the SLIGHTEST bit of history showing that this dude cared before money was involved, I'd feel more for him... Instead right now it seems he's less worried about how his creation impacted the community and more about how it COULD have impacted his wallet if he squeezed it himself instead of letting others do it.

    how is this even a debate, from what i've searched for like 30 seconds i found that the Original Skyblock map was made in 2011 while microsoft bought Mojang in 2014. This should make no legal sense for Microsoft to be able to lie about creating and owning that map.

      At it's root? The relevant law doesn't care. Trademark is a consumer protection law, and as such it's logic is quite different from, say, copyright.
      First off, trademark only starts applying when you actually register the trademarked word/logo/likeness/whatever.
      Second, it only protects the term in markets that you actually operate in, both in terms of product catagory (Monster energy drink suing other companies that have the word 'monster' in the name of their products when said products are not even tangentally adjacent to 'energy drinks' and trying to force settlements from parties who don't have the time and budget to deal wtih the court cases is straight up engaging in extortion, when the case actually goes to court they lose hard anywhere that has trademark laws that haven't been warped into uselessness) and geographic location (that's a bit more complex regarding what does and doesn't get affected).
      Thirdly, if your brand name becomes the common term used by the general public for All products of that catagory, it becomes generecised, and the trademark is lost by way of being meaningless as your brand has simply become another word. That's why Google fought superhard against the use of the term 'to google' to mean 'to use a (any!) search engine to find something on the internet'... for all the advantages it gives them, it also greatly weakens the utility of the trademark itself.
      As a combination of these elements, if the word you're trying to trademark as the name of your product in particular has become the common, generic term for that catagory of items (or a sufficiently adjacent/overlapping one) Before you register it, you won't be able to, it will be invalid.
      Now, Copyright, on the other hand, That cares. He'd have a case for copyright.
      The problem is that, seperately, Microsoft would also have a case against him for making the thing in the first place (doesn't matter who owned the copyright at the time, Microsoft owns it Now, and copyright works very differently from trademark). And microsoft persuing such a case, and Winning, would functionally make moding in general illegal unless one first attained an explicit license from the rightsholder. Which would be, frankly, a disaster for the wider video game industry and community. (its' actutually a lot more complicated than that. In some ways it wouldn't be as bad as that sounds, in others it would be quite a bit worse.
      And no one who actually knows how the industry actually works wants that to happen. The problem is that the exeutives and shareholders of the big corporations operating within the video game industry Don't actually understand how it works. They sure do understand (or have lawyers who understand and can explain it to them in small enough words) IP law and how to use it to engage in legalized extortion though!

      Microsoft's argument seems to be not that they created and own the map, but rather that "Skyblock" has become such a generic term disconnected from its original author that he should no longer have the right to trademark it. Like how "photoshopping an image" or "googling something" have become generic verbs to say editing an image or searching something online, but I guess this doesn't apply to billion-dollar tech companies

      @@strange-universe genuinely, at the price point people pay for consoles these days, you can get a pc that is far better for a similar price, ESPECIALLY if you are willing to actually learn a few things, it isn't even all that difficult, and if you find it kinda difficult, there are plenty of guides online to help you with it. Just buy or build a pc and get minecraft there, it's ten times better.

      Flatworld only has 1 biome. You will not be able to get all items using a flatworld. You will never be able to get snow, bamboo, mushrooms, bees, etc etc.

There's a resource pack called Ty'el UI that available for free on curseforge, it overhauled the bedrock UI from menu, inventory, containers, with TONS of small useful UI and features too.* IT also has confirmation prompt before you purchasing any paid content on marketplace, it is like middle finger to microsoft because they cannot implement that very simple prompt but community can.*

    6:52 It specifically refers to itself as "this version of the original skyblock" - implying that it isn't THE original, despite it being virtually identical. Technically false advertising since it basically IS the original map ported to Bedrock (potentially with a few very minute changes), but at the very least they aren't claiming to be the original creator like Razzleberries.
    Edit:It is technically written in a misleading way however, effectively tricking users into thinking it IS the original.

      Legally speaking you can call a recreation original in any way, shape, or form, you have to use classic, even if a company holds copyright of a brand and remakes something without the original creator involvement they open themselves to charges of impersonation and or false advertisement

That description is just there so that when someone is, inevitably, mislead into thinking it was the original, the people who uploaded it can point there and say "but we say right here that it isn't :) it's just a version of it :)". That's like if someone created a game using a Game Engine and then find out that the game engine company has been saying they created the game with zero credit to the original creator.

      Noobcrew didn't simply "reproduce" Minecraft. Instead, he used the game as a platform to create original content-a unique game mode called Skyblock. This is analogous to how many developers use game engines to create entirely new games, even though the engines themselves are not theirs.
      Noobcrew created something transformative within Minecraft, adding original content and gameplay mechanics. This differs from merely recreating Minecraft, which would be a copyright violation. His work, therefore, falls under what could be seen as a derivative work that provides additional value. This is not "reproducing" Minecraft but using a tool to create something new.
      The key here is that while Minecraft is the underlying platform, Skyblock is an original creation by Noobcrew that has become iconic in its own right. It would be akin to creating a mod or level using a game engine. The original game engine creators still own their technology, but the new work (the mod or game mode) belongs to the person who created it unless otherwise stated by the terms of service or license agreement.
      It was more transformative than straight up stealing.

      Mojang should add their own copyright system to the marketplace so if you made an original game, others shouldn’t be able to copy it. Although the only ones who can copy it is Mojang because they are the owners of the game of course they can make anything if they choose to. This will incentive more creative content. Another thing that they should add is remixes, so if you want to make SkyBlock and mix it up to be different, it will go under the original SkyBlock section if you scroll down. It will say “remixes” and under it is a whole lot of versions of SkyBlock. This will solve the whole naming problem with SkyBlock which was honestly not a big deal anyways, most people who will watch this video will forget about the naming problem anyways. The only one who cares about it is the original owner of SkyBlock which why would he really even care about it in the first place? Does he want more fame or does he want people to not get scammed out of a free map he made? If he made a free SkyBlock map why does he not put it on the marketplace himself to prevent people from getting scammed out of their money? Why go through all the troubles into getting into a lawsuit which he will probably lose?

      But now I'm seeing when I go to buy Minecraft it says you get both for 30$ (USD).
      A lot of people might just own both copies of the game.
      If on PC you can easily check if you own both by using the launcher and clicking the play/download button.

      You are missing some information here, as the creator of the video doesn't seem to understand trademark law. You can only have a trademark if it doesn't already mean something else within context.
      If you say "I am going to install windows on my computer" no one will think you are going to install Linux, as these are known to be 2 different things. For this reason Windows can be trademarked for operating systems. You could likely still open a window cleaning store called "Windows", as long as you don't copy any of the other branding (the logo, the color scheme etc).
      If you say "I am going to play Skyblock", it is not implied that you will play Noobcrews Skyblock. Skyblock has become a general term for the gamemode of being on an island in the sky. This would be similar to trademarking the terms "Gaming", "Video game" or "Playing games". These terms are all no longer related to one seller or company, they are generic. If a term is generic it cannot be trademarked anymore.
      Microsoft is the good guy in this case, saying everyone should be able to use the term "Skyblock", not just Noobcrew.

    I think what he is asking for is reasonable. He will probably win the legal battle if it ever gets to court but it sounds like the larger companies know they aren't going to win and since his request is reasonable they are starting to change. He is not attacking them like nintendo does for even the slightest affiliation he simply just wants people to know that they are not playing the origonal version which is not that big a deal.

      1:He gives up due to lack of funds to keep paying lawyers
      2:The thiefs get the case given to a judge thats extremely pro business and its thrown out
      3:Appeal until it reaches scotus,which will make a batshit ruling that says copryright/trademark is a one way street and that only large corporations can have it.
      4:He settles for an undisclosed sum to drop the trademark and cease demanding credit for his own work. Said sum is not nearly as much as they made, so they still come out ahead.

      Xerox, Google, Kleenex, Hoover, and many more companies have fought hard to avoid their brands becoming a generic term, or they'd lose the capability of stopping others from using the name.
      Like a wet wipe could literally have had the name kleenex on it, despite it not being the brand Kleenex, like "Uber Bango Wipes, the best Kleenex for your bum!", because that term would simply be "A wet wipe", because it is so commonly used like that.

      I vaguely recall Stampy saying that he doesn't mind if others copy his world as long as they don't try to pass it off as the original. He's even visited copies made by others in the past.
      I think it's a reasonable and unspoken rule in the community that you can directly take the maps of others and showcase as long as you don't try to take credit for the work.
      You don't necessarily have to credit the creator, Ie "hey everyone welcome to the video. I found this map but I forget the name of the creator. it sure wasn't me tho".
      I believe shortly after lovely world ended, Stampy released his map on the marketplace and probably elsewhere for all to enjoy. Toycat has done the same thing and released his world. I believe the Hermits tried to do the same but idk the status of if they got on the marketplace or not. I think Truly Bedrock got in on the action as well.

      @@wfr878 most of Stampys audience is either people who watched as kids or people who have kids and are rewatching. I'd bet it's mainly adults at this point that would want his world since they would be the only ones who have be able to binge SLW's 840 or so episodes.
      I personally did a recreation of Flower Power on bedrock back in 2015 for me and my siblings to play. I showed them the video and they wanted to play. I conveniently had a world to play immediately.
      It's gonna be the older crowd buying SLW and other youtubers maps. I'd buy a stampy plush if he had one (I missed out on the past opportunities due to lack of money to burn)

    This is honestly one of the reasons I dont buy stuff from the marketplace. A lot of the stuff on it is stolen content that the original creator can't do anything about except watch as their creation get milked for thousands to millions of money. Unless it's an official version or someone list/link the original, I won't get anything on the marketplace. Not that I buy anything on it anyways because nothing there is actually worth my money.
    I really hope the creator of One block follows NoobCrew step and either file for a trademark or talk to Mojang because it's also a very milked content on the Marketplace and other content creators.

      You know why a lot of it was free on Java? It was illegal to monetize.
      You really think that programmers, artists, and other people, would not attempt to monetize something they've worked on for sometimes 100s if not 1000s of hours, if they could?
      And what is overprized? If someone knows what they make is niche, and they spent (collectively) a 100 hours on it. Then 7250$ would be "the minimum wage"... So saying Microsoft takes a substantial cut, let's just say 50% (It's their IP, they paid for it, and Mojang did most of the work in the first place), that means they would if they sold it at 10$ have to sell at least 7250 copies to just break even.
      And on something like Marketplace, only the most popular stuff sells well, the rest is relegated to a few interested...
      And if people are willing to pay? Well, technically it isn't overpriced, is it? Overpriced means people wont buy.
      There is so much wrong with your comment, and not understanding a lot of stuff.
      If people could be paid for the modding, they will. Quite a few modders of Java went to Bedrock specifically because they can... but selling mods in general is a copyright issue at its base, but not when sanctioned.

    I hate to say it but this likely to fail on the merits. You can't trademark a term in common parlance even if you are the one that came up with it. Noobcrew created the term and the mode in 2011 and made no attempt to control the IP for 8 years allowing it to enter common parlance.
    If he didn't want people to have free usage but not be able to profit off of it, he needed to immediately trademark the term and attach an open license with a non-profit clause to it when he released the map back in 2011. Even then, it would still likely fail on the merits given that it would constitute tortious interference on IP he doesn't own. He can't force Mojang or Microsoft how they monetize their own products.
    So the only thing that would give him 100% success would have been making his own game from scratch, Trademarking the name, and attaching an open license with a non-profit clause.
