    The actress playing the cancer patient is Eileen Grubba. She literally lived through cancer caused by a medical mistake from a vaccine she received as a child. She became paralyzed which resulted in getting cancer from overexposure to x-ray radiation. Through dogged determination Eileen taught herself to walk again and now is cancer free. Eileen Grubba is an internationally known disability advocate for performers with disabilities in Hollywood. This episode truly shows an authentic disability portrayal.

      FYI, it wasn't the vaccine apparently, or at least not the one they originally thought it was. For a long time they didn't know if her paralysis was caused by a bad polio vaccine or Guillan Barr Syndrome but she claims that the Polio was ruled out and they did find a spinal chord injury from a viral attack which might have been from one of the other vaccines she was given (it was done in large batch apparently).

    I would be devastated if a surgery I had to save my life ended up making me wheelbound because of a simple, dumb mistake that the doctor never told anyone about and then covered it up with a metal plate.

    I really don’t blame her for wanting to sue. One mistake from a doctor costed her impairment for the rest of her life. Same thing happened to my mom while she was in the military. A doctor was giving her a lumbar puncture and kept messing it up and must’ve punctured a nerve and for almost 25 years she’s had chronic lower back pain from where to doctor tried to do the procedure and it runs all the way down her leg. Unfortunately she couldn’t sue the VA due to her contract with the military.

      Honesty is one of the main things that lowers the rate of being sued. Doesn't zero it (nothing does), but it lowers it enough that a lot of hospitals have adopted honesty as a policy over the years.

      I don't think they thought she wouldn't care or that she wouldn't sue. I think they were surprised that she was shooting the messengers. They went out of their way to do right by her, in a way that could cost them professionally, but she belittled them for it, as if they were part of the coverup. Look at what happens in real life. Dr. Death, anyone? She could have thanked them for uncovering the truth and being honest with her and then proceeded to state her intention to sue without being angry at them personally. She lumped all doctors together, unnecessarily.

Any doctor you can train not to feel whether it's for their patients or their own emotions, does not sound like a good doctor to have. They maintained their professionalism as far as I'm concerned but expecting them not to feel a certain way is too much to ask imo.

    If I was her, I would have gone after the doctor who caused it and the others who covered it up. And the doctors who told me the full truth, I would never go after. I don’t blame for how furious she is. The amount of anger I would feel if I was in her shoes. Thanks for uploading.

      Emotions can interfere with a person's reasoning, finding out the truth caused her to go ballistic since she went through all of this for nothing not to mention the fact that the incident was covered by an administrator. She probably didn't need to shoot the messenger, but I wouldn't blame her for suing the hospital.

      Ultimately the hospital is liable because the ones responsible worked for the hospital when they did the damage and covered it up. She can still sue the doctors who did this along side the hospital. They'll just be separate defendants who will have to have their own layers. Also, the hospital may be able to sue the doctors responsible as well as go after their licenses. I dunno if the show showed what happened but I'd assume the hospital settled and the guilty doctors lost their licenses.

    When the doctor's went to 'fix' my broken ankle, they managed to roll the big joint right ontop of my nerve, pinched it completely and it took years to move and finally release. its so so easy for these things to happen, be it on purpose or accident. medicine really is such a delicate art

      I came out of knee surgery with too few stitches on one of the incisions, and ended up with a wide scar. stretching from there to near near center of the patella (about 1.5 inches) there was something wonky with the nerves, like a single tense string where there was nothing of the sort. Touch one part of that line, the whole distance felt a fluttering kind of pull. I don't know if the damage was from the surgery or from the way the scar tissue formed around that badly stitched hole they put in me (I lean toward the latter), but it took over a decade for that annoying little nerve that got messed up to get itself straight.

    I get her anger; I would want to sue too. However, her anger is misplaced at the wrong doctors. The two of them didn't perform the surgery that caused it.

      As someone who works with the general public, the person who tells you the bad news is the first person you become angry with. Then, after you have had time to think, you become angry at the person who wronged you. I've been fussed out many times over facemasks and all I could say is I don't make the rules.

    Something similar happened to my mom years ago. She had a tumor on her brain, first surgery went well. Second surgery, the doctor cut a nerve that controlled half her body. Near paralyzed all along her left side. She can't move the left side of her face, lost her sight and couldn't close her left eye, can't hear from her left ear, BARELY feels on her left side and is at high risk of falling because her balance is waay off. Surgeon basically blamed it on the tumor, saying it was on the nerve and when they removed the piece the damage was done. Since my dad didn't really understand what the doctor was saying, and by what my mom said they were never told the potential risks of the surgery to begin with, he just took my mom home and took care of her. Years later after my dad's death, and my mom getting surgery on her left eye to put a gold piece inside so it could stay shut, my brother found out the truth and tried to sue on her behalf but since so many years had passed it was too late. Since I handle her medical care now, I get EXTREMELY picky on who her doctors are just to make sure she doesn't get hurt again. We understand mistakes are made, but it's one thing to admit the mistake, it's another to try to hide it and lie. I don't want her with another liar again.

    No doctor I know of will testify against another one, in the same way no cop will report another cop engaging in illegal activity. It simply doesn't happen. A "bloodthirsty malpractice attorney" is EXACTLY what that patient needs!! Enough costly lawsuits and maybe those white coats will stop covering each other's godawful mistakes.

      Ironically, "bloodthirsty malpractice attorneys" might make them close ranks even more once they realize that they can't play God just because they speak a different language than the rest of the world (You'd have to be a doctor to spot another doctor's mistake), and that their stupidity has consequences.
      To be fair to cops, their stupidity is far more easily recognizable.
      I hate the lack of accountability and transparency inherent in both these professions.

      Why would increasing the potential punishment and risk cause them to stop covering each other? More potential lawsuits will make them cover up more, as the alternative of allowing the lawsuit to happen will become more and more unacceptable.
      This all could have been avoided if the system made it so you could report co-workers without going down yourself or with actual faith in justice haooening

      @@theiran With 6 figures of debt to get through medical school, you likely would not do anything that puts your license at risk. Realistically, if you want any way of supporting your family without being crushed by the debt. Its very easy to say until you've been in school for 10+ years to get the license.

      there is a difference between malpractice and a mistake. Now the doctor covering the injury and not telling the patient of what occurred is most certainly malpractice and is a lawsuit. But if a doctor put you into a wheelchair through a mistake that was not negligent or had not mal intent, you knew the risks going into the surgery and you wouldn't be able to sue them for anything. The only reason why the lady in the clip has a case is because the surgeon decided to put a plate in her back to hide the mistake.

    So sad to see…my cousins delivery was botched and the delivery doctor was nowhere to be found. The hospital covered it up. They thought because she was a teen mom she was dumb and didn’t have family to fight for her.

      @@jannalam6861 initially after the c section both mom and baby were fine, 30mins later baby was bleeding in multiple parts of the brain. When investigated the delivery doctor was nowhere to be found, hospital did not cooperate. Later he was diagnosed with cerebral palsy after birth.

    I can sorta relate to this one. I had spinal fusion surgery, where ever the doctor got the bars and rods from where not clean or good, because they gave me an infection a type of infection not many doctors heard of, it was to the point where they were calling doctors from different countries including China. So I get put on IV meds for 10 months straight 24/7. I was even allergic to one of the meds but because there was only two meds in the world at the time that could cure me I had to be on it. 7 months in my parents notice I'm not answer them when their talking right at me, I didn't hear loud noises, finally two months later my mom took me to the hearing doctor. The med that I was not only allergic too was the med that took 90% of my hearing in both ears.
    It was heart breaking at the time, A surgery that was suppose to save/help me caused the infection then the meds what were saving my life from the infection took my hearing. I was so angry for so long. I was only 16 when it happened. Now I've grown to accept my hearing loss and embrace that part of me, learning ASL helped tons.

      Depending where you live, theres a possibility it was a private practice that bought real cheap bars from some shady factory. Its genuinely tragic you end up allergic to the only thing thwt can help you, and had to give up your hearing. Im so sorry, hope you are doing better.

    my aunt in law, had a mass in her chest, her doctor came in and completely drunk , dirty scrubs, drunk and on a cocaine binge , he completely ruined her, She went from DD to well a flat chest almost.. she woke up literally traumatized. She was a lucky one , only allowed to sue, because her husband wouldn’t allow her to sign off and keeping doctors accountable if she got injured. She was able to sue and Change her whole life and reconstruction surgery! It happens so much often then people think…

    I get why this lady is upset, I really do...but she shouldn't be so mean to to the 2 who are telling her the truth. It wasn’t their faults, but the surgeon who covered it up as well as the Dean. Be angry at the ones who ruined her life, not the ones who discovered the truth and knew they had to tell her it. I'd more so want to sue to actual surgeon at fault....not the entire hospital. I had a great surgeon when I burst fractured my C5 and needed a plate put in my neck. But he ended up getting a sour attitude when I'd come in for tingling fingers and severe neck pains (nerve damage from the car wreck that broke said neck) and when my mom asked a simple question, he screamed at her and took on the biggest God complex ever. I happily told him where to stick it and have never gone back. I also warn people about him. The rest of the staff there were amazing, so I only went after him since he was the one who stepped way out of line and became very unprofessional.

      If the dean of medicine is covering it up to act in the best interest of the hospital then the hospital is responsible and the hospital get sued and while those may have not been the individuals responsible when you learn that your life has been destroyed and it was just covered up you're going to be angry at anyone giving you that information.

    My colleague has something like this. Her breast cancer had metastasized to her spine after years of remission. She had back pain, went to a doctor, was immediately scheduled for surgery the next day. Doctor said "Don't worry, the risk of you being paralyzed is very low". Well, she woke up unable to feel or move her legs.
    It's been two years, and she has slowly, very slowly, learned to walk again. She still cannot feel one of her legs and generally walks with a cane. I don't know if it was a mistake or if the metastasis was genuinely so bad that this was unavoidable, but it's incredibly frustrating for her. Especially since the oncologist thinks she only has a few years to live.
    She had also just left her abusive husband when the back pain started (she originally thought the back pain was soreness from moving her stuff out).

    Didn’t get to watch this yet but the title made me want to comment.
    I was told I had kidney cancer and the surgeon removed part of my kidney and so called tumor.
    Found out 6 weeks later I didn’t have cancer! And this surgery has messed me up so bad I’m in so much pain everyday- And now my kidneys are declining gfr is 44 was 60, I have chronic kidney disease. See a nephrologist next week. But to the surgeon who waited weeks to do my surgery and is one of the best in the world lol He most likely knew I didn’t have cancer. Or he would have got me in the operating room asap but he waited which was a red flag. Even the report from the radiologist on ct scan read almost definitely cancer! I still have that!
    Well now it’s really killing me from the damage done to me in the surgery. Malpractice but why bother can’t win.

      Omg, everything they’ve put you through, that’s so unfair! I can somewhat relate, as my local hospital allowed me to get sepsis to the point where my large bowel ruptured & they had many chances to intervene … years later, I have type 1 diabetes pretty bad, my lower right leg amputated (due to post-sepsis syndrome) & fatty lumps all over my liver. Probably not even close to what you’re enduring, though. I’m so sorry, hon. If I could absorb your illness into myself, I would. Sending my thoughts & prayers. 😢💔🙏

      sorry to hear what you have gone through. But I would like to point out that's the price of waiting for 'one of the best in the world' its not like they can do surgery 24/7 and even a couple hours of surgery is mentally exhausting. Just because you have cancer doesn't mean you are gonna drop dead the next day, unlike some of his patients I would bet. I do hope the best in your recovery however, surgeries and rehab can be rough.

    I had my gallbladder removed a year ago. The doctor that did it didn't check to see if the gallstones moved. they had. 6 weeks later, I woke up feeling like i was in the freezer. I was leaking bile and had a potentially life threatening infection

      That rage gets you nowhere in the end. I was run over on a pedestrian crossing by a taxi driver not paying attention, and I wanted him to pay for what he did. The legal system let him off easy. I carried that trauma and anger around for years, until I realised in order to heal I had to let the anger for him go. Hatred only hurts us, it doesn't hurt the ones who did the damage.

    I can understand why the woman felt betrayed by what happened. And she should sue the hospital for everything they've got. But she had no right to take her anger out on those two who have been so kind to her and caring for her for months. They had no idea the procedure went wrong; they were the ones who found out about it. And instead of covering it up, they told her the truth. If she should be mad at anyone, it's the actual surgeon for messing up her back and the Dean for covering it up. But she owes those two an apology because again, they weren't part of the operation. They are innocent to the crime that was committed and shouldn't be held responsible for another doctors mistake.

      If she sues the hospital for everything they've got, and succeeds, the hundreds of doctors, nurses, technicians, and other workers who have no involvement whatsoever with her situation would be harmed. We also have patients who rely on this hospital for their care, who would now have to go to somewhere else. Imagine the impact on paramedics, who now might have to go to a farther and/or less equipped hospital for their patients. Imagine the family of a person who died as a result of the that, finding out that the hospital that could have saved their loved one's life was no longer there because of the actions of this woman. Imagine THEIR anger towards her for doing that. And imagine if she also blinded with rage decided to take it out on everyone who didn't even have any involvement or who could be blamed, like everyone who works at the law firm, the paramedics, etc. And then imagine the ripple effects that THAT person could cause by doing that, and someone else dies as a result, and THEY use their anger to aim at a wide target as well, AND SO ON AND SO FORTH. We get an endless chain of people hurting other people, and those hurt people making more hurt people, who then go on to hurt more people.
      She's angry, and because of that, she's willing to burn everything else down, without even considering if it's right to target those who had no involvement or cause harm to other patients as well. That's not to say it's totally wrong to sue a hospital to the ground. It really depends. But if you are a person who decides to do that, you really should think about the ripple effects of succeeding. It better be worth it. And you'd better understand what the world becomes if everyone uses their anger like that. Her anger is justified. What she wants to do with that anger is a different story. Maybe it is right to want to destroy the entire hospital. Maybe not. IDK.

      @@ShadeSlayer1911medical malpractice insurance. Insurance companies often reserve the right to sue the person who caused them to have to payout. Accidents are one thing, but in the real world if he made a mistake that falls out the the normal range of accident then the insurance company could go after the doctor for the loss.

    I'd sue, but not with an eye toward destroying the hospital, just toward making what's left of my life a little better. In other words, for a substantial amount, but not so punitive as to destroy people who had nothing to do with it.

    I’m siding with Max here, it doesn’t matter if they don’t have all the facts, even if they are wrong, the patient deserves and absolutely has the right to know, when it comes to this situation or in any medical situation the highest priority aside from keeping yourself and coworkers safe, is the patient.
    Also I 100% think she should sue, that guy should be put in jail but that’s not even the worst part, it’s that he doesn’t even care

    I could never take on the massive responsibility of performing surgery. One mistake changing or ending another persons life. I’m glad I don’t work with life, death, and disability.
    I was misdiagnosed for 20 years and hated all doctors. Then my wife went to medical school. Now I can see both sides. Wrong is wrong, of course. But mistakes are inevitable, even in the best hands.

    I'm not a sue-happy type of person, but this absolutely would have been my response, too. Unacceptable. Any doctor who makes a 'mistake' like this should at least lose their job and pay the patient thru the nose...and get additional education and training before being allowed to perform surgeries again. Any doctor who would cover up such a thing should lose their license and never practice medicine again.

      It's not revenge, it's restitution. Suing someone who took away your mobility, KNEW about it and sneakily covered it up, is hardly revenge imo. I get that she said she wants to take down the whole hospital, but given that multiple people systemically covered it up, the hospital clearly has issues.

    I should have sued the hospital that misdiagnosed me when I was seven.
    Little backstory. In 2009 my sister and I were in a golf cart accident. My sister had a concussion and some bruise and minor scrapes, but otherwise she was ok. Me on the other hand I was burned by the acid in the battery when it leaked onto my right leg. I also broke my right clavicle. After my sister lifted the golf cart off of me a nurse who lived nearby picked me up and set me in the back of her van. I had to be air lifted to the hospital. There they 'treated me,' but misdiagnosed me with road rash. Yeah I have no idea how. Anyways I had a gaping hole in my leg they stitched up and then they set my collar bone. They sent me home only hours after being admitted with the acid that was burning me still eating through my leg. My parents took me to another doctor who realized I had acid burns on my leg and started treating me. We should have sued that hospital for negligence, but we didn't.
    I don't remember the pain. I blocked that out. I bollocked a lot of things out from that part of my life, but I can't block out thinking I was going to die. I have scars obviously, but also a lot of trauma because of what happened. Maybe if the hospital had done their jobs I wouldn't be nearly as traumatized as I am by it.

      I am so sorry you went through that. The feeling of "I'm going to die" stays with you forever, I was hit by a car and I'll never forget that moment. If you haven't already, I would recommend therapy. It took me three years of therapy to be able to stop the nightmares and start to put the trauma in the past. I hope you get some peace.

      Yeah, I do too. The woman is right for wanting to sue, given that they borderline ruined her life. She was angry and upset, hence taking it out on the doctors who told her the truth. While I don’t agree with her taking it out on them, I understand it.
      The doctor who performed the malpractice made his bed and the the dean (Peter), wants to act like he was protecting the hospital from a lawsuit they would loose, when in reality he was protecting his ass.

      I see it as more making the situation more complicated. It's not a situation with a clean good outcome. Other than the person who made the mistake and pressured everyone around him to cover it up, no one else was entirely in the wrong, but nobody was entirely in the right either.
      The woman wants to take it out on the hospital, not the doctors who actually did that to her. If she succeeds, she would be putting countless doctors, nurses, janitors, and other workers out of jobs. Not only that, but their city would have lost a major hospital, and their medical needs would have to go elsewhere, possibly a farther location. She would be hurting so many people, because she wants to take it out on the hospital rather than the individuals who hurt her. Maybe it's because she's so angry at this moment that she can't focus her anger and just wants to carpet bomb everything in front of her. Maybe it's because she knows this could get her more money. Or maybe this is just who she is, a purely vindictive person who doesn't care who she hurts in her quest for vengeance. That's possible too. She could be a sweet and innocent victim, but that doesn't mean she can't also have her own major character flaws. Regardless of any of that, I understand her anger.
      The Dean wanted to protect his doctors and the hospital, and it's not like he could have undid the damage done either. The damage was done and he was only trying to contain the damage. He's not a psychopath either, at least not apparently, because he knows he committed a wrong. He just saw it as a lesser wrong. It's not right either, but I also understand his perspective.
      It seems to me that the writers wanted to write a more morally complex situation. And at least based on this clip, they succeeded. It doesn't mean they're trying to make justifications or take sides, again, at least based on this clip. It means they understand that the world isn't so simple with black and white morality. Morality is often grey.

    Although the botched doctor should be sued there is NO reason for her to take the whole damn hospital down WITH him!

      All the doctors that helped him cover it up, the report being wiped away by the dean of medicine at the time and the doctor quietly removed from the hospital without admitting fault makes it the hospital's fault. It's not the current director of the hospital's fault, but it's not the patient's fault it took her that long to find out either. The hospital is also the place that will have the money to actually pay anything close to a fair settlement for disabling her, not a doctor who might not even still be practicing/have any money.

      the funny thing is, the botched surgery only had a possibility to be sued because that doctor put the plate in and didn't inform the patient of the complication during the surgery. If he told the patient, all it would be is a complication and the doctors wouldn't be found breaking ethics or for having malpractice. tbh this is just a single doctors ego fucking up not only a patient but a hospital trying to keep his reputation.

      I can answer that question in one sentence...the hospital is the one with the deep pockets...not the doctor and not the dean. The doctor was covered by malpractice insurance that would pay out based on his policy. She can't go after his personal assets. The dean...is retired and might be wealthy but he isn't directly at fault. The hospital is where the real money is and regardless of the fact that the people who did this are no longer there the hospital is still liable for a mistake made inside one of its OR's.

    I have one of the best ortho surgeons in the country. He did both my hip replacements, and he told me he did not want to do any spinal surgery. He admitted that spinal surgery is too risky and often can go wrong. Even with the best surgeons. He wanted to alleviate my back pain by fixing my bad hips. He did. My back and hip pain is 90% less. No spinal surgery. I can live with the pain with creams and anti-inflammatory meds.
    I did reschedule my left hip twice. My doc asked why. I told him I wasn't taking the chance of him being tired, hung over, or distracted since both were after a holiday weekend. Lol He said, "smart!"

    Went to see a Dr once for an issue with my hands, or as it turned out - with my nerves. She spent a substantial amount of time berating me, telling me how silly overweight-fat-slob etc I was.
    11 lbs over 'ideal' weight for a ~6' male and built like a gorilla. Nothing was done about my hands, which today (25 years later) yay-go me... still mostly work. Mostly. But hey, who needs to be able to hold onto things anyway?

    I remember when I was growing up, hearing about the hernia surgery my dad had and they left a chunk of gauze in the wound. A year or so later, it came to the surface and 'exploded' into a mess of gauze, blood, and pus. I thought that was terrible enough, but this is out of this world horrendous.

    Sadly, there is a 7 year statue of limitations for medical malpractice. So, if you are needlessly suffering due to medical malpractice, you have 7 years to take care of it.

    my mom had back surgery 4 years ago and then again 3 years ago. the second surgery the doctor hit a nerve and now she has chronic lower back pain. she wasn’t the first victim either. he did it to over 10 patients and blamed that it could happen. he got his license taken away and got fined. that’s it. ridiculous

    Medical errors are the second highest-ranking cause of death. In Canadian it's almost impossible to sue doctorsor hospitals. Wich is why their liability insurance is so much lower than in the US.

    It brings to mind an interesting question: should a doctor who makes a single mistake be ousted from the profession when they could help countless others perfectly in the future? If you do something for decades, surely you will make a mistake at least once. Should all this doctor is be lost for 1 bad event that wasn’t even malicious? It’s an ethical question that is muddied by the cost of care in the US.

    Hospitals are big business. Dictors and nurses are employees who have thier own stake in hospital survival and not taking responsibility for their mistakes.     There are good doctors and there are bad doctors. She unfortunately had a bad one and another who had covered everything up for a long time. And it took several good doctors to realize the mistake that had been made. Something that should have been seen long ago.

      The Dean of the hospital covered it up, making the whole hospital liable, that's why she's suing the hospital

    It was unethical, stupid and cruel to tell the patient the plate was removed and then refuse to explain anything or answer her immediate and valid questions and instead speak cryptically about it.

    Sue the entire hospital? Two people covered it up. The one who made the mistake and the one who hid it.

    Not very smart to openly threaten the people taking care of you....like the doctor said, we take care of our own. If he was still working and heard this woman was gonna ruin him and his hospital the moment she gets better, he would.... how do i say it
    "see to it she does not get better... for a while"
    People who make threats whatever the cause, are idiots. Thats literally like an artillery battalion warning the enemy soldiers to stand clear

    What results were Max and Ellen hoping to achieve? Of course she is going to sue I would. It doesn't matter if the doctor who did it is there or not.
