Instead of checking if he was hurt the cop started arresting him in the middle of the road and another accident nearly happened. That cop put everyone in danger. Note you should NEVER move a motorcyclist that has been in an accident, you could end up paralyzing the person! Worse of all the officer received no punishment for it.

      Better question: What was that rider thinking accelerating from 78MPH to 81MPH in a 55MPH zone right into the back of what he just said he thought was a cop? Clearly the rider blurred his speedometer out when he was above 85MPH (misdemeanor speeding in Florida), but at the beginning it looked like he was doing over 100MPH... (felony in a 55zone by Florida law would be 105MPH). from the begining of the video to the crash he had over a mintue to not drive like a moron - but he chose speed instead. Even when he started getting too close to the cop. And WAY before the cop made the descision to stop him. Think of this from the point of view of all the rest of traffic on that segment of road - not just the biker's POV. We expect cops to stop idiots. He stopped an idiot. Job done.
      From there - posting the video publicaly online means there's an unedited video where the speedometer can be read. This can be subpoenaed and used against him in court for prosecution. If he destroys the undoctored video to attempt to evade prosecution - it's effectively an adminssion of guilt to whatever the DA wants to charge him with for the speed (destruction of evidence means the court can presume the evidence would have showed the crime). And, the cops+DA can still work back from the frame-rate of the recording and real-world measurements of the lane parkings int eh video to determine his speeds throughout the whole public video. He might as well have not blurred out the speedo so that we could all see how much of an A-hole he is on the road...
      And yes, I used to ride, and sometimes a bit fast - but this is asking for it.

      @@Real_Tim_S Like I said, everyone has their opinions on who was right and who was wrong. But that cop should have never put the motorcyclists life in danger. The collison happened at high speeds. No matter the situation, you do not move the motorcyclist after a crash. If it was a spinal or head injury, one wrong move and that man could be paralyzed. The cop should always be prepared for the worse case scenario. Checking the motorcyclists condition after a crash should be prioritized above moving the guy to arrest him.

    • @Real_Tim_S
      @Real_Tim_S 2 ปีที่แล้ว +11

      @@MikoTishh Cops put people comitting crimes in danger all the time, just like those people comitting crimes put everyone else's lives in danger. Pick your winner. Rider elected to operate at those high speeds in violation of the posted 55MPH limit on that stretch. That is not the cop's fault. You play the hand you're dealt, when you want to stop someone who's mind is visibly focused on getting around you on a more nimble vehicle, your options are limited. What would you prefer him to do? Shoot at him in traffic?
      Yes, I know in general you don't move a rider after a crash. I used to be one, and have been in a wreck. But, objectively, you also don't leave a suspect uncuffed and able to flee while affecting an arrest (even if no charges are ultimately filed - and arrest is a separate legal thing from an arraignment). There is more than one thing going on here - but everyone is focussed on the crash itself. And it's important to note that we are seeing this from a very specific point of view, not what the cop can see.
      This video doesn't provide enough evidence that your complaint about post-wreck movement is required. It appears that the forward camera becomes detached from the rider in the crash. So any movement after the crash is not necessarily due to the torso movement of the rider. The rear camera stays attached to the bike. We NEVER see the cop move the rider, or if the rider gets up on his own accord (he says he was uninjured in the post-roll, leaves me thinking he was self abulatory). If the cop is approaching a dismounted rider from the crash walking around on his own after observed speeding and trying to get past the squad car after the lights turn on - I would absolutely put him in cuffs. Especially if he was one of a group of riders. It's reasonable.

If you or I were to brake check someone anywhere, at any time, and it ends up resulting in a crash or injury, we would be locked up or cited immediately. That officer almost killed that biker for no reason. I'm not sure if his riding was any faster than what was shown in this clip, but it doesn't matter. Purposefully stopping a 4,000lb car in the path of a biker going 80mph is attempted murder in my eyes. I notice the cop arrested the biker to deflect the situation onto the rider and not himself. He should lose his career and license for that psychotic move.

    • @Real_Tim_S
      @Real_Tim_S 2 ปีที่แล้ว +13

      And you would have lost. When you compare "every other driver" to "cops" - you're going to be dissapointed. "Every other driver" does not have the authority to enforce traffic laws. Unmarked cars on freewways are typically used to nail road raging drivers, or motorcycle hooligans. Objectively, it looks like the cop was out there doing his job, up to and including using his vehicle to stop a motorcyclist who even comments that the cop was cutting off his escape paths. Yes, that's exaclty how an agressive chase-ender works. Had that cop let him slip by, he would very likely not been caught, unless he wrecked out (see danger to the public in below segment).
      Remember that to stop a fleeing felon, use of deadly force is authorized to prevent danger to the public (this is both by Florida state law and SCOTUS case law, see Tennessee vs. Garner). Fleeing a traffic stop is a felony in Florida. Speeding 50+ over the posted limit is also a felony in FL. Speeding 30+ over the posted limit is still an arrestable crime. Posted speed was 55MPH. So he was probably going to be arrested anyway, unless the cop was in a giving mood - which he would not have been after the rider slammed into hs car.
      Anyway - I can't feel bad for the rider, because after the first brake check when he says "maybe that is a cop" - what did he do? ACCELERATE from 78 to 81. Hardly a person who was thinking about consequences. That is, until that rear bumper was coming at him, really fast.
      You express a doubt about faster speeds. In another comment here, I calculated it out using lane markings and frame rate to over 105MPH, which would be felony speeding. Also he was within 65-feet of that charger right before the crash at 81MPH - I think the cop's description was apt, he was "tailgating the hell out of" him at speed.

The biker clearly doesn't respect the law or anyone else when he's driving recklessly. He should've not only been given a ticket, but had his license suspended. After taking a driver test Americans aren’t actually taught well. Nobody follows the “every ten miles you’re going stay one car length back”. Nobody knows road signs or the lines on the road. A lot of people, hate me or not cuz I am a woman, but mostly women don’t know anything about their cars. Im not saying you need to know the car in and out in all crevices but you gotta at least have knowledge about the dash buttons and the engine ect. When I took my written test so many people failed it when it’s common knowledge. Same thing with the drivers test, and for my drivers test all I had to do was check if my blinkers, hazards, and windshield wipers work and drove around the sheriffs office block. It took less than 13 minutes to do and I never implemented any real parking besides in the sheriffs EMPTY PARKING LOT. Never got on the interstate or HIGHWAY. Never did any serious road turns like a roundabout.
      Some Americans are really good drivers, I just fortunately learned how to drive by paying attention to surrounding my whole life. But I wouldn’t be setting standards if I were you. There’s many UK videos going around about their own terrible driving

    • @natd602

      Oh absolutely no hate. US drivers are horrible and I’m so scared of driving on the highway. There are near accidents around me every day, and I mean like super close to me and/or usually involving me. People have zero defensive driving skills nor a care at all for anyone else on the road yet they’ll cuss and complain about getting into an accident. I was in an accident and it got pinned on me when I’m pretty sure it was insurance fraud. They were trying to take advantage of the fact that I was 18 and a “new” driver. Based on the laws I can see how someone would think it’s my fault but it’s one of those situations where someone made it an accident when it otherwise wouldn’t have been. Like having clearance to turn but someone oncoming switches into the lane you’re turning in or speeds up. That is their fault but they lie and legally it’s on you because most cops don’t give one crap about listening and delegating fault accurately. That’s why I’m investing in dashcams because it’s the only thing that saves you. Not getting another accident pinned on me. I already should’ve gotten seriously injured in that one and miraculously didn’t.

I don't think that was a legal traffic stop, and the officer should be liable for all damages. Sue the officer, the police department, and the state for reckless endangerment to public safety, brake checking, unsafe lane change, failure to signal lane change, using motor vehicle as a weapon causing bodily injury to biker. Then, claim for PTSD, that every time you ride around COPs, you're afraid they're out there to kill you or run you off the road. There is no way the biker should be at fault for this accident/ incident. I bet that pig probably lied in his reports, so I'm hoping someone witnessed what happened. Most importantly, the biker was wearing a helmet/ body cam and caught the footage, and based on the footage I believe the Insurance claim should be a breeze. If uncertain with the proceedings, get a good personal injury lawyer. They will know how to milk the system getting you the compensation you deserve.

      Everyone I see commenting on that clip always assumes the biker did nothing wrong, and the cop has no right or responsibility to do his job.
      For the biker to not be at fault, he would have to not be doing anything wrong. He was doing 81MPH in a 55MPH zone right before he slammed into what he thought was a cop. What you call a brake check, is in fact slowing down to force a following driver to slow down - a normal part of a police pursuit. In this case, the camera's wide angle makes it look like they are much further away from the Charger than they are in reality.
      According to the MUTCD (federal traffic design manual. plublically available, includes signs and paint marking standards), those dashed lane markings are 4-inches wide and 10 feet long with a 30 foot gap between them. At 25:08 right before the cop turns his lights on, I see two white lines (10 + 10 = 20 feet), plus what I'm going to generously call 1.5 gaps (30 + 15 = 45 feet). That's 65 feet total from the back of the Charger to the front of the bike. And the speed at the frame of video is 75MPH. Think about that for a second - that's about the length of a bendy bus between the Charger and the bike at freeway speeds. And he put himself there, since he's the sole operator of the bike.
      We can use this information to extrapolate further. Where a lane marking goes past his handle bar is a fixed point in space. We can count how many frames of video he took to go from one lane line to the next. At the very opening of the video, when his speedo is blurred out, I roughly counted 15-16 frames from one dash to the next (you can do this too, by hitting the space bar to pause, and then the "" keys on your keyboard to frame back forwards respectively). I then looked at how many frames I had to increment to get the time counter to click over one full second. This is a 60-frame/second video (it looks like the original before being added to this compilation was 30fps as we have repeated frames due to frame rate conversion, but that's a minor detail). Now we can take those counted frames and do so simple math. 15/60 = 0.25 seconds from one line to the next, which is 40 feet total. 15 frames is one quarter of a second, so we can extrapolate out that in a second he would travel 4 x 40feet = 160feet. There are 3600 seconds in a hour, so over an hour at 160feet per second we get 576,000 feet per hour. There are 5280 feet in a mile, so 576,000 / 5280 = 109MPH (estimated)... The felony threshold in florida is 50+ over posted, which again was 55MPH (so 105MPH to comit a felony). BTW, I checked this method with the moments before impact, and calculated 75MPH based on lane markings when his speedo read 78MPH. That's an error of only 3MPH, or about +/-4%. This meant my estimate of 109MPH at around -4% would be about 105MPH...
      So not only is he criminally speeding like hell, he's tailgating the hell out of what he believes is a cop. I'm not sure how anyone defends this guy, except if they only consider the moment of impact in complete isolation of why the cop might have been inspired to turn on his lights and get in front of a fleeing felon...
      @Cherry Punch, to top it off you are publicaly advocating for comitting fraud based on feelings. Not a good look. As a tax payer (in a different state granted), I'd prefer that he not sue the state for comiting a crime and negligently operating his vehicle. I also hope he doesn't have the same insurance company I do because his driving might make everyone's rates go up. Think about what you're advocating for... publicaly.

      @@Real_Tim_S I think people understand that the bike was speeding the problem is that the cop brake checked him after practically cutting him off there(given what you say about distance). He wasn't really revving it ((went from like 80 to 70 right before the cop turned lights on started braking)) much when the cop got in front of him. To which the cop then braked hard. To me it looked like the cop purposefully caused the crash. Like wtf dude you are just like the people saying the biker did nothing wrong except on the exact opposite side.

      @@thepsychocat7911 Well you don't seem to be giving the perspective of the cop any thought.
      Imagine you're working TRAFFIC ENFORCEMENT, and your radar goes off in a 55MPH zone while you're in the far left lane with someone coming up your rear end at 105MPH (what they rider was doing at the beginnign of the clip). This is felony speeding in Florida. Not cite and relese, this is your bike is going to impound and you're going to jail. A whole 45 seconds (yes, spoiler, I've seen the original video that wasn't sped up) before the crash. You can't just look at the 10 seconds before the crash and presume the cop has no knowledge of the rider's behaviour!
      Reaonably at that point, I'd move my vehicle over a lane or two to give the rider the benefit of the doubt, that they will see traffic congestion and slow down - but this is a test of intent. The biker immediately changes lanes in behind the Charger to pass other slower-than-criminal-speed traffic. The Charger then makes a right lane change and the biker follows at speed. The officer can now make an informed call on the intent of the rider. The rider wants to go faster than the posted speed limit even if traffic is heavy - the officer continues (while the video is sped up) and the rider continues to pace the officer. He is collecting evidence of the rider's speed and continued intent.
      But the rider starts to crowd the officer at an unsafe distance, and begins getting loose with the lane he's in - making his own actions unpredicable. The cop would perceive this behaviour as "dangerous to the public," especially since there's nothing ahead of them but stopped traffic, and be motivated to take direct and immediate action to put a stop to it.
      At this point, about 25:00, the officer does the first brake check while the rider is in the lane directly behind him, then attempts to put some distance between him and the rider. I read this as a cue that the rider is too close, and again this is from my own experience with riding. From the first brake check to the crash - it's 9-10 seconds. You try to excuse the rider's acceleration as "he wasn't really revving it" - sure granted, he didn't put the hammer down. But he also undeniably, from the speed indicated on his own video and speedometer, did absolutely nothing to put space between him and the squad car, even as he was commenting on the realization that it probably was a cop. He accelerated and closed that distance again, that the cop had already tried to put between them. At that point, if you're the cop and you've paced him, know the intent of the rider to continue to speed, gave the rider a brake tap to encorage so some space, then that rider used up that space again and appeared to be moving to go around you... Yeah - I'd move to block to stop the escape that appears to be what the rider's doing. And the rider even mentioned he had a desire to get around what was now a fully lit squad car (we call it an "escape route", and so does the rider in the video text, but note that slowing wasn't his first choice) - that's fleeing and eluding by definition, another felony. What do you expect a cop to do when someone has the audacity to commit multiple felonies in their presence? Wave and smile as they whiz by? They, unlike the rest of use drivers, have the authority to enforce traffic laws!! You think when he turned on his lights he wasn't in the process of an enforcement action? You think he wants to let a rider who is intent on speed and appears to be staging for a run actually make good on that escape and put the public in even more danger? NOPE, stab that brake pedal - Mr Dumb A$$ on the bike will eat the back of the Dodge, and he won't have a method of escape anymore as his front fork crushes into the engine. Makes perfect objective rational sense to prevent a car-versus-motorcycle chase.
      As a former rider I lament the destroyed bike, but at the same time I'm also not shedding tears for this guy's rediculous behavior. Nor his crocodile tears trying to get people to enable his denial. Even the rider's commentary "oh the cop was making it look like he was pulling to the side" reeks of someone who doesn't think to consider even for a moment that the lights are on for HIM.
      Someone that slow in the head, shouldn't go that fast on a bike.

      @@Real_Tim_S I dont give a shit how terrible the biker is dude. You seem to forgetting that the cop did something that could've easily killed him. Speeding and tailgating =/= death my guy. Cant believe you are advocating for this with bullshit arguements. I defend cops to a point but that's too much. Also you are lying if you dont think people are going to accelerate out of a bit of anger for getting brake checked I've seen plenty of these kind of brake check videos its like 90% of them. Everyone does it not saying its the smartest thing to do however. The main problem here is the dumbass cop should've lit him up far far earlier instead of I assume(like how you just love to assume shit) getting mad himself and then extremely escalating the situation. Like the biker was actively running from the cops. Instead of just being a speeder/tailgater

    The SUV drives better empty than with the driver behind the wheel. Its three trees in a row!
    That's a golden strike!
