Hi Ms. Naomi. Since we last chatted I have settled with my insurance company. They settled on 80% PD, both knees, both hips, lumbar, thoracic and cervical spine. Due to the fact that I have an attorney he is now working on getting me SIBTF benefits. Just for other injured workers information who might read this post, I got a lump sum for back pay and because I settled at over 70% I will receive benefits for 5 years until the monies owed are paid out and then I will receive about $500 a month as a life pension. You'll never know how grateful I am for your posts which helped me learn of the whole process. Oh btw it took 8 years for the work comp process to come to settlement. God bless you. I forgot to mention (life time medical.) Sorry.

Need to discuss what's a subrogation? I guess if you use health insurance, they will make you sign reimbursement agreement that if you win your case, i guess health insurance wants paid back. Explain how health insurance works with denied workers comp claims.
Subrogation is basically when one party stands in the shoes of another and gets reimbursed. The most common situation where it comes into play is third party responsible for injury. Like if you drive for work and are rearended by a driver. You have workers comp but even if you do not pursue action against the driver, the work comp insurance can pursue action against the driver and recoup some of the money they spent on benefits to you since it was their fault you were injured. If your claim is denied, the insurance company loses the ability to control your treatment while your claim is denied. So you are able to treat with your private doctor. If your private health insurance doctors put a lien on the case to be reimbursed, that would just be one of the liens in your case. The defense has to settle out liens after the case settles. Hello. Injured knee 5/21/22. Patella looks out of place and I think Acl. I was put on 39 month rehire list after 52 weeks of TD. No accommodations at surprise short zoom meeting that my superviser only attended for 5 min while on vacation. H R kept telling me no more pay after 52 weeks. my union agreed when i told them. Union says they can't help now. No dual representation since I hired a attorney she said. Nobody would respond to emails/calls. Is that right? Insurance is now sending me 2/3 pay . I was denied my July 1st new fiscal year Pto/sick days. CalPers account says inactive. Is that Right?

Hi, my son filed for work compensation in Massachusetts on May 2023. At first his employer's insurance approved the reconstruction knee surgery. They fired him after that injury and soon after they changed their decision. Next Oct 5th is a court date, my sons attorney sent email the to schedule with the insurance doctor a doctor's evaluation. We know what to expect but will it affect my work compensation claim if I hire another attorney. The communication is bad and my son hasn't recieved any work compensation after his work related injury?
Hi Nellie, I only do California WC, so I can't tell you for sure. If it were in CA, you might have a slight delay in the new attorney getting up to speed, but not enough to keep you from changing attorneys. Settlement can happen without an attorney, but not necessarily with our without one. It has to do with your injury. Your TTD does not reflect any raises. Only the time period date of injury to one year prior. If you are not working, probably not get the raise. If you are, check with an employment attorney and your attorney if there is any action you can take for your circumstances based on being overlooked for a raise. @@GonzalezLawEmpower hey thanks Gonzalez. I got a letter saying if I don’t receive C&r in 30 days let my attorney know. In the letter it tells me I got a year to use the retraining voucher but it doesn’t state when I should expect the voucher or time frame. I just want to uses it bc a year is not a long time it will fly by and class’s only start in semester. Just want to get the most out of the situation and not get screwed. Work comp is worse then government programs.

Derrick, If your employer CRCD, you did not settle. Looks like settlement negotiations may have broken down because you are set for a mandatory settlement conference. If you case had settled, you would have had an order approving compromise and release under view events. Did you actually get that charged or was it only in their opening paperwork? Even if something different there, a judge still has to approve. When it comes time to settle, make sure only 15%.
