    Thank you for making this amazing video. If an arrest was made for a class-b misdemeanor and the case resulted in no conviction, should one self-incriminate saying that they committed a crime? This is Question 26 on the form I485

      Hello,
      This is the kind of specific question that requires a careful analysis of the facts and circumstances of one’s case. We recommend you contact us for a consultation so that we can review the documentation in your criminal matter and provide a thorough analysis. You can schedule with us directly at jlw.as.me/schedule.

      Hello,
      Without specific research, it is difficult for us to say whether a conviction for breaching the peace would interfere with your visa waiver eligibility. In the USA, this kind of case is typically called “Disturbing the Peace” and it is usually a class C misdemeanor, meaning it is not treated as a serious criminal issue that would make someone ineligible for any immigration benefit - so long as the applicant can provide all relevant police reports and court documents. We would recommend gathering all of the documentation related to your arrest and conviction, and trying to apply for the visa waiver. If that does not work, you should still be able to qualify for a visa, though it will require an interview. If you are able to share with the consular officer that the interview is extra challenging for you because of your diagnosis, then they will have a little context and hopefully empathy for you as you go through that process. At risk of TMI, I will share with you that one of my daughters is autistic and also has Tourette syndrome; she had a tic and made an obscene gesture at the consular officer interviewing her for a replacement passport in San Jose, Costa Rica last year. Thankfully, the officer just brushed it off immediately once we explained the health situation.

      Hi, Chris,
      Thank you for reaching out. This is such an important question. In our experience, people who are renewing green cards who have misdemeanors are typically able to renew without problems. However, we do recommend consulting with a trusted attorney or accredited representative from a non-profit immigration services provider before you file for your renewal. In addition, we would recommend review of your case to determine if you can qualify for U.S. citizenship. That way, if in the future you have struggles with mental health or any other kind of encounter with the police or criminal justice system, you’ll be protected from deportation. If we can be of further assistance to you, please reach out to us at jlw.law.

    Do you offer free case evaluation?

    • @jenniferwalkergates5745
      @jenniferwalkergates5745 2 ปีที่แล้ว +1

      Hello,
      At this time, we are not able to offer free case evaluation because proper assessment of a case, especially a complex case involving criminal issues, typically requires a substantial amount of attorney time. Non-attorneys in Texas are not allowed to provide legal advice, so we do charge for our case assessments so that we can dedicate the required time for providing a thorough and legally sound evaluation. We do hope to begin offering free case screenings in the near future, but this will simply screen for clear eligibility for certain benefits and will not involve provision of legal advice.
