If she’s not capable of or doesn’t want to raising the baby, why not just it up for adoption? It’s would be better than being raised by someone like her. Even if the adoptive parents divorce, it would still be better for them.
Illegitimate children need to establish legal parentage prior to death in order to have any claim to an inheritance. Though it does vary some by US state, a paternity test after death is not generally enough to establish parentage because, from a legal standpoint, there is a difference between biological parentage and legal parentage. For legal parentage, there generally needs to be an actual established parental relationship or at the very least an acknowledgement of parentage before one can make a claim for inheritance, despite what movies and television shows often depict. An adopted child would have legal claim of inheritance, for example, but if the husband did not know a child borne out of wedlock existed before he died, then in most places, that child would have no legal right of inheritance because legal parentage was never established.
