There is nothing to stop Lee Hsien Yang from demolishing the house now that Dr. Lee has passed away unless there are changes to the law. It is the younger of the Lee brothers that has brought disrepute to this matter all these years with his baseless accusations.
The last will and testament is a declaration of intentions of one’s assets after death. The executor of this will have been warned to remove the demolition clause. The demolition clause in the will has nullified the possession of 38 Oxley Road. Rule of law: When the property is demolished , the land returned to the state and the landowner has to pay for redevelopment.
from this report, it seems that LKY was denied the opportunity to make his Final Will and Testament as he preferred and was tricked into leaving the matter of his 38 Oxley Road residence, ambiguous, upon his death. But is it the truth and is that the only truth a) If he was ambiguous about the specific matter, then the executors decide - says the law. But if it was ambiguous only in writing, but clear in spoken format, then what is clear supercedes as long as it is also consistent with his personality. b) but even if clear, the executors can choose to accept the command from the grave but can also choose to refuse to do it, but must, in good faith ie tell the court what they choose and why. So it has legal principle backing. And as individuals, they can preserve their point of view. But since the court must uphold the Deceased's wishes, it can then allow a court appointed administrator to preserve the Deceased's request ie do not break unique identity of the living nor the deceased. c) must the court abide by the Deceased's wishes on all matters, or only some. Ie do the Court, also have a final say in anyone's Will or is it over-reach in the interst of greater good that typically only means politics is not far behind. The idea that a person's Testament supersedes the person's written Will is not easy, because ink is heavier, and people say things they do not mean often or change their minds. But if it's clear, then there is nothing to debate - its clear, written or spoken, its clear. If we let the court decide, then it is very bad news from the the point of view of legal freedoms in Singapore. So the Lee boys must decide for themselves. Let's keep away from the gargantuan issue of rights of the deceased and focus on rights of the living. If there is clarity of intentions, then just ask those who know LKY best, (his own kids, grandkids, friends, buddies) and whom he trusted the most, to answer some basic questions: - was LKY a person - what did LKY say he wanted to happen with his 38 Oxley house after his death, - was it his decision to make - was he ever directly or indirectly told to not bother to make this decision coz it is not his decision to make - One quick test on authority of the 'hearsay' is: does it align with his personality at the time of his death ie he could have changed once he left public office - then ask: Do the Executors need to follow the Deceased's instructions or do they need to protect themselves from his instructions? Principle The Deceased retains unique identity as if alive. Each person alive also has unique identity. Each person evolves and their personalities may change, unique identities. Generally, the living has greater voice than the dead. That means that the Executors can choose to follow thru with the Deceased's instructions or to reject it. But they do not get to Ignore it. That is the basic rules of court. So they only need to make clear if they are Choosing not to follow through or if they do not know what the Deceased wanted and its as good as a coin toss. The Court can also question all grandsons and grand daughters, friends and buddies, and his closest confidantes if they know. And can corrobate with either side. But to do this, they must be granted protection from both sides. Can the court truly protect citizens or does the court itself want a say in the matter. And finally, the case must be tested to see if the SHC wants a say in the matter and wants the house to stand which is coincidentally what LHL wants too. And then finally, test if LHL is influenced by the Court, or did the Court influence his stand. So no, I would not bother to take this matter to court, because it is nearly impossible to penalise the Court even if they influenced LHL. So my view is that let LHY decide since he is not under the influence of the SHC nor any political group, even if he was not an executor he was close to his dad and probably knows what his dad wanted. And LHY could effectively close judiciary over-reach. And that is far far more important than anyone has mentioned so far. It also breaks the ties between Govt and SHC and could one day result in a higher quality SHC and Parliament. One day....when I do not know but breaking the link of Court to Parliament and Parliament to COurt, is pretty important. We dont want the Government nor SHC acting like a snake entering the Final Will and Testament of private individuals. And we definaitely do not want them ganging up on the people.

It's a private family affair. Let it be categorised as such. If the government wishes to acquire it for whatever reason - as it has done for many private property such as for road or MRT construction, housing project, monumental preservation or military bases - it can do so with a simple stroke of the pen, just pass a law. He didn't want his house to be preserved to honour him after his death. Get your facts right before you vent your frustrations here.
@@anjalikastarr2824 Oh, so what is the issue now??? Use your pea brain to think and reply. Stop embarrassing yourself. Go and do your homework! You are too overly sensitive to think that I am frustrated. Sorry, I am NOT! Hahahahahaha.. So you mean the power of a will >>> Land acquisition act? Your level of understanding is beyond my ability to comprehend. LOL
@@westwoodly Is he your father, someone related to you? Poor you for such a busy body and getting all rile up over a complete stranger. Go and do something more meaningful in your life! And no, won't be watching ANY videos of him. Guess you have not heard of the term "diplomatic". You measure the quality of a person by the VIPs who attended funerals??? LOL.. My toes are laughing!
This is their family matters. Why Mr LHY was in opposition not PAP? Mr LKY must be very sad to see this if he is still with us.

😮 With great respect to All Sides ... Founding Prime Minister of Singapore , Lee Kuan Yew & wife should had the 38 , Oxley Road family house be mandated to be upgraded & preserved as a reminder of Singapore early struggles as a Nation State , thus avoided all these ugly family disagreements that divided siblings & family members ... A lesson for all of us to prepared & settled our possessions to the next generations happily when we are still alive so that , after our respective departures , hopefully there will be less issues ... 🙏🕯🌏✌💜🕊
You are NOT OBEDIENT to your Parent's dying wish 👎👎👎
LKy did say to demolish the house!!
It’s just an estate. Gosh.
Oh dear. This case never gets solved.
Jesus, be coming before the 38 Oxley road Solution comes in.
Even my two sons very concerned about this case after they born in 2014 and 2016 hmm 😂
🙏🙏😤
38 Oxley House!
成也Oxley?
败也Oxley ?
Till lky resurrection fr grave only solved ?
🤣🤪
The house will not be demolished. The founder's memorial will still be built. Please move on.
Why?
Bcz LKY’s purported WILL has unresolved “issues” that likely to implicate Own Family members… Hence , never Challenged in Court but instead Whitewashed amongst Subordinates in Parliament… 😊

There is no why. This is simply reality. Local Singaporeans will not change their vote just because of this matter. GST vouchers are far more important than LKY's will, though of course no Singaporean will ever admit it.
Like I said, please move on.
38 Oxley Road SHOULD be preserved as Singapore’s heritage and of great significance in the founding of Singapore especially where the first meetings of the PAP and LKY took place. There’s a great possibility that the younger brother with the sister influenced-misled LKY when he was in a weakened feeble condition, unclear thinking to put his signature possibly without comprehending /seeing what he was signing.
Strike when he is most vulnerable. What about other founding leaders like Goh Keng Swee, S Rajaratam, Yusof Ishak etc? Why they do not face such a problem?
Very probable knowing that Hsien Yang is sneaky and a liar.
