      Dana Shaw I feel you I made the same promise and when I was disrespected by a supervisor I basically told him if you talk to me like that again where gonna have a problem,meaning I was going to beat his ass. he didn't say anything. weeks later I just had enough of their b.s. and just quit. I don't need to work at a job where management acts shady and rude towards me.. unemployment for now is my next move..

      I just try and put it out there that. If I lose my job because I countered the bullying. Then I won't have any thing to lose. Plus I'm not mentally and emotionally stable so I don't know what kinda dark place I might.. 😉😁😠😡🤬😈☠

    Those coworkers that actually witnessed the event usually turn the backs against you. That’s what I found. Radio silence from all of them now.

      lol I know what you are feeling, I am like a leper now. Even when I document this on Team meeting to another co-worker, they don't even acknowledge it but I got it documented on company property so if I get a lawyer to subpoena them about the harassment, I some evidence to help out my lawyer.

    Why does protective class or category have to be a part of the equation? Why the law can't be enforced by ALL people for a safe work environment? I don't get it!

      Even if you're a protected class, unless they say or write something that refers to that protected class, they can harass and bully all they want.

    I quit due to continuous "depositions" with HR and my boss. Boss always fishing for issues with me from coworkers and embellishing, taking out of context, lawyer and gaining power. I then asked to rescind my resignation as there is a new manager coming and I was assured by coworker/friends she is very good. My request to cancel my resignation was denied. I put in a 2 week notice and asked to cancel it in less than 24 hours but it was denied. I always got good annual review, excellent peer review , good attendance, superior work knowledge and performance. I feel the harassment was too much to bear and if I got fired it would ruin my career so I quit with notice in writing.

    I've been harassed since January 20th and complained through email/in person multiple times to supervisors and HR. I've been intimidated, lied to and he even said I hit him yesterday. No lawyer wants to take my case

    Dirty Disgusting unprofessional conduct of most of those companies. Where there is disunity in the work place, good employees are leaving while the negligent one's remain but need to be placed under investigation,
    they will get put out of business.

    Voting time came up AND I had an assistant manager demanding to know if I was voting Republican or Democrat! I told him it wasn't his business and I didn't want to discuss politics on the job. I made several other excuses to avoid the issue BUT he kept persisting with harsher language every time. I was harrassed and tormented about the subject by him and I was extremely uncomfortable. Finally I engaged some opinions on politics and he wasn't happy with my views... He fired me not long after that....Yes he had good reason to fire me because I showed up late but after months of being tormented by him I hated showing up to work at all...FYI. This was years ago when I was a kid so I didn't know I had any rights or anything BUT I was really scared back then about political party "Gangs" of people in high power positions like management positions... A brutal conspiracy theory to have as a kid entering the work force BUT it's not far from truth in reality. Fyi
    Never discuss politics at work if you want to keep your job...

    Great video. It just shows how lax labor laws are for employees in the US. Fortunately, some states are better than others, but the huge majority of laws are meant to protect companies not employees. This isn't the case in many other companies that are more employee friendly, but the US is nearly always business-first, not people-first. Never assume anything you say or do at work is not being watched and recorded. It's easy for companies to monitor what you do and say. Deleting emails or files on your computer does not mean they are gone.

    I have a new boss and ever since she’s been there has made my life a living hell. I have had above expectations performance reviews now all of a sudden she finds fault with everything I do. When I disclosed that I applied for another position within 1 week she placed me on a performance improvement plan over frivolous items. I can prove that I performed my job reasonably, followed the process and policy and the items that she was pointing out were subjective personal preferences as opposed to actual objective processes policy and procedure. How can this not be considered harassment? I receive constant emails where everything I do is in question it takes time away from my productivity it creates tension and anxiety, poor employee relations. This has gone on for 8 months. I haven’t been fired but it is making my work environment unbearable. I feel like based on this I don’t have a case because it doesn’t involve any of the protected class subject items.

      Hi Candy C, thanks for the comment. I would be incredibly frustrated if I were you. That sounds exhausting. Yes, you're pointing out one of the most difficult things I have to discuss with potential clients. Not all "harassment" is unlawful. It sounds like you are being micromanaged to death by a terrible boss. But it doesn't sound like she is doing it unlawfully (as unlawful harassment in CA is based on a protected characteristic or activity). When I talk to potential clients with situations like this I often tell them that there is a significant difference between what is unfair and what is unlawful. What you are experiencing sounds unfair, but it does not sound illegal. My recommendation to folks in your position is to start looking for a new job and/or apply for an internal transfer (if available).

    I have lead shift supervisor, but he's not the manger, he's been treating me unfair compare to other co-workers, I ask him why am I getting treated different or unfairly, he said bc I just don't like you...do I have a case? I also feel uncomfortable to go come to work too now

    Almost impossible to fight at the Post Office. They have a tremendous amount of lawyers and they rarely lose. Have a co worker who is offensive consistently. Documented evidence and statements to higher lever management yet nothing gets done. He's been on the floor yelling at females and still nothing. It's like He can't be touched. Eventually it's going to lead to a bad ending

    What does it mean when an administrator gives you a project to do, but then turns around and tells everyone whom you need to get the information from to NOT give it to you? The administrator has done this to me several times. I get told by co-workers that "they're not allowed to help me or provide any information to me", but yet their information is a crucial part of getting my report turned in to the administrator.
    Isn't that harrassment?

    I live in CA. This past month I had to take a family leave permit to take care of my sick mother, that month I lose lots of weight due to stress.(I am full figure not obese). When I came back to work my coworker (we are not friends) told me that "I look done and over". I told her I feel that way inside because was a hard time. She continue telling me that several times during the day, later she told me I looked very wrinkle, and after that she told me I lose that big cheeks of mine. I was extremely uncomfortable with her comments and report this to my Supervisor. The coworker has been using uncomfortable comments of my physical appearance since before I leave to take care of my mother. She is slim and love to make comments about weight. I would like to know if she harassing me?

    Hi, I'm a federal employee with a DoN Agency whose EEOC attorney is in the process of requesting a Summary Judgement. At the Mandatory Initial Conference, 02/17/2022, the agency attorney stated he would submit a motion for summary judgement at the end of the month. Today I received an e-mail from my supervisor asking me if I would be willing to accept a 3 to 6 month assignment in Norfolk, VA. To you think that has anything to do with the MSJ the employer attorney is about to submit? I know you need more background details so I'll try to make this as short as possible.
    I have essentially been retired in place (RIP) after I filed my complaint with the agency EEO, 3/16/2022. My basis(es) for discrimination are as follows: Age, Race, Retaliation/Reprisal, Assignment of Duties, Harassment - Non-sexual (Hostile Work Environment), Reassignment Directed. I am a 61 year old, African American Male, who has filed and received a favorable settlement after an ADR, in 2012 and EEO complaint filed in 2019, that was dismissed via MSJ by an EEOC Administrative Judge 09/28/2021.
    That being said, do you think the employers attorney is trying to create a pre-text of refusal to accept work as part of his MSJ, even though it is a relocation from New Orleans to Norfolk, VA, and the fact that the position (Contract Officer Representative-COR) should be able to be performed remotely? As you can surmise this is a pattern of discriminatory behavior, documented for well over ten years at this agency and within the DoN. My responds to him was to ask for "time to think about it" because they are aware that I'm retiring at the end of the calendar year and have already submitted my retirement request. I would prefer to discuss this further with you or an attorney you might recommend offline if possible. Thank you!!!

    I am in GA. I was attacked at work on 01/14/2020 by another employee. They kept the employee. I had to quit for my safety. They are refusing to cover my medical bills. I sustained a concussion. I do not know what to do. I cannot afford a lawyer. I am horrified and humilliated. Any advice?

    Uber now retaliate against drivers by creeping to your history and force you by intentionally only find rides outside your area then only find rides more further away. You have no choice to shut it down and drive back work for half the money.
    If you don't take 5 of 10 they won't tell you where the next rides go.
    Before I make 25-35 pick ups a day now I can do 15-20 at maximum. I make 50% less. In a high surge area they find rides 10-20 minutes away that go to areas where you don't drive.

      Same here I'm very disappointed in the EEOC for dismissing my case and sending my the right to sue letter. I have direct evidence from my Termination meeting because I recorded it and it's clear that I was wrongfully terminated for reporting sexual-harassment. My employer's Position statement had several INCONSISTENCIES that contradict their story and there are things in their position statement that can be proven as lies that my recording can easily prove. My Investigation was not handled properly and was transferred to another state and once I was assigned to an investigator she contacted me one time sending me one email introducing herself and saying it would be dismissed. She won't return any of my requests for my eeoc file and her findings are incorrect.
      My employment issues are
      1. Paid less than other employees. I was assigned to do a physically challenging job assignment that mostly men were assigned because it was hard work. I have 5 years of experience and they advertise the job to be $9.50-$13.00 based on experience and as a woman was getting paid $9.15 less than other employees with no experience
      2. EMPLOYER was NEGLIGENT and told me to use Corrosive chemicals and didn't warn me, train me or provide an recommended PPE of a respirator or anything. I was exposed to corrosive chemicals and could have died, there was no SDS sheet and I was all by myself in a building under construction and didn't have functional ventilation. I suffered nerve damage in my hand, my lungs were damaged, I got really bad anxiety and heart palpitations and ended up in the ER. While in the ER they decided to deactivate my badge for that location and cut my hours. Then my boss demanded that I left that hospital to go give her the keys for the building. I wasn't allowed more than two days off and I wasn't allowed to file for workers compensation. during the two days I was off they couldn't find anyone to cover for me so one of my supervisors text me and threatened my but I physically couldn't work and they didn't understand that or have any consideration. After only two days offI return to work and wasn't allowed to file for workers compensation and my hours were cut as punishment for their mistake. I suffered lung damage reactivate airway disease and have relied on an inhaler as needed and for daily use.
      3. I was sexually harrassed at another building my husband and I worked as contracted Employees. The man kept asking me for sexual favors and I kept telling him no after a while he got really angry because I kept telling him no and created a hostile work environment constantly complaining about non-existent things as punishment. I told my supervisor and I was scared to come forward and tell the office about what had happened in fear of being retaliated against. I decided they needed to know because I had already experienced what it was like to be punished for something that wasn't my fault and didn't want it to happen again. I told the administration director and the director of operations about the sexual harrassment and they didn't do anyting. I was physically and mentally drained from the abusive hostile work environment so I wrote an annnomous note to his HR about his misconduct. 2 days later he falsely accused my husband of stealing a laptop and we were not allowed back to work. We contacted our supervisors and they wouldn't answer any of our text messages or calls. they claim that we didn't contact them and we were no call no shows after we were told we weren't allowed to workbut this was not a no-call no-show because we weren't scheduled for any shifts or had any hours. this was around Christmas time and finally when I got ahold of one of my supervisors she claimed she was going to be out of the office due to the holidays and would be back and schedule a meeting with us when she was back in the office. she deceived us into thinking that this was a preliminary meeting to discuss the sexual harassment. My employer was aware of the sexual harassment and I had sent them audio proof of it so it would be investigated and they refused to INVESTIGATE it or move us to another location in the termination meeting I recorded they said that "they have to honor customer requests and we wouldn't be considered for any other positions". They didn't want to investigate it and in the termination meeting you they are saying that "they didn't want to be in the middle of a sexual-harassment claim" they lied to the Eeoc and go as far as repeating my harassers lies as their own testimony that they said that they saw proof of the theft. they claim they saw us being involved in the theft of a laptop from one of the offices in the building.we never ever had any access to any of the offices in the building and this is an absolute lie and in the recording the administration director says 'I don't know if you did it I haven't seen the proof but the customers told us about so we really don't want to be in the middle of a sexual harassment claim and just have to honor customer requests." I'm very disappointed in the EEOC and how my case was handled because I don't think the investigator looked at any of my evidence she didn't even ask any questionsor want to talk to any of my witnesses it was overright away once I was assigned to an investigator and she will not return any of my emails. She sent one email to introduce yourself and say it was over and I was shocked. I was really confident in my case because of all the evidence I have and all of the many inconsistencies that my employer makes in their position statement. This was not fairmy employer has nothing not one document not one credible true thing that helps them and yet my case was dismissed. I was given the right to sue letter and I've contacted a couple law firms but it's not easy finding a lawyer they are slow to respond and a few of them that have talked to me no my employers lawyer and are intimidated by his reputationand it's frustrating because when it comes to evidence evidence has everything and they have nothing so it's really hard finding anyone who will help me and who will considerconsider taking my case based on merit and evidence rather than a name with no evidence it's just very frustrating. I don't know what more I need to have but it feels like a lot of examples of discrimination I could have direct evidence I could have a really strong case but yet it's so hard and I don't understand why it's unreal

    Good morning to you Attorney it's really kind of you to give your time to advise ordinary employee to understand their job description in legal way how to recognize the incoming predicament
    But I observed it's rare to find a real professional co workers some are so domineering as if they own the company because your just a minimum wage job some really looked down upon Bec they're are questioning your educational background how come you are accepted it's not a good experience
    Even tho you want to quit your job you can't because of the monthly pay check and you are not happy anymore

    The protected are among the worst people who think just because they have connections up there among management staff, that this makes them untouchable and with out accountability. These are the one's who get away with murder. This is going on where l work. There is so much favoritism and corruption that has created unpleasant work environment and poor communication in the work place because of some of the most malicious forms of personal prejudices some of the bad employees carry around where they give other's Hell on a daily basis. This is not a healthy situation at all.

      they can. But you can carry a one with you. When I worked in a hostile workplace I constantly carried Dictaphone with me, to be sure those bastards will not lie when I will complain to boss. Also helps at court.

      (Answering for USA). Absolutely companies can install cameras, can monitor your computer (keystroke capture, etc.), can read your emails and more. Never assume anything you do while in the office or using a company computer is private! And deleting an email or a file on your computer does not mean it is gone - there are always backups.

      ​@@IreneSee I lost my hostile workplace claim, so this particular video could have made a big difference for me. I won failure to accommodate, and had all kinds of evidence for that, from direct to statistical. I also managed to prove discriminatory intent, even though I didn't have to, to win a failure to accommodate claim. I did that mostly by documenting their delays and negligence in responding to my requests for RA. Hope that helps!

    The problem is Corporation are getting tax breaks for employing people and if the people quit they keep the tax brakes, So they employ you and then they harass you to make you quit don't giving you even unemployment. Be aware of those medium size companies that are hiring all the time, or when someone in the company tells You that for your position has passed a ton of people.
    It will be wood that someone that has the skill to make a website to put all of those perpetrators on the public spotlight.

    Is it Severe if I ( black lesbian female ) was targeted by a male co worker he literally tried to fight me I have witnesses that were just standing there and one that had to help me... Management is calling it a miscommunication but now I'm scared because what happens the next time he has a " miscommunication " and why out of everyone was I the one he targeted like that? My manager said they're intimidated because I'm a woman and I out work them but I just do my job I don't disrespect anyone and honestly this incident 5 days old has triggered a past incident where I was assaulted by a male because of my sexual orientation. I don't know what to do I need help because I still have rent but Management has lied about many things and dismissed how this has affected me. Any advice will help it's not about money it's about standing up for myself and not allowing people to do these things to people that are just trying to work take care of themselves and their families.

    Wow what about if the employer interrupts lunches and breaks? Also the employer stalks my husband by driving his car around looking for him asking him for him. Cussed him out screams at him. And their are so many witnesses. My husband filed a complaint with HR she took my husband in her office told him to fill out the paperwork and she said she will call a meeting in a day or two here we are a week later the HR lady tells my husband that his case is higher than her pay grade and that her manager will take care of it. Still nothing is being done and my husband’s main supervisor knows everything because he also gets harassed. Also the man harassing is part of the Executive team he’s the owners brother. This man will park his car while my husband is eating and watches him. He will get out of his car walk up to him during his lunch and breaks screaming orders at him. There is so much more but to much to write.

      Barbarella Bravin- unions are there to mediate and in a lot of cases you are absolutely correct but I have a case right now and the only support I have gotten is through the union. Now that I’ve experienced such a tremendous amount of harassment I am now a union steward and plan to help as many employees as I can In the right circumstances.

      steve g what if it was a supervisor not manager or even a lead and the main lead that was harassing me got promoted to a supervisor when she couldn't even do the job that they expected us to do and me on the other hand would hit far and beyond in one department 450items per hour and id hit 750 with flawless accuracy another one was 680 I'd hit 1000 and they have a data base that could even prove it too

    Can anyone tell me if having an insubordinate "protected" employee who daily tortures (with severe, extreme and pervasive harassment) the entire Crew (for over 20 mos.) and especially the Supervisor, because the Big Liberal Municipality is afraid to reign in a protected person, there is nothing that Supervisor can legally do because he is unprotected?       Hi there. What you are describing sounds like an awful mix of bureaucracy, politics, fear, and entitlement. I don't know what you mean by "unprotected." Every person is a member of a "protected" class. I'm a caucasian male. Under FEHA, I'm protected just the same as a black female is protected. If I were working for a company, and the employer decided to harass or terminate me for being white or male, that would be against the law just the same.
      Also, an employer can always fire an employee for insubordination or any other legitimate reason. The risk that the employer takes is when an employee has good evidence to suggest that the termination was motivated by his/her protected status. But if the employer has good grounds to terminate someone, they can and should. That is the benefit of CA being an "at-will" state. The goal is to allow employers to fire bad employees.

      This BF has been employed here for several yrs and her Father as well and has had scandals as well, but as a BM and friend of our long term former, corrupt, BM Mayor, he is too is immune from any and all consequences for his misdeeds over the years.
      His daughter has gone through multiple disciplinary processes, she's filed many EEO complaints, ruined three or four W Supervisors, she has been fired and then accepted back, with back pay for wrongful termination! Now she's heading up a racial equality panel to educate all the racist's left in her wake.

The bar which your presentation seemed set, for having a winnable case, was the qualifications you cited for being a member of a Protected Category. White Heterosexual Male doesn't have a box for anyone to check. FEHA may have some language alluding to protection for WHM (as well) but where I work, it is of no practical significance, they will retaliate.

      @@speelane2000 FEHA stands for the CA Fair Employment & Housing Act. It is the main anti-discrimination law in California. If you're not in CA, then your state may have different laws. Regardless, Title VII is the Federal anti-discrimination law and that sets the minimum. CA's main law is CA Govt. Code 12940.

From my experience the best is to gather any brave witnesses and accude an attorney, leave a typed account of the entire matter(all details), fill out a letter as an signed affidavit, mail certified to the highest executive present at the workplace. Lesser measures seen as weak. No brave co-worker witness? go work elsewhere

    Branigan Robertson get license in Mississippi i need you here. I'm being discriminated against and retailatied against because I reported fraud, discrimination and mis-conduct to my employer. I work for a defense contractor. Never been written up for nothing. I've received bonuses and raises since I've been there I was promoted to a lead position. They were knowingly selling non conforming parts to the government that can cause the lives of sailers and many others. Since my disclosure, I've been isolated, harrased, discriminated against and I've been refused to return to work although I've been released fullduty. I have text, emails, records, and several other things. They've violates my FMLA rights, ADA rights and workers comp rights. I have text messages of other employees telling me that suoervisors told them to not talk to me. Make me feel unwanted and several other things. Audio files and several other things. I can probe hostile work environment with ease. They lied to department of defense and I can prove that as well.

    they tried to fire me by saying that I asked somebody do you want to fight and I didn't but they still suspended me and we're determined to let me go but I had more statements on my side and ended up coming back & now it got to the point that they actually framed me & fired me on the day that I took a sick day so that way I could speak with hr about the abuse they asked to search me without any probable cause the supervisor who searched me 2weeks before it said he was going to get me for any company policy he could possibly get me for and when I empty my jacket there so happened to be a candy that somebody put there because while I'm picking I take my jacket off and they took advantage of that smh but I was being harassed by 3superviosr kinda 1mangers and 1 lead but I didn't before I got fired retailuate in front of everybody when we started the day about descrimation and unethical work practices and to the point I slayed my supervisor in front of everybody and told her that her idea is creating conflict of interest and she tried to be all smart and I told her well even Rick agreed with me that it was and she just rolled her eyes and said and I quote i don't care and I bit my tongue I now wish that I didn't because there was alot of people there that had no idea that Rick was the manager and they would've probably all laughed at her she already felt humiliated if only 60% wouldn't have been new
