    Thank you so much for your kind message for the people.
    I’m the less holder so how can I kick out the tenets.
    How ever the tenets doesn’t have any pepper from the landlord and lease holder.
    Please help me understand this situation

    Indeed very interesting.I wonder what advice could be given to a tenant that has a landlady that's not prepared to rectify roofing,damp,and electrical issues making the property uninhabitable?

    Make sure the EX96 confirmation form is signed & risk assessment is completed in full with full contact details on who will be attending the eviction to sign off the warrant as if not done then the eviction won't happen.Landlords must ensure this has been completed either by themselves or their solicitors.

    Section 21 is served to tenants with assured short term tenancy agreement, which gives them 2 months. In the meantime we are made homeless and currently dealing with an injury which will require regular care for at least few months. Unfortunately agency did not serve 21 notice ,2 months before the contract ends. Because there was a clear closure in the contract which was signed by all parties initially that this was a 12 months of tenancy only.
    Even though, they agreed and signed knowingly and afterwards (month ago) arranged the date for check up on property, tenants then told the agency that they were adviced by council to stay put because agency didn't serve them the section 21 in time.
    We are now forced to wait 2 months minimum, with an injury on leg, cannot move much, cannot drive, feeling anxiety, being stuck in a diy campervan in front yard of our friends home. Feeling awful. For how long we don't know.

    I have given my tenant a section 21 but now they are still refusing to leave she has had four months notice and should be leaving my property on the 7th of December but has been to the council and got some advice and been told not to leave but the property has been sold

    My issue is slightly different. my tenant has been paying rent and he has been with me for a few years. unfortunately due to my own circumstances and for child care issues, I moved from summerset and living with my parents in London and have been living in a room with my child. I served my tenant notice in January for him to leave at the end of June ( giving him enough time as he has a family and the fact that he paid rent each month although not always on time and at times I had to remind him) I explained the reasons why I need the property. subsequesntly, taking covid into consideration , I served second notice in May extending to first week of October and clearly mentioned that I live in a room and I need to move to my home. Therefore he had 8 months in total to vacate.
    He went abroad for nearly 3 months from June to August and I think he left it for too long to look for a proprty and also he mentioned that he has been refused by some agents and land lords. He has not found a place to go to and he is overstaying. I have been messaging and urging him to keep looking since serving the second notice, he clearly dismissed all my requests. I am now too weak to speak with him, one I am not going anywhere with his lack of communication skills with small sentence texts and second not respondig to some of my messages asking him to call. I have now asked someone else to represent (mediator, an investor landlord who has a property portfolio and manages his properties ) and hoping that this will not end up in a legal action to evict. But if that is the only option, I am prepared to do that. any thoughts anyone?

    This is not applicable to me, for I am the victim ! My belongings are getting stolen and destroyed where I have lived and are currently living ! It is like being gang stalked and mobbed at the same time ! I am NOT the one who is doing this and I am tired of the gaslighting !
    This is like a "SCRIPTED" horror show that never ends !
    He and others are harassing me, and I share a bathroom with the landlord in his home, which was uncomfortable to begin with. In addition, he thinks there is nothing wrong with me walking out of the bathroom after taking a shower with a towel on, while he is sitting with the door open in the next room !
    I am highly uncomfortable with this, and have told him that he needs to go downstairs when I plan on taking a shower ! He also has the monies for a web cam (could be highly problematic/ illegal/criminal) external hard drive, dance classes, going out to eat, yet getting him to repair or replace any fixtures in his home has to be FORCED !
    In fact, one night, I opened my door and found him standing in his doorway, with his boxer briefs on, and I was horrified ! In addition, I found a pornographic magazine/mail order catalogue on the dining room table. Also, I keep catching this 80+ year old pervert, looking at my body parts, and I so completely uncomfortable and agitated ! In addition, my underwear is getting "punctured" and other clothing is getting "cut up", food is being eaten and tampered with !
    The whole situation is absolutely insane ! I am tired to calling the local authorities and others to try and get assistance here ! Please help !!

    What if the tenant pays off enough between the date of serving the notice and the court hearing so that the arreas are less than two months, is the section still valid ?

      Hi Greg, thanks for your question. Should a Section 8 Notice have been served on the Tenant on the basis of arrears of rent, then a Landlord would usually seek to rely upon grounds 8, 10 and 11 of schedule 2 to the Housing Act 1988 (if applicable). Should the Tenant have paid sufficient amounts to the Landlord following the service of the Notice, so as to bring the arrears of rent below the 2 month arrears of rent threshold required for ground 8 and the Landlord had also included grounds 10 and 11 in the Section 8 Notice, the Landlord could still seek a possession Order. If the Landlord is able to prove that there are some arrears of rent at the date of the Hearing and/or that the Tenant has persistently delayed in paying the rent, then the Court does have discretionary power to award possession of the property to the Landlord.

    More importantly people in their 70s should not be served with a notice to vacate a property they have lived in for 16 years or more just because the landlord wishes to sell. There should at least be a six months notice for every year spent paying rent without a problem or a moving allowance of £10,000 payable by the Landlord on the sale of the property with long term tenants in situ. A lot of people are renting these days and laws need to be tightened up and firmly put into legislation. People want to live with security of tenure, not always going to bed with the threat of vacating for reasons that are of no fault of their own. I for one am sick and tired of listening to the bleating of landlords who say they are not making any money out of their properties and that government legislation makes it hard for them to keep the property. Something should be done NOW - not left till after the election. No more evictions because landlords want to sell, unless rents have been withheld by the tenants. It is selfish and evil.

      You are a dick head. Its not selfish to want or need to sell your own property, and as for 6 months notice for every year that would mean 8 yrs to sell !
