BREAKING: DOJ Took The BAIT On Machine Gun Case… They Started The Appeal Which Could DESTROY The NFA
The entire NFA is unconstitutional.
Well it was signed into law by a democrat after it was passed by democrats so no surprise they didn’t care
The following apply to all branches of government:
Murdock V Pennsylvania 319 U.S. 105 (1943): taxation of rights from the constitution is illegal, so the NFA is illegal to enforce (as if "shall not be infringed" wasn't clear enough).
5 U.S.C. § 3331-3333/7311: Advocacy to overthrow constitutional rule of law is definitively illegal with penalties to include removal from office or job/position AND fines or confinement.
18 U.S.C. § 1918/241-242: Violation of the Bill of Rights under color of law is illegal. No branch of government has legal immunities.
So yeah, the whole purpose of the ATF is unconstitutional.

This is the appropriate reaction. In case you all haven't been paying attention- regardless of 'the laws, rulings and standing, if they don't like the way something is going they will just go around it or go through it. When it doesn't serve them they will just throw out the rules. The likelihood of something sensible happening on the books is less than nil. The bureaucracy will never hold itself accountable

A good first start is to get rid of the Hughes Amendment if we plan on dismantling the NFA.
The Hughes amendment shouldn’t have ever been passed. Another sterling Republican failure right there passed in a spending bill that solved nothing.
If the NFA dies, the Hughes amendment will also die.

@@thomashasty2936 He's right though. If you are convicted of a crime, you have the right to appeal the conviction as many times as you want. That's why people who get the death penalty aren't actually executed until like 10 years later. Those 10 years are taken up with the person convicted constantly appealing either their conviction or their sentence.

I mean it’s not as far fetched as it sounds. Cargil stated that rates of fire consistent with machine guns didn’t make items machine guns. So really all that would have to be done is reference the fact that all a machine gun is, is a sear that increases the rate of fire.

The chances of this happening are so slim. The same as always it will go to the Supreme Court and they won’t take up the case
eventually they have to take the case. They can't keep denying cases. Look at the assault weapons bans cases. They keep coming back.
@@TacTygerThe problem with those cases is slightly different. This case is specifically defined. The AWB cases are harder to rule on because they consistently change the definition of the vague nonsense that is an “assault weapon” every state uses a different definition of it. They do that specifically so it doesn’t get to the SCOTUS

That's why we constantly ask what an assault weapon is and recently we did get an answer that just so happens to be ruled under heller and Bruen because a federal judge threw a temper tantrum and said " these commonly owned assault weapons " Gotcha ! also FPC and others have pretty much gotten the same exact answer that it is a political blanket term that just means any modern firearm or weapon and now that they are working with exactly that definition in the cases the walls are closing in
SCOTUS will have to take up the case because of Circuit Split. Circuit Split is SCOTUS’s domain.
They only take cases once it's been back and forth through the courts, especially with a 2a case and even more so with all the recent 2A cases that have now laid a framework for all cases moving foward.

The Breun decision stops all the lower Court judges are just mad because scotus stopped the lower courts from misinterpreting what the Second Amendment means

There are a lot of rulings in gun cases that are unconstitutional and should be gotten rid of them

So the ATF and DOJ didn't really have a choice! They were stuck between a rock and a hard place. The rock being the Bruen decision, and the hard place being the constitution!

If I remember, the court that started the NFA ruled that since the military did NOT use SBS’s, then they basically said the WE could also use anything the military used. AND if the lawyer for Miller had got off his a$$ and showed up to the court he could have informed the court that, yes, the army used SBS,s in the trenches of WW1.

There’s always the “dangerous and unusual” clause the anti-gunners always like to throw out there. However, the law that created the NFA1934 really hasn’t “delivered as promised” either.
There is no dangerous and unusual clause anywhere in the constitution of the united states of America supreme law of the land therefore dangerous and unusual is moot irrelevant meaningless.

As retired Air Force with multiple combat deployments, I Don’t Want a “full auto” rifle. Although splitting hairs, I’d rather have the 3 shot burst. I found that bust is fairly accurate on 2 if not all 3 shots. “Full auto”, meaning not burst, is simply not accurate after the 2nd shot. That being said, it’d be Really nice to have a burst/auto option.
We should have the right to own a machine gun if we want under the 2nd amendment period or not if we don't want one

The Miller case covering the NFA was weird, as the appellant skipped when released, then died. So only the government case was heard.

Somewhat surprising that the DOJ decided to appeal this case. It wasn't precedential, and was an "as applied" challenge only affecting the defendant. It would not surprise me if a Trump DOJ drops the appeal to cut its losses.

First off the Bruen case is about bearing arms. The case that has bearing on firearm bans is Heller. Heller states that firearms can be banned if they are found to be “ dangerous and unusual “ Caetano v Massachusetts sets the bar for unusual at 200,000. There are a little over 175,000 privately licensed full auto firearms that are NFA listed. NFA firearms held by law enforcement, private security companies, rental companies for the movie industry, etc are not considered because they are not privately owned. The only way to increase NFA full auto firearms is repeal the Hughes Amendment. The SCOTUS will abide by their previous precedents and uphold the ban in my opinion.
No senator, Congressmen, governor, president has any legal lawful constitutional authority or jurisdiction to pass any form of gun laws whatsoever anywhere in the united states of America and no judge has any legal lawful constitutional authority or jurisdiction to enforce any form of gun laws whatsoever anywhere in the united states of America under the 14th amendment section 1 NO STATE SHALL MAKE OR ENFORCE ANY LAW WHICH SHALL ABRIDGE THE PRIVILEGES OR IMMUNITIES OF CITIZENS OF THE UNITED STATES, they are all state officials elected or appointed to a specific state and therefore prohibited by the constitution of the united states of America supreme law of the land from passing or enforcing any form of gun laws anywhere in the united states of America period.
Any small arm in common use by the military is a common use firearm which is neither unusual nor dangerous. They can be regulated at the state and federal level, but cannot be banned. So NFA is not what's in danger so much as Reagan's 1985 select fire ban. The ban that started it all. Once that ban goes, all bans follow

The NFA doesn't ban any of the above, it imposes a tax on said arms. The GCA of 1986 bans machine guns manufactured post 1986. I know a tax on a right is unconstitutional, but this ruling won't affect the NFA.
And remind everyone that they called it The Gun Control Act in 1986 because they _want to control guns._

You know, I don’t think that this is as good as it sounds. I don’t think the current court make up is going to be willing to stand by it’s own standards, when it comes to machine guns. I think we could end up with a terrible ruling that we will spend decades trying to overturn.
If gangstas have access to full-automatic accessories for their auto-loading f'arms, why should the law-abiding not have equivalent access? After all, aren't we all about equity? Or equality? Or whatever term one chooses? We need to level the playing field. I shoud say: the BATTLE field.
