How can we decide that they are actually a gay?
How can we assure that they are not abusing a girl child ( raping) ?

No it's your mind, it's not your body. So as of now there are no tests that can make sure of your sexual orientation. But yes this is a valid point, whenever in future when we'll legalize the marriage, we'll have to think about this stuff!!kudos✌🏻

Our "honourable" Supreme Court regularly complains about lack of resources to manage pending cases. Same SC has enough resources to take up the issue of same-sex marriage, but says no to issues like Uniform Civil Code & Exodus of Kashmiri Hindus from the Kashmir valley. Sheer hypocrisy.

SC hasn't taken any action against udaynidhi stalin for his derogatory remarks against Sanātani Dharma. The fact is, our judiciary has always been biased against Sanātanis. Talking about UCC, it will make sure all citizens are actually treated equally, unlike right now.

Judges who favoured same sex marriage should look at the state of affairs in western countries. Same sex marriage is not just restricted to the couple but effects whole society. It is also supported by some capital elites. Why? Because more and more young children who will be attracted will try to get into "sex-change operation" or will get "hormones injection" which means huge profits.

When a child is adopted, the child has no control over it, suppose a child is raised by same sex parents and that child when grow older will face challenge and may eventually drop parents and it may impact its mental health.. in society for everyone parents means mother and father of two different biological sex. Out of 100 if one chile os raised by same sex parents it will be difficult.. either their should be age limit for adoption of child that a mature child can be adopted by same ssx parents after taking child concent

Very sad decision by SC for LGBTQ people. Country should not discriminate towards section of its citizens specially democratic country like ours. By reading comments one can easily observe how much ignorant people are towards these people and their sufferings due to non recognition of their basic rights. Sc has duty to protect rights of social minority if they are denied by there rights by majority. Legalization would have created atmosphere for social acceptance towards these people. How can we say we are vishwaguru, vasudhev kutubkam when we r not recognised family rights of section of our society. Hope things will change in positive direction in future .

In my opinion allowing same sex marriage does not pose any existential threat to the Society essentially because a marriage lasts only when it is solemnised with mutual consent of both the partner. In a marriage it is the affection towards each other that sustains the relationship and the relationship that lacks this affection then the marriage falls apart. And in this context if a person who is a homosexual marries a woman which is a norm as per the society will this last longer if he does not share intimate relationship because of him being a homosexual. I have met with people who entered into marriage because of family pressure despite being homosexual and whose marriage ended with false allegations on him under IPC 496 dowry only to have reason for divorce. Even if one disagrees with this should have his own reason why he disagrees and not because others disagree. Critical thinking skills is very important when we talk about SOCIAL JUSTICE.
So your kids are not just yours neither your marriage is just a personal matter.. the state and the union obviously will interfere in it ..

I have heard many opinions on this issue but I can understand the supreme court takes on this. But our parliament is filled with many barely educated, orthodox people. They already rejected the appeal by giving some of the baseless arguements which literally anybody could counter. As this plea was taken to the supreme court with some of the most pure arguements about " right to marry" supreme court simply thrashing it saying it's parliament's role when they already knew their judgements and arguements was pure bullshitery. Maybe SC is right and it's really not their place to make/change law on this subject then this law which literally have so many counter-arguements against it would never change due to how much orthodox and uneducated our leaders are nowadays.

It is more important that LGBTQ people are first economically brought into the mainstream rather than raise a hue & cry over marital rights & status etc. Ut does not provide any real benefit to those people. As individuals they need economic & and social security rather than marital security. In any case who will provide security to whom? In normal marriages the man provides security to his wife & child. Here as there will be no procreation no nurturing of new life who needs the family security. It is another matter that they should be allowed to lead a dignified life but that has nothing to do with marital status.
