    This is indeed a great cautionary tale. Thankfully, Combs withdrew the lawsuit and gave her $11,000 in compensation for her bank having been froze. Apparently, the company he has in place is supposed to look out for big ticket copyrights, upward of a million dollars doing international sales. He now also has a tumbler of his own for purchase, with all proceeds going towards her. It was an honest mistake, and I’m happy compassion was shown…I doubt most cases would end this way for obvious reasons though.

      He's a good guy because like you said, most lawsuits will NOT end that way. I will continue listening to his cover of Tracy Chapman's fast car, which I love. 😁 I like supporting people with a ❤.

    She knew what she was doing I suspect but decided to take the risk anyway. Greed drives many to get on to Etsy with infringing other people's copyright rights and trademarks. She was lucky and even made money out of it.

    It looks like that lady was a professional thief violating all kinds of laws. It is stealing, and is something everyone should know. Just because someone like a country music star or Disney makes lots of money doesn't give anyone the right to use their property to make money. It reaks of entitlement. I do have compassion for the woman, but she obviously is trying to make a living taking from other people's work. Thank you for making this video and I hope the people that just have a little things done from other people's work will listen to this and not let it happen to them.

    Luke Combs did not sue her. He quickly diverted the situation the moment he heard about it. As he stated his legal team are to go after big business making millions off of counterfeits that advertise as originals. He gave this woman 2x the amount of what was being held in Amazon & made his own tumbler where all the profits will go to this woman.

    He took it all back and made a tumbler with the proceeds going to her. So I don't think this shows sellers they shouldn't do this.

      Yeah but it could have ended very very differently. If she was selling Disney related products and it was Disney suing her? They wouldn't have been nearly as forgiving, if at all.... She got lucky.

    It’s 🔥SO important🔥 to educate yourself on what you can and cannot use/do. I don’t fathom why she thought she could use someone else’s likeness without a licence and be comfortable doing that. I saw another video on this last week and he was very kind to her. Hard lesson to learn but good this is highlighted with her and also with everyone else. There are a lot of chancers out there creating unlicensed merchandise. Don’t copy them! Be honourable and know what you can and cannot do. ✨

      A lot of these vendors are also buying this artwork online so they think they are protected, only to find out the source of the artwork violates copyright. It's sad because thousands of people are doing this on social media and are begging to be sued. They just don't know what they are doing and don't consider copyright issues. One tumbler can ruin you financially. It's unfortunate she was scapegoated.

    People should know better than to sell products based on well known person(s) or intellectual property, ignorance or otherwise isn't an excuse - this situation should serve as an example.

    Not only did he remove the charge but he is sending money to help her and her family! His kindness is misguided imho. It's sending the wrong message and could well encourage other 'small guys' to think they can get away with infringing his and other artists' IP rights 🙄

I haven't watched the video so maybe she truly didn't know but I stand by what I said earlier how does any adult not know that you can't pick your favorite musician or your favorite sports team and just make t-shirts with their face and their logo and their images I mean come on common sense here people. I agree he went away too easy. Okay fine maybe drop the fine or the charges but don't give her any money don't apologize she was clearly in the wrong. Ignorance of the law is no excuse next time you get caught speeding tell them that you had no idea that it was against the law to speed and see how well that goes over.

      I agree, definitely seems out of proportion, normally they just report you for copyright infringement and the platform takes down the item.

    It's scary because there are so many trademarks that are so frivolous. Such as ....cuz I Said so. Mama bear. Etc.
    Also I have a question. If you list something for sale and someone copywrites it later? What happens then?

      If someone trademarks it later, then it's not different than if it was trademarked before you listed it, you are still liable. I tend to not include the exact saying on my shirt in the SEO for this reason. If you see a particular saying getting really popular that you are selling, just check it every once and awhile for trademarks or make a google sheets doc with all the sayings you use and you can pay for softwares like Merch Informer to check them for you. Or Everbee's trademark checking service is slowly getting better to be able to warn you about trademarks, but for right now it shows you lots of random other stuff as well.

    I am curious about some of the Etsy stores out there too! I've noticed stores selling Stray Cats tees. I love the old 80s stuff (I grew up in the 80s), but just wow.     What if you have a custom product and someone orders a saying that is TM'd? For example let's say you sell a customizable cup for sale and the customer puts into the textbox that they want the cup to say, "Mama Bear". "Mama Bear" is trademarked. Is this infringement? I feel like this would be extremely difficult and time consuming to monitor if you have customizable products.

    I always say that just because others are doing it doesn't mean you should. All of those other shops will eventually get caught for copyright infringement. Maybe not today, next month, or 2-3 years, but the hammer will come down on them. Its just not worth the hassle.

    I would love to get a video on tips of how to make this more passive, and only spent 2 hours a day on it, getting more free time is the reason we all do it, isn’t it?
    But the longer I am on Etsy and the more I’m selling, I’m realising that I’m working harder than in my office job.
    I remember you mentioned in 1 of your videos that at times you only spent 20 minutes per day but got consistent sales.
    Also every time I stop listing for a few days I notice sales go down.

    What if you made a product with a trademark work or phrase before it became trademark? Let's say I made the product 2 years ago and in the last six months it became trademarked.

      once it has been trade marked you can not keep on selling it. as someone else now owns the legal rights to that design/concept. But you can't get in trouble for anything done before the trademark was established

    I tried warning another person on YT about her Etsy store and some of the items she's selling. All she said is " Noted " and keeps selling Daisney, Hello Kitty and more. I think this lady knows better. Nice of him to pay the $250K but he went and gave her even more. I think that sends the wrong message. She will never learn and others will try and get away with the same thing.

    Not sure if you mentioned this (didn't catch it) but also do not use TM'd or copyright words in your titles, tags, or description either. I really appreciate you highlighting the importance of keeping your work as original as possible. If you can't manage that, this probably isn't the right business for you.

A question, I have a Christian Products store, and I saw that the word God has a trademark and obviously I have designs in which I put phrases with the word God, can you sue me for it? Because the truth is that there comes a time when practically everything is a trademark so we should invent a new language or I don't know, it's frustrating to be honest...

      So typically if the word "God" for example is trademarked, first you need to make sure it's specifically trademarked for the types of items you want to sell it on like clothing, mugs, ornaments etc. If it is, then it is just trademarked to put only that word by itself on there. As long as it's a pretty common word like God, then you will be able to use it in a sentence. It's always easy to check because if you look on USPTO, usually you will see longer trademarks with that word in it as well. So if someone else can trademark a 3-4 word saying with God in it, then you can use it in a different way as well. Not legal advice, but this is my best understanding! They are just protecting from "creating brand confusion", so like the word "nike" is much more unique so I don't think you could get away with using it in a sentence for example.

I find it so crazy on how many people sell things on etsy that they are not allowed to, and I know better because of your course, but for others out there who are just trying to get by and make such a mistake can be devastating.     Especially now, I see Etsy shops selling NFL design type of merchandise with the playoffs going on. I think to myself, "Wow, these people are taking on an enormous risk, way more than I'm willing to take." I'm mainly seeing mostly the current playoff teams stuff. I highly doubt any of these Etsy store folks, got permission from the NFL or the 49ers, or Lions or whichever team stuff they are selling.

    Characters, people, name brands, and even sections of lyrics are off limits. Imagine thinking one could make and capitalize off Mickey Mouse products without licensing and approval. When in doubt, forget it.

    How do you handle stolen parcels please, where it is said delivered.

      Sometimes it says delivered before it is actually dropped off, message Printify and they will usually tell you to wait 7 days for the item to show up and have the customer check with the post office and neighbors. If it isn't there by the end of the 7 days, they should send a free replacement! But anytime you have an order issue, just message Printify first before even responding to the customer. They are great at taking care of issues!

      @@CassiyJohnsonthank you. 🙏it’s been days since they have not found the order, I am in the Uk and Amazon just drops parcels outside the house even if it is a busy area, this makes it subject to theft. So far it’s 2 customers. I got refund for one from printify as it is too late to send replacement but I would message for the other. They are actually quite helpful

    I feel for her, but she brought this on herself. It's called common sense and claiming you didn't know isn't ever going to work except in a very unusual case like Luke Combs being a nice guy. You definitely can't count on that though. "Everybody else is doing it" didn't work in high school and it doesn't work in real life. I didn't realize someone could sue you and win without you being legally notified and I don't consider email to be legal notification. I think someone in the states with that asinine rule needs to be fighting back against it because emails disappear all the time.

    I'm not falling for her boo-hoo story. She loves him, so naturally she starts stealing from the guy. He had to pay her out to save his reputation and to turn the story around and explain his business practices publicly because of this plagiarist. Mom's little thievery shop that she runs out of her home; I guess counterfeiting money would be a federal crime. Someone I knew copyright infringed on Disney characters painted on wood furniture for children at a local crafts marketplace. Disney sent her a cease-and-desist letter. She kept on doing it, and then they sued for about 200 grand, way back in the 90's. She had to get a lawyer and settle the case for 30 grand! Thank you for helping sellers out by showing this kind of lazy destructive behavior and where it can lead.

      I see so many stores with copyright infringed products and wondered what percentage of then have have a license to sell these products? Do you know whether it's difficult to be granted a license to use say, disney images and branding on your products? Disney and barbie have been huge this year on etsy and I often wonder if some of them do actually have licenses?

      @@Harleymakesthings Let's face it, Disney Licensing is very big business. There is a TH-camr named Hannah Ricketts who happens to have a job in Licensing for Disney. She did mention that her job entails working with partnerships and developing licensed product lines across all of Disney's assets. There would be a contract and the Disney law division would go over it...seems like a whole lotta hoops for a small Etsy seller to jump through.

      Usually they do just report your account on the platform and get the listings taken down, this is the first time I have heard of this happening personally.

    I'm sorry but any adult should know you can't use someone else's face or something you see in a movie. It doesn't belong to you it's obviously copyrighted why would anyone ever use this type of thing in a design. I did a AI beach design one time that had a vaguely recognizable Volkswagen in the very back and within 2 hours Amazon told me to remove it via Volkswagon telling them. That was an accident this was obviously someone just trying to make money before they got caught.

      @@CassiyJohnson I was being very careful I'm not sure how that slipped past me but I'll tell you what it sure made me be a lot more careful when looking over my AI designs. I was thankful to Amazon they handled it perfectly they sent me an email and said this is in violation per Volkswagen I think it said I had like 48 hours to take it down I deleted the design within 30 minutes it's not worth the risk to my account. That's why I'm always shocked when I see these stores that are blatantly using copyrighted material right out in the open and often times they are best sellers with advertising I just don't understand how they don't get caught sooner. Thank you for your video I had not seen this until you posted it. 😉
