Why Do I Need A Criminal Defense Lawyer if I'm Innocent?

The shortest answer video you can make with the same question, but for Canada, is, "don't say sht".
Almost all of these videos tell us what to do assuming we are in fact drunk. They say just by being pulled over you are virtually guaranteed to be going to jail no matter what, so dont give them anything. That makes sense if you are pretty sure you are drunk. But what if you only had one drink and you feel just fine? How about 2 drinks and feel just fine? Doesnt refusing the tests then guarantee you will be arrested, whereas the cop might let you go if you really arent drunk?

I’ve got a way better piece of advice: how you answer that question depends on whether you actually have been drinking or not. If you have, you’re an idiot and you’re likely screwed anyway, so don’t make it worse. If you haven’t, then say so. Be polite, cooperative. And you’ll be fine. In case you haven’t seen the news: bucking up on an officer during a traffic stop might just get you killed. Just saying. Don’t be stupid. That officer has huge breadth with just how much damage he can bring to your life. When you’re roadside, you’re not the shot caller, the officer is .
I was a prosecutor for 5 years, both felonies and misdemeanors, and have done criminal defense and parole work exclusively for the last 33 years here in Austin, TX. HERE anyway, our officers may be a little bit more on top of things. Your answer of "no" to the question of "have you had anything to drink?" Tells the officer immediately that you're lying to him/her, NOT a good way to start off your encounter. To "take the fifth'? To tell the officer that you're not going to answer his questions, tells the officer that you're hiding something. To shut him/her down completely without answering any questions, at lease here in Texas, gets you arrested for Failure to Identify. The officer can smell the alcohol on your breath, to tell him/her you had "a beer,: etc., doesn't admit to intoxication, but also makes the officer think you're (at least) NOT lying to him. Best answer is an absolute "NO" because you honestly haven't been drinking, don't drink and drive at all and you'll be fine.

This type of advice simply doesnt make sense to me. If you say Yes, that does not indicate that you broke the law, since in most places the law is 0.08 BAC limit. If you say i plead the 5th, they will take that as you were drinking but avoiding going on the record, and so they will breathalyze you and seek an arrest if they can justify it. At least if you say Yes they might be willing to cut you a break if they dont think you had too much since you were honest with them. Or at least say No and they might not even investigate you for it at all.
Unfortunately, no one "cuts you a break" these days. Every officer has a BWC. Once you admit you had alcohol it justifies the detention of you further to perform Field Sobriety Exercises. Even if you say 1 drink it justifies that detention.

The attorney left out to answer this way, if you HAVE been drinking. If your haven't, then say 'no' and a good chance the officer will move on. You will see quickly if the officers mind is already made up that you have been drinking. Then you can go to the 5th amendment route and ask to use the station breathalyzer or have blood work drawn. The portable one is not accurate most of the time.
Then after doing that, you will be immediately taken to the station and will need to call this attorney. See how this works?

Have you seen news out of Tennessee lately? 604 people arrested for DUI that not only had not consumed any alcohol but when breathalyzer tested they blew 0.000. Major scandal. So not everyone arrested these days is actually drunk.
