Welcome to The Patent Guy channel! Unlike other channels, I have no interest in selling anything. The primary motivation for most patent attorneys on TH-cam is to solicit clients. Therefore, they are inherently biased to encourage you to try to get a patent whether you should or not. My family has directly experienced the adverse affects of this inherent bias.

China is just following the exact footsteps that the US..UK and EU have been bullying and threatening other countries in its foreign jurisdictions on chips act and others with tariffs and sanctions... if the US can do it, why not other countries...so what is that you are complaining???? True. But it does not prevent them from forcing those doing business in China to accept Chinese Courts telling them what they can charge for their patents in the United States.

Is China setting unreasonable rates, or is China rolling its muscles to limit exploitative excesses of patent royalties? Two questions arise: 1) how does your example play out in the real world, in figures? How much money did Nokia invest to develop the patent technology, and how much did they make of it so far? In other words, how exploitative was their set rate of $3/phone, and how (un)fair is the reduction to $1/phone? 2) Does this mean that China is developing the tools to deal effectively with patent trolls? Saying that, a deep dive on patent trolls, how they work and their influence on innovation might make an interesting video topic.
Those are very good questions. Frankly, I am more concerned about Chinese Courts overstepping and setting rates for patents outside of China than I am about the rates that they actually set. 1)I do not know about Nokia's actual finances, they do not share them with me. 2)I don't think this is an attempt by China to effectively deal with trolls, rather, I believe it is a power grab by China to extend their geopolitical influence outside of China. Great idea! I could talk for hours about trolls . . . a deep dive on that topic would be fun and easy for me to make and likely would be interesting to my audience. I will add it to my list of video topic ideas. Thank you!

Since I'm no financial whiz myself I asked AI, and though I assume this answer to be wrong it may still give a ballpark estimate: The patents likely involved are Nokia’s 5G SEPs for technologies required to implement 5G standards. Nokia's investment in developing 5G patents is estimated to be in the range of $1.6 billion to $2.1 billion USD for the relevant period, based on their overall R&D budget. In terms of royalties, assuming 1 billion 5G devices sold annually, Nokia might have earned about $7 billion in royalties over the last few years, before and after the rate reduction. If these figures are anything close to the truth I definately don't blame China for reducing patent royalties. Personally I wouldn't call it a power grab unless it's used in bad faith or weaponised. If they limit themselves to cases where ROI already exceeds 200% I'm all up for it. If the USA doesn't like that, maybe they should have figured out how to stop excesses themselves.
Forget patenting something, I did it once, and its just a waste of time and money, best of putting a copyright on it, that way its a criminal act if someone copies it... Plus like here in Australia the state fines and investigates the copyright infringements so you aren't paying the legal.
America is a weapons war law firm corporation billionaire China is not - they don’t put the destruction of humanity first - profits are after people & because the rich can’t buy their Govt they are able to afford their lives & live how we were told we could if we did everything right we are 4% of the global population but home to 2/3’s of the world’s lawyers - lawyers don’t produce shit so it’s hardly shocking that China who has the most engineers & scientists would be filing more patents than us we’re too busy trying to survive to innovate

No. Patents are designed to ruin you if you don't already have hundreds of millions of dollars. To fool you into thinking you are protected when any US judge can give your patent that cost you hundreds of thousands to get, to any company that has more resources to market and distribute your IP worldwide.
Thank you for your comment! That is a fantastic suggestion and one which I have been seriously thinking about. I think it would help a lot of people, which is the reason why I make these videos. I would love to do it! The problem I have is finding the time to devote to such a project. I have a full time job and life outside of work. Maybe I need to stop making excuses and just get started on the project!?
It's much worse than. There are spies within the patent office who delay pertinent patent applications and forward them to interested parties. Then a modified application is fast forwarded, over the original one. There are many stories of this practice and it's a very old one.
I ran across some patent trolls that got mad at me for making up a name they didn't think of for the technology I'm working with. They told me how they had planned in advance of this technology taking off and would wait until the company got really going and then sue them for the name they put rights on. I was glad that I thought of something those trolls didn't think of, but interestingly someone someplace else did try and sue me for the name of my company but it turned out I thought of it first.

Great point! However, China has had a lead in STEM students for quite some time. That trend does not align well with the recent surge.

Thank you so much. Having read the patent center website, and some of the statutory code; then coming to youtube for help figuring out how to use the website, I began to doubt my non-provisional selection. Was my reading comprehension as it relates to legal juxtaposition suddenly degrading? Upon skimming some videos aimed toward promotion of provisional patents, the creators provided few facts while repetitively using phrases regarding provisional such as "builds trust" "path to market" "first stake in the ground". Conspiratorially, I wouldn't be surprised if these creators were financially compensated by corporations.
You are very welcome and thank you for your kind words! In my experience, most of those who advise the use of a provisional application are trying to "sell" something (usually their services). They are worried about scaring away potential clients because of the relatively high cost of a properly prepared application and try to comfort people by making them believe that a provisional is less expensive. It is NOT true! To the contrary, you actually spend MORE by filing a provisional because it is entirely unnecessary. Glad to learn that you made the right choice. As in-house counsel, I align well with my client and think about the business and realize that a provisional is never the right choice.
Huawei just won a patent infringement cases by an American company in Europe.
What one should own are the products or brands they've built from the ideas, not the ideas or methods that produced them. Life is fundamentally open source - From simple methods of heating your home in winter, to the design of a spoon, your life runs on innovations that would be patent- eligible, yet are not patented. If you thought of something first, before anyone else, then you have the advantage of time. Harvest all you can from it. But to establish it that no one else can/should think of the same, no way. Patent trolling was born and given life by the legal system, with patent lawyers like you sir screwing people over technicalities.

@@ThePatentGuy Patent laws should be part of a cybernetic review of the economic, social and environmental processes. From an economic viewpoint one might ask what China has done. China's industry has rocketed ahead. China's application (or not) of patent laws has been part of a system that has raised hundreds of millions of Chinese out of poverty and made China one of the two world economic powers.
How did this South African billionaire insert himself completely into politics in a matter of months.

"gov't efficiency" means AI. AI means central control, less gov't vulnerability to pesky humans who have morals and interest in truth and justice.
The present patent system seeks 2 goals: 1. Protect Intellectual Property (IP), which it does pretty well. 2. Promote invention, which it does HORRIBLY. I see ways to see that inventors receive money in connection with their inventions, WITHOUT the present cumbersome and expensive process. We NEED this debate, that should lead to a system that also works for inventors, in addition to working for industry.

Ending remote work wouldn't make any significant difference at all over the long run and would actually hurt more than help over the short run. I think it's a waste of time and DOGE should focus their efforts elsewhere.
Examiners will soon be replaced by AI. And they should be.

I’m concerned about my patent being stolen, now more than ever. Non-biased individuals working for our Government, that’s a good thing, we trust them to help us because they’re just like us. Two multi-billionaires stating they’re planning to destroy programs that protect seniors, disabled, veterans, and children are not looking out for We, The People. If they truly wanted to stop government waste, they should have started with the man in the mirror, at all the free money they have taken that belongs to taxpayers or helping those with special interests. How about changing the tax codes for those who are not paying their fair share, the bailout funding for corporations, insurance companies, properties sitting vacant; here’s a radical idea, move people into vacant homes in trade for mandatory work cleaning of cities, homelessness and crime would be reduced and it’s a great way to stop waste and improve things. What’s to stop them from sifting through billions of files, pulling those they want, discover information, make modifications, then file their own? With endless funding, they can lawyer to death the little guy, then outperform the marketing, laying waste the original patent holder. What’s to stop them from abusing the office?Certainly not Trump, we’re watching that on livestreams every day. The entire idea is a total CF. Those two have no business being anywhere near that or any other government office that works to protect everyone’s right to file and hold a patent or trademark. For those saying, “They can make it more streamline and faster”…Elon is known for taking/buying existing ideas then improving or skilling them up with his paid researchers and team of engineers. Buying work already completed is not being an “inventor”. Having endless amounts of money to pay for the substantial, if not all of the contributions from engineering teams and researchers, rather than being solely his own creations, is not the same. So, for the little people in the reality room, Elon being anywhere near the patent office is truly frightening. Inserting them into this agency is a serious conflict of interest, much like the rest of the goofballs Trump is appointing to intentionally destroy our government. We are not moving in the right direction folks. Anyone that believes that these two running this agency is a good thing, is delusional. Making workers drive to work, this is Elon’s ego and his bullying behavior. The pandemic proved that workers are just as or more efficient working at home and they can save money on childcare and transportation, so that blows his argument out of the water. Ask yourself, “What could either gain from total access to the USPTO?” For those filing, maybe you can see it as a win but from an individual perspective, no, this has red flags all over it.

How about the patent office move to “somewhere” else? If most can do their work remote……then DC isn’t a locked in location
That is a good point. There are regional offices, but they are technical field specific. So, if you a not an examiner in a technical field relevant to the satellite office, then you are out of luck. They really should be more flexible on that.
@ My personal opinion about DOGE: I think they’re looking for obvious fat in the system. The more technical the work, the less likely (but not always) they will trim. After 35 years working for a university, I am well aware of campus positions that had spacious offices but rarely an occupant. So the general concept of DOGE is good in my eyes!

Politicians have thumbs, and they need to have people under them - as does the bloated USPTO 'beurocrappy', many of whom are no longer needed, but their are used to the $$ and they are trained to say 'do you want fries with that' as their next job!
I'm a patent lawyer and the quality of examiners and the time they seem to spend on cases is abysmal, especially after the remote move. Distributed workforce does NOT require working at home - government buildings throughout the US could have office space for patent examiners.
Excellent point. They did establish satellite offices, but the limit the Examiners who are resident at those office to only those examining in the technical fields that are positioned at those offices.

The real problem with Patents is it limits creation, if someone creates a product, do it well and make if affordable for others and this will create demand. I have been involved in the process and I gave up because it was too expensive and there are so many variations you may not be able to create your product even if it exceeds other products by a long shot. You said it its profit and has nothing to do with creation and the betterment of mankind. Sounds like more corporate gobble goop and lets look at a lot of the very poor products produced that are so damn expensive and last half of what they used to. Automobiles would fit that example. How about instead of profits we focus on delivery of sustainable products that do not fill up dump sites and really get what we pay for.

Musk is very intelligent. He will analyse this and see that examiners no longer use the huge fleets of filing cabinets, indexes and fetchy/carry staff - where a file was brought to the examiner, inspected and assessed and then other files fetched/carried as the process carried on - we have all seen the file archives of the patent office. Now, in the office, they actually remotely access/view/assess patents/claims. Only rare very old files may be in paper format - and those decline as more files are scanned and onlined. So all this will do is change where the examiner sits - at home or in a DC office. I see a huge pushback from examiners, perhaps the best half will quit and operate from home as gig-type examiners/attorneys/consultants = huge burden on the patent office who will need huge new hire numbers - and these are 'rara avis', rare birds indeed - they are not supermarket cashiers which flock at ~~$20/hour to find new positions. the patent lawsuit/litigation turf needs to be 'weeded', so that patent trolls and certain judge enclaves in Texas, that shame the PO with corrupted bribery schemes - all well hidden and cloaked in false propriety.

Many jobs do well with home working. So, why not the patent office. I have a few patents on the American system and I'm thousands of miles from them, so, many people will simply not care where they're located. Musk has a habit of annoying some people and I suspect that he may soon start annoying Trump and that may End Musk's interference.

Personally, I really appreciate being able to work from home, however, I will say that it is nice to occasionally interact with my colleagues in person. Frankly, I think many of us are MORE productive working from home or from wherever we choose to work to be the most productive.

By rosey, did you mean the adjective rosy? It's worthwhile listening to what's actually being said and applying some critical thinking to those words before challenging people about doing research. Where Musk is concerned, people haven't far to go to find out what he's been saying. X is right there to get it from the horse's mouth and because he is so prominent, he is being reported on throughout the day and at night sometimes. Musk needs little researching for this level of opinion piece, and that's what it is, an opinion, nothing more, nothing less. I'd have thought anyone with an interest in intellectual property would want to know if a character like Musk was going to poke his nose in, as that could end up detrimental towards anyone trying to protect their IP. If Musk gets involved, I'd be more concerned about him trying to profit from that involvement and we don't need that.
Forcing everyone back into offices will waste more money on office rent and setup, and waste employees’ time and morale on commute travel. Big hit against tax dollar efficiency.

I agree that for the some people, remote work can be a great improvement in efficiency but the problem is that that is not universally the case. The problem is that despite the remote work, patents have become increasingly expensive while the time to approve the has also increased and this is hurting business. I support remote work but the government needs to become more efficient and at least with in-person work, that efficiency can be monitored and improved. Our team works remote and we meeting our project targets. I suspect if we start falling behind, there will be a call for "all hands on deck" and we will all be in the office. If you (or anyone else) has an alternate proposal to reduce wait time without increasing costs, I am all ears. Currently China is completing patent reviews in 14-16mo and issued 1.6 million utility patents in 2024. On the other hand, the US takes 36mo and only released 300,000 patents in 2024. That is ridiculous and embarrassing.

My understanding and observation of the work that is performed by Examiners is that it does not involve working in teams at all. Therefore, in-person collaboration is not necessary. Examiners work independently and did so even when they were in the office everyday. The contrast between the overall, high level performance of the U.S. patent office examination system in comparison to those of other countries, I believe could be attributed to the lack of value that our country places in our Examiners. For example, German, Chinese, and Japanese examiners are VERY highly respected and are compensated accordingly. Engineers and scientists from those countries respect and value working at those patent offices. In contrast, the U.S. does not compensate the Examiners at the same level as other countries, let alone the rest of the U.S. job market, therefore, people only go to the patent office if they cannot find a better job and see it as a last resort. If we want efficient, fast, high quality examination, we need to attract better talent to the patent office.
