Hey there! When you say that law now requires a licensed agent to “list” the contract, are you saying that the property has to be listed on the MLS? Or is a licensed agent able to act as a wholesaler themselves and just market the contract for assignment to a list of buyers that they know without listing it on the MLS?
I don't even recall hearing about this in my pre-license class!! I went through VanEd online.
What if the question doesn't mention whose responsibility would be on the day of closing?

Hey Randall, I want to become a wholesaler in Nebraska but am worried about regulations and stipulations like this one hindering my chances at success. According to LB892 per the Nebraska Real Estate Commission, "LB892... requires a real estate license for “ marketing for sale an equitable interest in a contract for the purchase of real property between a property owner and a prospective purchaser."" So, would privately contacting an investor about your properties under contract and assigning the contract to the buyer privately be okay since it clearly states only the public marketing of the property to be prohibited?
Thanks for the question... the simple answer is... it's still illegal. Marketing is broadly define even to include word of mouth between individuals.

An interesting and thoughtful video. I was aware that Nebraska is a one party consent state. I didn't consider that at a showing with a buyers agent and a buyer, where the seller is not there, then the seller is not a party in the conversation and the one party consent law does not apply. I would guess that if a seller has audio and video recording devices, they could be covered if they had a sign stating that there is audio and video surveillance within the home.

Great information! That realtor did not find the house for the buyer. As a buyer in a tight market I feel like I am doing all the work. You can’t just wait for a house to become available anymore. I would hire and pay for an agent that would put in the hours to find off market deals.

The fence question was just brought up in class.
From my experience the 16th century feudal system still exists and is hidden in our system today. Certain types of Property like surplus funds reverts back to the king when unclaimed. We still have mayors, governors etc which kind of shows us evidence. The chair of saint Peter is the successor. Feel free to add to this post.

Well, we should be owning property in Allodial... Fee Simple ownership is NOT allodial and clearly keeps up in a semi-feudal system... because we certainly have government interference (Taxes, Building Codes which are private by the way, etc)
Exactly, fee simple is a title of use. What one must study is registered vs record and public vs private.

Yes. Nebraska has a reciprocity law. You only have to take a 3 hour agency class and pass the criminal background check. The class can be taken online. I moved from AZ to NE in 2016.
This is screams self-accountably and promptness. Once you sign a contract for a listing, don't delay or allow yourself to get distracted and list the property within 24 hours. The fines are fair... Delaying a listing a 4th time is not a good sign on an agent or broker's part. Excellent video Paul, thank you.
