Thank you for watching! Rob & I tried to cover as many aspects as we could about intellectual property, but obviously we weren't able to cover everything under the sun. I based the conversation around the *most* commonly asked questions I see all the time online. Please try to stick to topics mentioned in *this* video here in the comments. If there's high enough interest (re: lots of views) I will ask if he's able to return for Part II. Rob is a busy practicing attorney, and I am so grateful he was able to lend us his time at all. Make sure to follow him on social media, as he shares a lot of great insight for his followers.

Thanks for the informative video. Very well done and answered most of my questions. AI used for creating derivative works is something i would be interested to hear more about in a follow-up conversation. Also would like to hear more about patent infringement. Thanks again.

So glad you had Rob on! This makes things much more clear as to the risks you take on in making derivative stuff etc. Appreciate you providing this content!

Etsy deactivated a couple of my fabrics I was selling per Nickelodeon. I didn't understand that. I sell supplies in that shop and I purchase my fabrics from wholesale.

Im not a seller, everything I do is personal use or gifts. But I had a couple questions that may have been good to ask. Let’s say I make and sell doll clothes. What about the use of “inspired”. Inspired by American Girl. Is that a yeah or nay. He touched on “not affiliated”, but I’m not sure it was clear to me. Again, let’s say I sell bejeweled Nikes. In the description is it acceptable to say “not affiliated with Nike”. And my other question probably has nothing to do with the topic other than a seller making money. But I’m obsessed with Disney Popcorn buckets. There are people that will pick up buckets and charge a sellers fee. Makes sense, they are using their time to pick it up. But is there an issue with someone making money off a product? Or does that fit with fair use (I forget the term you used in the beginning with the fabric example)?

You probably want to avoid using any names of brands or trademarked words/phrases anywhere online if you're selling. Saying "inspired by" would likely *not* offer any protection. Using brand names in Etsy listings/descriptions is also flagging items for removal. Chanel and Louis Vuitton are even going after various sellers for having their trademarked logos in product photos & marketing materials.
Simply reselling items for a profit likely would just fall under First Sale Doctrine as those sellers are *not* making changes to the item and are selling exactly as-is. The issue that's becoming more prevalent is people CHANGING products in the form of significant alterations / upcycling them into other items.

This is helpful, I'm curious about things like accessories. For example iPhones, where they use "Fits iPhone 13" or something like that in the title, as its impossible to find non-Apple products otherwise. Are accessories protected from copyright issues?

Soooo..Chevy, Ford n Dodge r also brands. But its not an issue with them for decades in refurbishing vehicles n reselling them.
Bought a 70 Chevelle SS for $700 in 1985 then fixed it up n sold it for $50,000. Why can't I not buy Disney Items..fix them up n resell them or alter then onto something else?
