good work but i'd like to point out a mistake: the Kelsenian theory was in fact rejected in this case and the reiterated the Doctrine of Necessity to justify its decision

Respected madam, As we know that in dosso case, a precedent was set that according to doctrine of neccesity, when there is a change in govt, constitution or laws of the land and no resistance is shown, it will be considered as a successful revolution. Although this precedent was completely rejected in Zarina Gohar/Asma Jelani case as the supreme court declared that we are the judges of our own jurisdiction and supreme court is not bound to act upon any theory. The precedent of State Vs Dosso case was rejected which led to the restoration of democracy in Pakistan. Then how can the precedent of Dosso case be used in 1977 when it was already declared null and void in 1972? Please reply. Thank you.
