I am of the opinion that when an officer asks for consent to search the personal affects of someone they suspect as allegedly having contraband then if the subject does not consent to the search as is searched anyway only to reveal nothing illegal in their possession then it is more of an infringement of the reasonable search clause under the 4th amendment as it is written in the bill of rights. Because the detainee was asked if he/she had anything illegal on them or in their car to which he/she answered no. The fact that a detainee was being truthful carries the same weight as if he or she were lying.

What undermines the public's trust in law enforcement is most stops that result in unwarranted sanctions, ones that don't show clear cause for a vehicle search where searches are conducted anyway often trump the nexus of the stop. One can only conclude that the violation formulates the segway of a more intrusive agenda. What other conclusion can you come to?
