President Biden has signed legislation to reauthorize Section 702 of the Foreign Intelligence Surveillance Act despite years of protest from rights groups and privacy experts who say the law is routinely used to conduct warrantless surveillance on millions of American citizens. The Senate approved the FISA bill on Friday in a 60-34 vote, and critics say it not only reauthorizes domestic spying but also dramatically expands its scope. "It's an enormous amount of data that they're collecting and very few rules" limiting its collection, says investigative journalist James Bamford. He warns that personal information collected by U.S. intelligence is also shared with Israel, which uses the data to target people in Gaza. "The U.S. has got to stop supplying all this data and the targeting materials," he says. Bamford's new article for The Nation is headlined "The NSA Wants Carte Blanche for Warrantless Surveillance."

It is appalling and frightening, and our American understanding of personal privacy has radically changed because of it. At least among those in my genetation, for whom civics was an itegral part of our education. That ended 50 years ago. People on subsequent generations, at least those in public primary and secondary schools, were denied this education, and it shows. Snowden and others had some success in forcing the Senate to act, but once loosed, there is no putting the genie back. I should note here, the that our country is under constant and ever increasing cyber attack. Many tens of thousands of attempts are made every day, by foreign entities to spy on corporations, individuals, defense entities (both contracted and government based) , academia, media and many more. Many US based foriegn operatives use ubiquitous forms of communication to send and receive inforation, and our protection against these threats is the NSA. I don't agree that American citizens should then, allow for the general collection of our communications as a cost we must bear for our saftey. I also dont agree that companies selling us all things we buy, should be legally able to amass our consumer info either. We can silve this problem, but to do so, we have to stand united in our opposition, voting in those who oppose, and getting out from under those who support these intrusions. Of course, that would mean theowing off identity based politics altogether, in favor of idea based politics. Imagine that. Americans voting like Americans were meant to vote.

The ACLU has some interesting information on their site regarding the loopholes in the HIIPA act they are using to access our personal information. For example;

The HIPAA rules provide a wide variety of circumstances under which medical information can be disclosed for law enforcement-related purposes without explicitly requiring a warrant.[iii] These circumstances include (1) law enforcement requests for information to identify or locate a suspect, fugitive, witness, or missing person (2) instances where there has been a crime committed on the premises of the covered entity, and (3) in a medical emergency in connection with a crime.[iv]
In other words, law enforcement is entitled to your records simply by asserting that you are a suspect or the victim of a crime.
Q: Can the government get access to my medical files through the USA Patriot Act?
A: Yes. Section 215 of the Patriot Act allows the FBI Director or his designee to get a court order under the Foreign Intelligence Surveillance Act “requiring the production of any tangible things (including books, records, papers, documents, and other items) for an investigation to protect against international terrorism or clandestine intelligence activities, provided that such investigation of a United States person is not conducted solely upon the basis of activities protected by the first amendment to the Constitution.”[vii] This power appears to apply to medical records.
