Mam as you said that the plaintiff must have suffered damages, but plaintiff ne hi toh malicious case kiya tha and jiske upar case hota h woh toh defendant hota h n? I have this confusion, please help
Right plaintiff ne maliciously case kiya tha lekin jb court ko pta lggya ki ye malicious prosecution thi or usme baad defendant ne malicious prosecution ka case kra toh Pehle vala defendant ab plaintiff bngya ...I hope it's clear.
@Sheenam Thanks for answering this question.. I hade the very same doubt and was looking at videos to clear it. It is now crystal clear. Thank you so much ❤️
@@RiyaSingh-ip1ku Malicious prosecution occurs when someone is wrongfully taken to court without valid grounds and with malicious intent. Initially, Person A (who will later become the defendant in the malicious prosecution case) starts a false legal case against Person B (who will later become the plaintiff in the malicious prosecution claim). Person B wins the case, proving their innocence. After this, Person B can sue Person A for malicious prosecution, claiming that the original case was started without good reason (no probable cause) and with bad intentions (malice). The purpose of this new lawsuit is for Person B to recover damages they suffered from being wrongfully accused, such as financial loss, damage to reputation, or emotional distress. Thus, in the malicious prosecution case, Person B becomes the plaintiff, and Person A becomes the defendant. This ensures that those wrongfully accused can seek justice after the original case ends in their favor.
