Yes my matter is about frequent transfer ( more than 8 times in year, underposting only) and no nature of duties mentioned. My post designation and it's requires qualifications are different. So it is very difficult to us ,nature of duties sometimes as per designation and sometimes as per Qualifiaction.

Where should a PSB employee can file complaint related to service matters?
Sir, we filed a WP(C) in the high court against the UoI and the decision will come in our favour by the single judge. After that, the UoI filed Review Petition against the WP (C) decision. The Review petition was also dismissed on merit by the High Court. Then we filed a Contempt case against UoI for not implementing the decision of the court given in WP (C). In response to the contempt case, the court in its hearing mentioned that " . THE MATTER IS ADJOURNED AT THE REQUEST OF THE RESPONDENTS (UoI) BY A PERIOD OF 5 WEEKS MAKING IT CLEAR THAT IN CASE, THE RESPONDENTS DO NOT SUCCEED IN THEIR APPEAL OR DO NOT GET A STAY ON THE OPERATION OF THE ORDER THEY SHALL COMPLY WITH THE SAID ORDER FAILING WHICH RESPONDENT SHALL REMAIN PERSONALLY PRESENT IN COURT ON THE NEXT DATE OF HEARING." On that basis, UoI filed an LPA in the High Court and the high court issued a notice to our advocate with the direction to submit the reply of LPA within 5 weeks and give a new date for the hearing. Know I want to know what happened to our case can UoI implement the order of WP(C) or decision will be implemented after the outcome of the LPA filed by UoI. What happened contempt case filed by us. Please response

Delay in release of gratuity in favour of a retired govt employee results in his right to life and liberty as guaranteed under Article 21 of the Constitution.In such a case, should the matter be agitated in an administrative tribunal or in a High court under 226 of the Constitution?
Consideration of arguments relating to violation of fundamental rights guaranteed under the constitution of India is not restricted only to the high courts or Supreme Court. That can be considered also by the Administrative Tribunal.
If your case falls within the definition of "service matter", then according to the judgement of the supreme court only Court of first instance would be Administrative Tribunal.
It would be a matter of being fortunate if the high court entertain the petition directly.
Please show your papers to some expert lawyer in the field and take further step only in accordance with his advice.

To uska parinaam unhen bhugtna padega. Agar contempt case chalu rahte hue bhi vah Court ke direction na manne ki jurrrat kar rahe hain, to Court mein case ki hearing ki darmiyan yah baat ujagar karni hogi. Court unhen bhi apni baat kahane ka mauka dega. Donon pakshon ko sunane ke bad agar Court ko lagta hai ki aapke virodhi paksh ne contempt Kiya hi hai, to unse court strictly deal karegi aisi apeksha hai.

Thank you for reaching out to me with your query. However, I must mention that I do not practice in Madhya Pradesh, and I am not familiar with the exact location of the State Administrative Tribunal (SAT) in MP.
Regarding your service matter, you need to first determine whether you are an employee of the Madhya Pradesh Tourism Corporation or the MP State government. If you are an employee of the Corporation, then your case may not be under the purview of the Administrative Tribunal, but you may approach High Court directly unless you have any other alternative remedy.
However, if you are an employee of the State government, then you can approach the State Administrative Tribunal to file your case.
I strongly suggest you to consult a practicing Advocate who is well-versed in the local laws and procedures, before deciding to file your case. They will be able to guide you better and ensure that your case is filed correctly.

सर , हम उत्तर प्रदेश राज्य में वर्ष 2006 में संविदा पर स्वास्थ्य विभाग में 47 दिनों तक कार्य किये थे परन्तु आज तक 2023 विभाग द्वारा हमको भुगतान नहीं किया गया है , हमको हाईकोर्ट इलाहाबाद जाना चाहिए या फिर ट्रिब्यूनल में ।

Sir admission -25 क्या होता है। एक केस में नैनीताल कोर्ट ने amendment file करने को कहा है 10 दिन के भीतर pititioner को। और फिर अपने आर्डर में लिखा है list this writ pitition as soon as amendment file by pititioner.
Amendment भी फ़ाइल कर दिया है, responder को नोटिस भी आ गए है ,इसे एक महीने से ऊपर हो गया है। responder कोई रिप्लाई नही कर रहे है इसलिये अब आगे सुनवाई कब होगी ,बताने का कष्ट करें।

सम्मानीय वकील साहब सर्विस मैटर में वन विभाग व राजस्व विभाग 2009 से आज दिवस तक कार्यरत है लेकिन आज दिवस तक उनको परमानेंट नहीं किया गया। क्या वह परमानेंट हो सकते हैं कि नहीं।
यह, उनका कामकाज प्रोबेशन पीरियड के दरमियान कैसे रहा उस पर डिपेंड करेगा। अगर उनका परफॉर्मेंस देखते हुए एंपलॉयर ने उनका प्रोबेशन पीरियड बढ़ा दिया होगा तो परमानेंट होने को समय लगेगा। पर फिर भी यह आश्चर्य की बात है कि 2009 से लेकर तो अब तक यानी कि 2022 तक उन्हें परमानेंट नहीं किया गया!
आपकी सिचुएशन ऐसी है कि इसमें इंटरेक्शन करके कुछ डाक्यूमेंट्स एग्जामिन करने की जरूरत है। तभी ठीक तरह से सलाह दी जा सकती है। यह कमेंट में इतने लिमिटेड स्कोप में पॉसिबल नहीं। आप अपनी चॉइस के वकील साहब से सलाह ले सकते हैं वह ठीक रहेगा।

सम्मानीय वकील साहब कार्मिक 2009 से 2014 तक वन विभाग में कार्यरत था व 2013 से वन विभाग द्वारा कार्मिक को राजस्व विभाग में काम सीखने के लिए मौखिक आदेश से भेजा गया उसी दरमियान वन विभाग ने 2014 को बजट का अभाव बताकर सेवा से पृथक कर दिया लेकिन कार्मिक आज दिवस तक राजस्व विभाग में कार्यरत है उस को पेमेंट भी नही मिलता बस एक आस हे की परमानेंट कर देगे।

मी , WRD water resources development मध्ये वग् ३ ची कर्मचारी आहे.service ला११वर्षापेक्षा जास्त झाले पतिपत्नी एकत्रीकरण GR अन्तर्गत विनंती बदली.झाली Rilivar पण आहे .पण Rilivar हा आता येण्यासाठी तयार नाही.Rilivar हा विनंती बदलीने येणारा आहे.मीMATमध्ये जावं का?
असं आहे की कोर्टामध्ये केस करण्याकरता एक तर तुम्हाला कुठलातरी कायदेशीर अधिकार असावा लागतो जो की कोणीतरी उल्लंघित केला असेल, किंवा प्रतिवादींवर कुठले तरी कायदेशीर कर्तव्य असावे लागते जे की ते पूर्ण करीत नाही आहेत. तुमच्या केस मध्ये रिलीवरने आलेच पाहिजे अशी त्याच्यावर सक्ती करणे असे कुठले कायदेशीर बंधन वॉटर रिसोर्सेस डिपार्टमेंट वर आहे? ते तपासावे लागेल. माझ्या मते जर का ही प्रशासकीय बदली असती तर गोष्ट वेगळी असती म्हणजे असे की त्या स्थितीमध्ये रीलीवर याला येणे भाग होते. परंतु ही बदली विनंतीने आहे म्हणता. जर तुमच्या रिलीवरला विनंतीने देखील आता यायचे नसेल तर त्याला यावेच लागेल असे कायदेशीर बंधन असेल असे मला वाटत नाही. त्यामुळे अशा परिस्थितीमध्ये मॅटमध्ये जाऊन काही हाती लागेल असे वाटत नाही. तरीही एक गोष्ट लक्षात घ्यावी की मी तुमची केस पूर्णपणे तपासलेली नाही. तुम्ही जे काही प्रश्नामध्ये लिहिले आहे त्यावरून हे साधारण मार्गदर्शन देतो आहे. याला तुमच्या केसचा कायदेशीर सल्ला समजू नये. तुम्हाला योग्य वाटेल त्या वकिलांना प्रत्यक्ष भेटून किंवा फोनवर चर्चा करून रीतसरपणे कायदेशीर सल्ला घेऊनच पुढचे पाऊल उचलावे.

देखिए सुप्रीम कोर्ट में ही नहीं तो किसी भी कोर्ट में कैसे दायर तो कोई भी कभी भी कर सकता है। इसलिए क्या आपके सुप्रीम कोर्ट में दायर कर सकते हैं या नहीं इसका जवाब है जी हां आप कर सकते हैं। मगर केवल केस दायर कर सकते हैं और इस वजह से अपने केस दायर कर दी इसका मतलब यह नहीं की आप केस जीत जाओगे। आपकी एवं पी ए डिसमिस करने में हाई कोर्ट ने क्या लीगल गलती की यह जब तक आप सुप्रीम कोर्ट के दिखाकर कन्वेंस ना करोगे तब तक सुप्रीम कोर्ट में जितने की संभावना कम है।

sir what is terrorial jurisdiction.my father got discharge from his service on the ground of being inefficient after being working in the federation for more than 35 years.He was compulsary retired from his office in raipur.I have file the case in patna high court.Does the patna high court will entertain the case as the cause of action taken place in raipur.But he is a retired person.many colegue of my father approaches patna high court and they all get their judgement.But my father is a retired person and we are resident of bihar.Can filing a writ appropriate at patna high court.As there is no CAT for the my father govt firm NCCF .sir plaese reply.I will be very greatfull to you.sir please reply.my father is in depression.He worked for about 35 years in office.please reply sir as he is only bread winner of my family.

ऐसे स्टे ऑर्डर महाराष्ट्र फॉरेस्ट सर्विस से रिलेटेड क्लास थ्री पोस्ट फॉरेस्ट गार्ड के लिए इंडस्ट्रियल कोर्ट में होने पर भी मेन कंप्लेंट पेंडिंग रहते हुए भी फिर से नई ट्रांफर ऑर्डर कर दी और वन साइड रिलीव कर दिया, उस ऑर्डर के खिलाफ फिर से कंप्लेंट उसी कोर्ट में फाइल की, लेकिन कोर्ट ने respondent के फाल्स स्टेटमेंट पर मुझे नई केस में स्टे नही दिया तो मैं हाय कोर्ट नागपुर गया WP 7208/2019 वहा कोविड से केस पेंडिंग हो गई, इसलिए सुपीरियर ऑफिसर से डिस्कस कर के " मेरा आर्थिक एवं सेवा विशयक कोई नुक्सान न करने की चर्चा पर केस वापस/विड्रा किए और नई पोस्टिंग मेरे गांव में मिली है, परंतु मेरे बैक वेजेस और सर्विस बेनिफिट के लिए अधिकारी आनाकानी कर रहे है" उनकी यह कार्यवाही सही थी क्या, और अब मैने क्या करना चाहिए! संजय सुईवाल वनरक्षक, तेल्हारा, जिल्हा अकोला, वन विभाग अकोला.

Yes in my opinion the PSU employees are not the employees of union of India in strict sense. They are employees of some corporation. So they will have to go to High court directly. But take advice of an expert lawyer by consulting him. Don't treat my opinion as legal advice in any particular case.

So, accordingly High court has granted interim relief (status quo) still, is it necessary to file another application in State Administrative Tribunal pertaining to the impugned notice?
No. Not necessary. Once the matter is under consideration of the High Court and even interim relief is operating, then unless this writ petition is disposed of by high court by passing some order you need not go to administrative tribunal.
