In the letter he received, TH-cam says "There are either ads running on your video, with the revenue going to the copyright owner, or the copyright owner is receiving stats about your video's views." This is while the video is still running. So it's possible that there are many cases where TH-cam is in violation of copyright law due to their own actions.

Google fears it will be used to host illegal content, so they come down hard on the side of claimants. They are also not staffed well enough to investigate every claim. They know this screws over content creators, but they don't want to spend the money to implement a better system.

Covers can legally be claimed by the copyright holders. It falls under the right to perform. Copyrights cover not only the original recording, but any performances, sampling, unauthorized arrangements, remixes and written transcriptions. Even if your video has just a few seconds of a recording it can be claimed, unless it falls under fair use (i.e. you're reviewing the song). Now, if these claims are _not_ by the copyright holders and truly are by fake channels, then that's really messed up.
To be honest, that system is stupid. As if the guy who claims to own the song rethinks his decision and says "Yeah, actually you're right, this isn't my song.".

Some company's actually do that like one time a youtuber's video got copyrighted when it was suppose to be protected by fair use and when he went on twitter and said that he was reviewing his legal options the company gave him the video back. Im seriously disappointed in TH-cam for this mess. Imagine relying on a source like this to maintain the credibility of your work. Even with evidence and everything to back him up, TH-cam still didn't act rationally. What does it take for this kind of occurrence to stop happening? I read the comments and seen people's channels be unfairly striked and taken down. All the content and work erased into nothing. These are horrendous stories and TH-cam really needs to stop breaking the hearts and lives of their community.

I respect how calm & cool you are with the whole situation - I'm confident you will get it resolved in the end . I was robbed $6000 USD from one of these claims myself. The company (Extreme Music) claimed my entire short movie on a song which wasn't even used in the video. I sent about 4 retractions and contacted TH-cam multiple times over the 12 months (nothing worked obviously). In the end, I had to personally go seek them out and threaten to take further action if they didn't do anything about it; and thankfully they did. It’s alright for us bigger channels, but anyone fairly small has no chance against these false claims which sucks big time.

I've had similar situation when someone stole my track and besides TH-cam monetization he even sold it on Google Play. The reason why TH-cam won't do anyhting is because they let music distributors handle the copyright claims. Thankfully for me I got the issue solved relatively easily by contacting the music distributor this guy used to steal and monetize my track and ask them to remove it. However it's rarely this easy and the whole system should be improved to prevent these kind of things happening.

Just yesterday I had my ENTIRE channel demonetized because youtube now decided that if a video has been uploaded to the platform too many times (basically people stealing our songs/videos and reuploading them on their channel) it counts as duplicate/reused content and all channels can get punished in one way or another. The problem is: knowing youtube the way we do, they are certainly leaving those decisions up to some kind of broken bot following a horrible algorithm and so it backfires and punished even the ORIGINAL creators...

Well at least the bot should make it like the 5 oldest uploaded videos are not punished outright but manually reviewed (i say the 5 as if the original creator got a problem in upload and reupload it the day after or something) it should help quite a lot in this case... But well they can't physically do anything without the bot 1rst...
At the end of the day TH-cam is still getting paid so there is 0 benifit for them to intervene. It's horribly sad to see and we can only hope that in the future these claims will be based upon evidence first.

This is still a huge ongoing problem even years later - I recently got a copyright strike and despite having proper licenses for the footage in my video my dispute is going back to the claimant for review - the system makes absolutely no sense and seems intended to mentally stress out legitimate content creators by others who have bad intentions - this seriously needs to change

The fact that even a TH-camr of your size barely gets any help and is being thrown around is deeply worrying for other content creators. Imagine a person who can't have the reach you do and comes across the same problem or any other of this magnitude to address this.
This is honestly the first time I’ve heard of this happening, and I think I’ve had something similar happen, I got copyrighted on an absolute BS claim, on a video with no bgm, and I got claimed for a song that wasn’t even in the game I was playing. I really hope that you got the rights to your song back, and that the way to recover your rights has since been simplified in a way that actually makes some sense
We had a similar thing happen to us. A dummy company bought a bunch of samples from the same source as us. They setup a fake artist and songs that were just random mashes of those samples. Then they used Content ID to claim thousands of songs. Over 170 of our videos were claimed as a result as we play our music in the background of our live streams. It took 60 days to resolve and it only resolved because they didn't respond to the counter claim.
Maaan, dealing with that while creating Heartbound must have been REALLY stressful! At least you won the dispute, could have gotten alot worse, like TheFatRat's did

This happened to me in one of my biggest video a few months ago, it is so frustrating, thankfully it got fixed too but it is unbelievable how youtube leaves it all to the person who is basically stealing your video instead of protecting the rightful owner.
same. I had a vid with 2.6 mil views and it was probably the dumbest video on the platform (as with all my videos) but it was still bullshit. It was an edit off of something that I did not make, however, I did follow all the legal copyright rules. I probably would have been fine with it if it had just been claimed right off the start, but the thing is, there was no claim for about 6 months, and then when I went to check on it one day, it was gone. It has been blocked worldwide, and can never be brought back.

Jim Sterling has his own claim ID as far as I know because it happens to him so often. But he is lucky enough to have the money to get a damn good lawyer that can leave YT trembling in their boots at the drop of a pen. Not all content creators have that. Infact, I am 110% sure there are small channels that have fallen victim to these "people" that are so basic that they cant even come up with 1 original idea for themselves, so they do what they have heard others are doing to scam CCs and steal what they can from them before running and hiding like a puppy when somebody turns on a vacuum. Thats why I dont even bother with creating content on here. Because some child whos daddy didnt love them enough will just throw a fit because I got more likes then they did. All videos on my channel are just simple videos that I dont monetize because I want people to watch them and enjoy

TheFatRat: I got a claim on one of my videos. It said that I used a song called "The Spectre" In my video. In my video I had no copyrighted music and I didn't even know the song at the time.
Its absolutely ridiculous how dumb the system is.. Everyone can do this you dont have to be a big company to claim someones video, TH-cam doesnt even look at the claim and this is getting sooo abused

You should report the video then
Covers can legally be claimed by the copyright holders. It falls under the right to perform. Copyrights cover not only the original recording, but any performances, sampling, unauthorized arrangements, remixes and written transcriptions. Even if your video has just a few seconds of a recording it can be claimed, unless it falls under fair use (i.e. you're reviewing the song). Now, if these claims are _not_ by the copyright holders and truly are by fake channels, then that's really messed up.

Even with evidence and everything to back him up, TH-cam still didn't act rationally. What does it take for this kind of occurrence to stop happening? I read the comments and seen people's channels be unfairly striked and taken down. All the content and work erased into nothing. These are horrendous stories and TH-cam really needs to stop breaking the hearts and lives of their community.

3 years later, the system hasn’t changed. Two of my original songs have been copyright claimed this week. The fight continues.
I respect how calm & cool you are with the whole situation - I'm confident you will get it resolved in the end . I was robbed $6000 USD from one of these claims myself. The company (Extreme Music) claimed my entire short movie on a song which wasn't even used in the video. I sent about 4 retractions and contacted TH-cam multiple times over the 12 months (nothing worked obviously). In the end, I had to personally go seek them out and threaten to take further action if they didn't do anything about it; and thankfully they did. It’s alright for us bigger channels, but anyone fairly small has no chance against these false claims which sucks big time.

I've had similar situation when someone stole my track and besides TH-cam monetization he even sold it on Google Play. The reason why TH-cam won't do anyhting is because they let music distributors handle the copyright claims.
Thankfully for me I got the issue solved relatively easily by contacting the music distributor this guy used to steal and monetize my track and ask them to remove it. However it's rarely this easy and the whole system should be improved to prevent these kind of things happening.

Just yesterday I had my ENTIRE channel demonetized because youtube now decided that if a video has been uploaded to the platform too many times (basically people stealing our songs/videos and reuploading them on their channel) it counts as duplicate/reused content and all channels can get punished in one way or another. The problem is: knowing youtube the way we do, they are certainly leaving those decisions up to some kind of broken bot following a horrible algorithm and so it backfires and punished even the ORIGINAL creators...

The thing is that many people don’t know if these companies do own the content. My amv has been claimed by Western and Asian companies, some of them are completely unknown to me and checking from their websites is useless because I can’t find anything in them. Either they don’t have data of that content or don’t have a feature to look it up.
Many people will then just leave claims alone in the fear of strikes. People don’t have the knowledge, money, time or energy to fight.

This is honestly the first time I’ve heard of this happening, and I think I’ve had something similar happen, I got copyrighted on an absolute BS claim, on a video with no bgm, and I got claimed for a song that wasn’t even in the game I was playing. I really hope that you got the rights to your song back, and that the way to recover your rights has since been simplified in a way that actually makes some sense
We had a similar thing happen to us. A dummy company bought a bunch of samples from the same source as us. They setup a fake artist and songs that were just random mashes of those samples. Then they used Content ID to claim thousands of songs. Over 170 of our videos were claimed as a result as we play our music in the background of our live streams. It took 60 days to resolve and it only resolved because they didn't respond to the counter claim.
Maaan, dealing with that while creating Heartbound must have been REALLY stressful! At least you won the dispute, could have gotten alot worse, like TheFatRat's did

This happened to me in one of my biggest video a few months ago, it is so frustrating, thankfully it got fixed too but it is unbelievable how youtube leaves it all to the person who is basically stealing your video instead of protecting the rightful owner.
same. I had a vid with 2.6 mil views and it was probably the dumbest video on the platform (as with all my videos) but it was still bullshit. It was an edit off of something that I did not make, however, I did follow all the legal copyright rules. I probably would have been fine with it if it had just been claimed right off the start, but the thing is, there was no claim for about 6 months, and then when I went to check on it one day, it was gone. It has been blocked worldwide, and can never be brought back.
This is literally the logic of letting a convict review their own case and decide if they are guilty or not.

Im glad you got your video back. CCs like you, SidAlpha, and so many more keep getting this kind of crap all the time. Jim Sterling has his own claim ID as far as I know because it happens to him so often. But he is lucky enough to have the money to get a damn good lawyer that can leave YT trembling in their boots at the drop of a pen. Not all content creators have that. Infact, I am 110% sure there are small channels that have fallen victim to these "people" that are so basic that they cant even come up with 1 original idea for themselves, so they do what they have heard others are doing to scam CCs and steal what they can from them before running and hiding like a puppy when somebody turns on a vacuum. Thats why I dont even bother with creating content on here. Because some child whos daddy didnt love them enough will just throw a fit because I got more likes then they did. All videos on my channel are just simple videos that I dont monetize because I want people to watch them and enjoy
