Plastic Packaging Regulations under Category 1 Rigid Packaging Plastic | Enterclimate

After the government released the Guidelines on #Extended #Producer #Responsibility for Plastic Packaging for defining the EPR-related modalities in January 2022, the PWM 2nd amendment Rules were notified in July 2022, which are, as of now, the latest amendment to the PWM Rules, 2016. This amendment defined certain terms,
• Biodegradable plastic

• plastic packaging
Let's understand What is plastic packaging . The rules define it as any packaging material made by using plastics for protecting, preserving, storing, and transporting of products in a variety of ways; ‘Now it is well known that the government today wants businesses identified as producers, importers, brand owners and Plastic Waste Processors to register themselves on the EPR portal.
However,a business identified as brand owners and registered as micro and small-scale businesses have been exempted from EPR obligations, while producers from these categories will need an EPR certificate. Apart from them, every importer that imports goods that come in plastic packaging will also need to register at the portal and fulfil the generated EPR Targets. Finally, Plastic Waste Processors(PWP), such as plastic granule manufacturers using plastic waste, waste-to-energy plants that use plastic waste and cement kilns that dispose of non-recyclable plastic that use plastic waste in co-processing, will also berequired to register themselves under the PWP category.
The EPR targets will be based on the weight of plastic packaging used by the entity. You can collaborate with registered recyclers / co-processors/ and PWPs who can recycle proportionate plastic waste on your behalf, or you can purchase EPR certificates from plastic recyclers and PWPs. PIBOs that are operational in one or two states/UTs are also required to register with the concerned SPCB / PCC.
Also, another important thing to remember is that businesses will need to ensure which category of plastic packaging they are using. to understand that the obligated businesses will have to fulfil the waste management targets generated at the time of registration under the specific category of plastic that they use for packaging.
