    JUDICIAL CRISIS IN PAKISTAN
    • Introduction:
o The crisis started with letter by 6 judges of IHC
o Government’s decision to establish judicial commission made issue more serious
o SCP Suo moto notice was the first ever taken by new CJP
    • Contextualizing the developments:
o There seems to be a split between Judiciary and executive in general and establishment in particular.
o There seems to be a split within judiciary as well.
o Not the first time, historically the tussle has resulted in major crisis in Pakistan.
    • Current Crisis:
o Three high courts have recently been highlighted by controversaries that involved PTI and governmental institutions.
o Currently, IHC is at the limelight, first for writing letters, then by continuous tough remarks and issues faced by some judges particularly Justice Babar Sattar.
o Governmental ministers and some others have consistently held press conferences against IHC judges.
o Remarks by Supreme Court Judge Athar Minallah forced CJP to take suo moto notice of the issue and cases will be heard in coming days.
    • Why?
o There are two aspects to this conflict:
 Perception that judiciary, other than CJP, have some soft corner for PTI and IK.
 Fear that any relaxation to IK will create political problems for the newly formed government amidst the election controversaries and the establishment.
    • Implications:
    o More political instability
    o More polarization
    o Economic Impacts
    o Increasingly weak democracy
    • Conclusion

This is first time that even a discussion on judicial crisis sounds more like some political discussion.

Judicial crisis in Pakistan is a real threat to parliamentary democracy and viable political culture which has worsened the economic woes . Additionally, the issue can be addressed making judiciary independent and transparent by purging all ails that has derailed its credibility at large. Sir please comment.
