    Pretty sure the physical retribution, even in the form of a tattoo, would be considered a criminal act. Legally speaking, the tattoo artist would have zero defense. She’s could also sue for pain and suffering and could easily win. Not sure it really happened. Plus wouldn’t she know something was up when he suddenly started tattooing the middle of her back?

      Yes this thank you. I've worked for and around tattoo artists for years and that's not ok. You created a verbal contract with her and you both broke it and your part can't be fixed with some money. She's going to want laser tattoo removal and you'll have to pay for that minus what she owed you. Tit for tat is not smart in this case.

    I'd like to say for that last story, the tattoo artist. Be very careful because people will sue you for that. Do not emulate it please.

    This is why I never want anything tattooed on my back! even though I'd pay them. I want to be able to see the finished work without a mirror. I've seen some photos of really awful back tats.

      This is more of looking into the tattoo artist's previous work. If you're happy with it, then go for it. Just try to avoid going for cheap.

      Back tattoos (specially full back tattoos) are super expensive because is SO MUCH area to cover. If you factor the difficulty of the design, and the reputation of the artist it can only get even more expensive. So what people do? They forget this will take at least a year to finish and ball at the high prices for the full product (as an example I'm quoting a floral full back and the prices are running from 6-9k at the moment, we are still working on design but it might get to 10k in the end) and go for a cheap one, a "my friend can do it for 2k" type of deal... And well, they get what they paid for.

      @@BeriaLima - I'd never really gone into the prices and labour involved in a full back tattoo, as it's not something I'm interested in: my tattoos are all private statements and so are where I can see them, and covered by clothing in the normal course of events.
      I've seen photos of some absolutely amazing full-back tats, though, and whatever they cost, they were worth it.

I never understood how they could be to begin with, but I learned it can be taught as a child which I actually had a few things I thought was right but tbh also seems stupid thinking about it now and I'm glad I learned but my parents and grandparents refuse. My dad thinks that all Mexicans are bad and gonna SA my mom and me. Which if anything hes the kinda person who'd do that

    Even if it was illegal and Scott took them to court and won, I think it would've been a pyrrhic victory. Because OP would've at some point tell them that it was because of racism that they what they did and they probably would had evidence for it too. So Scott's reputation would've been ruined from it.

      In principle, you should be right, but in practice, the opposite is true.
      It doesn't matter if it's "illegal" or not, it's civil litigation, not a criminal case. And over 90% of civil suits settle out of court, and typically with a mutual non-disclosure agreement, so nobody's reputation would be hurt because nobody outside the involved parties would ever know. And if it ever did get leaked by OP's company, not only would they be liable for breaching the non-disclosure agreement (and probably their original contracted terms that usually have a clause to ensure such discretion), but also, it would hurt their reputation more if prospective clients found out they were not being discreet about their dealings with other members of their clientele. Would you hire a company that bad-mouthed its clients? Of course not. So nobody will ever know.
      Beyond that, the court doesn't care if "Scott" was a racist. That's not the issue at hand. It's a simple matter of whether OP's company fulfilled its end of the contract for lead generation. So it would never be proven (or even mentioned) that Scott has a racial bias in taking contracts. That's speculative, with no proof, and is immaterial to the case, even if a review of the evidence makes it obvious. It's still not the point of any potential litigation. Just mentioning it would piss off a judge because they'd be wasting the court's time with irrelevant arguments. If OP said that publically, they and/or their company would be open to lawsuits for slander and/or libel.
      But then, this was never going to court, lol. Not a chance. Nothing was ever even going to be filed. Putting aside the fact that Scott's primary complaint was that he lost his discount (which isn't something you can really sue for, there are no damages to recover so he doesn't have a case at all), there is still one other glaring issue with Scott's statement...
      Every single person who has ever uttered the phrase "I'm going to call my lawyer" as an ultimatum
      A) Doesn't have a lawyer.
      B) Doesn't have a case.
      C) Doesn't know the first thing about how civil litigation works.
      D) Will never find an attorney willing to work with a pompous know-it-all, jackass of a client.
      This is a universal truth. When someone threatens you with a call to their
      lawyer, it means they're vulnerable, you hold all the cards, and you
      should immediately pounce on them. That statement is an admission of
      defeat for people who are too stupid and stubborn to vocalize an actual
      concession. That statement has never intimidated anyone with an IQ above
      the ambient room temperature. It's just the last spiteful cry of
      someone who's about to run out of the room in tears, with their hands
      covering their genitals, who's about to have an emotional breakdown because they lost.
      You know how slurred or incoherent speech is viewed as an early warning sign that someone is having a stroke? Similarly "I'm going to call my lawyer" is likewise just a precursor to a grown-up temper tantrum, lol.
      "I'm going to call my lawyer" should be music to your ears... it means you've already won.
      You will not actually hear from their lawyer. On the extremely remote possibility that they
      do seek legal consultation, as soon as they explain their complaint, the
      lawyer will nope-the-fuck-out. If they actually had a case, they'd have
      argued the merits with you instead of resorting to empty threats. These are words never spoken by people who mean it.
      This is doubly true if you are threatening a business, to which you are a
      client. They know their business better than you. It's a safe assumption
      that people in the business have structured their contracts
      and policies in such a way as to limit their liability because they
      actually want to stay in business. Most of the time, they will be
      operating within those parameters. And if they're not, there's no need
      to make such threats.
      In the real world, you don't tip your hand. If you have a lawyer and you are intent on having them file a lawsuit, you don't warn the person you're going to sue and give them a
      chance to cover their ass, lol. Like on TV, one spouse always says to the other, very dramatically "I want a divorce"... in the real world, only idiots say that. That's essentially saying "Hey, cash out all the bank accounts quick so you don't have to share it with me", lol. You don't warn people of impending legal action. That's like rule #1.
      The first time they hear about it should be when they're served with either the lawsuit or a C&D or something of that nature. Even if you are just trying to intimidate
      them, those words are only potentially scary in writing, on the
      letterhead of an actual law firm, or better, service from the court itself. If you are ever threatened with a lawyer, you can and should call their bluff 100% of the time. You have all the leverage in that scenario, use it.

    second story reminds me of the recent trend of tattoo artists tattooing their signatures on their clients bodies without their consent. both are an easy win in court. like yeah, it sucks that she didnt pay but that would have been solvable in small claims. there is absolutely no need to bodily harm someone just bc theyre a jackass to you.

    Story 2: Regardless if she can pay or not you have to go through legal services tattooing ANYTHING on somebody without their permission from a signature hidden in the work or an image they didn't request is illegal on multiple levels ranging from simple tattoo negligence to full blown assault, which can result in a hefty lawsuit as well as losing your license to tattoo. The 'victim' even if she didn't pay would walk away with vastly more money than the tattoo would cost and the artist would be paying for it. The artist in the story only got away with it because the customer wasn't very smart clearly.

      @@jboy804, usually under the back seat there is only car floor. We once had to remove it from our family car and we found there some rusted watched that were smuggled in 1980's, probably from West Germany. More modern cars, especially high-end ones could hide there quite a bit of mechanical and electrical components, like heaters, seat articulation and adjustment mechanisms, etc. I assume a good mechanic would know, what to avoid.
      Besides, potential damage must be above certain monetary value for police to investigate, and either prosecution or judge can dismiss the case anyway...

    Wonder what happened to the tattoo artist...An Austrian tattoo artist did something similar and put a 16inch dong on a guy, got charged for causing bodily harm and got 3.5 years in jail.

      As "justified" as it might have seemed at the time permanently disfiguring someone over a few thousand dollars is just not right... ever... There are ways to get his money if he wanted but she has no way to fix what he did... (at least not without more time and money she obviously doesn't have...) She 100% was in the wrong for nonpayment but this is defiantly one of those "two wrongs don't make a right" situations. Plus, even without court involvement, dude is wrecking his and the shops reputation on this stupid act. There is no way she didn't blast them online for this and, even with the fact of nonpayment, people will still see how unprofessional they acted overall.

      This guy does prove one thing to me. There's a sliding scale of racism, and this is probably the most extreme you can go without blood and violence.
      I've seen a genuinely racist guy hiring and working for POC individuals, but talking behind their back about their performance/homes/etc while being much more lenient on his white workers, who fall asleep on the job (they work in a landscaping-adjacent field) or actually steal from him/threaten his life.

    Story 2: I would NEVER suggest doing this in retribution. It's could result in criminal and civil penalties (as well as being psycho).
    You can be heavily sued and even potentially go to jail for this. Yes, it is technically theft from the affected person, but if you ever got that in front of a jury that would be very bad. That was literally semi-permanent retribution easily shown in court (that the tattoo artist definitely didn't get informed consent to perform). That's why I said possible criminal, but likely just heavily civil. Yes the tattoo artist can asked to be paid, but the amount the affected can ask for both the pain and suffering and the removal cost is going to trump that in spades.
    What do you do instead? Just don't finish it psycho and go to collections agency.

      @@stormshadow2838 It's not only illegal, but it's quite immoral to assault someone for non-payment (immoral and non-legal don't always line up). Cops won't do much for non-payment for a continual service. They'll likely refer it to civil court (AKA small claims), as debtor's jail is suppose to not be thing now (although there is an indirect debtor's jail with government based fines but that's another discussion).
      EDIT: There is a thing called theft of services which could be used to charge the patron (which I'm going to refer to as debtor's prison 2.0), but the tattoo artist will almost certainly either never see the money then or not for a LONG time. If the patron claims non-payment is due to dissatisfaction, they likely wipe their hands of it and tell them to go to civil court (assuming the patron was smart enough to do this). They could never literally force the patron to pay, maybe try to convince them to at best.

    That last story is really bad on the tattoo artist. The customer can sue because that's not how you handle that situation. If my tattoo artist did that, I would just expect them to sue or ask for payment, stopping the tattoo. That artist should have known better. Non-payment is bad, but that revenge on her?

      Yeah that would've been an open and shut case against the tattoo artist that would've probably not only cost him his license, but required that he pay the cost of having it removed. It'd be right up there with an electrician realizing he's not going to get paid, so he intentionally miswires the house. He'd be 100% liable for any damage that happens as a result.

      Except what the artist did is regret dangerous, like in the realm of being sued into the ground dangerous. Doesn’t matter if she had the money or not. What he should have done is just turned her away, instead he basically committed a form of “assault” that a lawyer could definitely argue and spin to make him pay out the nose for. There are tons of stories of tattooists getting sued over bad tattoos what do you think would happen over something like this that’s more deliberate and malicious.

    On the porting numbers question. I worked for a company that managed call centers all over the US and Canada, and we had in our contract that any numbers we managed for the client had so many days more than 30 in OP case that we would hold onto them for. Most of the time it would go like this. We would forward the number to them, and they were expected to request the number to be moved to their account at the phone company. If they needed help doing it, we would help, but we couldn't do it for them as it was their account it was moving to. After the contracted time, if they hadn't moved the number, it was up to us was we did with the number. However, it was a manual process, so we had many accounts where their number was forwarded for years, and we never caught it.
    That the fun began. We were moving to an entirely new phone switch. All numbers had to be ported, and all accounts had to be setup. We used the billing system for the process, and any numbers we didn't have in the billing system we simply parked. Think pointing the number at a generic message that the number wasn't active. All of a sudden, a ton of clients phone numbers stopped working for them, and they had to track down what was going on. We had a lot of returning clients that month :)

    Tattoo story: I've heard stories of people trying to stiff tattoo artist, as a reminder for history tattoo parlours use to be extremely dangerous the kind you'd never walk into. Tattoo parlours are the place to shake you down and carry bat's behind the counter, these are people who can happily give you ink but are usually the kind who've got some heavy pasts so don't fuck around.

    For the last story, I wouldn’t be surprised if what the tattoo artist did would be considered assault or something similar. The woman can’t do anything about it without getting herself in legal trouble but there still playing with fire.

      If she hasn't paid then you simply refuse to continue until she does or take her to court for that. What they say was done is outright a crime that could absolutely get their business shut down though.
      Not that it matters because it's so blatantly nonsense it's obviously made up.
      Only a seriously brain damaged person would think there isn't going to be a pro bono legal boning coming their way regardless of the money status of the client if they did that.
      And even if they counter sue at that point it would just be deducted from the business shattering payout.

    No, its not illegal. ive worked with several phone service providers. Technically speaking those CTN's are "bought" and will be used as asset by your company. It is by your prerogative as company how to use it as per contract with customers. once your contract ended with your customers and as per your policy, you can port the number to the customer or use it again as company asset.

    Why on earth would you ever get a service without having the money, I think that is dumb, but then again tattoo parlours attract a small population of people who think art should not be paid for. IDK, As an tattoo artist, can’t you ask for some sort of payment upfront, especially on a piece that’s going to cost the artist many hours and ink? Putting money on the table tells you if the customer is actually serious or just talk.

    Story 1 the legality there is definitely questionable. Telecom providers cannot reassign a phone number for at least 45 days after it goes out of service. Now this guy didn't work for a telecom provider, but I'm pretty sure the same FCC regulations apply there too, since it was effectively some guy's business number.

    The "tattoo artist" in the last story actually commited grievous bodily harm, at least in German law. My wife is a tattoo artist and it literally does not matter if she payed or not, if the artist does not tattoo what was agreed upon, he/she/itdoesn'tmatter can be sued to bankruptcy even here in Germany.
    This behaviour should not be condoned or even praised.

    In Germany tatooing a person with an image that was not part of the contract is body harming and illegal. you have to pay the removing, you have to pay a hugh fine for body harming, you have to pay for emotional damages. And perhaps they will close your business. And you will get no dime, even if you can proofe that she tried to betray you.

    Porting the tracked numbers to the new customer would be intentional interference with contractual relations. Your contract with Company A allows you to cancel service if you don't get paid. It doesn't allow you to direct Company A's customers to Company B, especially if Company B pays you a commission. Also, OP's contract with Company A almost certainly bars them from using customer info to help a competitor, especially if that competitor is paying them 40% extra.

    I hope that tattoo artist doesn't have to pay the full price for her tattoo removal. That's not legal. I think he should have taken her to court and refused to finish instead of risking his reputation and legal issues. He has zero standing in a court case due to the fact that he broke the verbal contract. Had he not done that she would have to pay him plus the trouble but now he's going to have to deal with that. And honestly that could be a huge issue and cause him to go out of business.

    What the ad OP did wasn't legal, but it wasn't illegal either. Scott waved his rights to those numbers and so it was the company's will to do with them as they pleased. At worst the OP would be in trouble with the company for an unauthorized addition of CTNs on a customer's account, but I'm sure they would overlook that after seeing the 40% sales increase from said customer.
    However, what the tattoo artist did absolutely is illegal and frankly I hate them for it. Tattoos are permanent, especially in the era that artist was in, so to permanently fk up the girl's back like that on purpose is absolutely grounds for a lawsuit. Nonpaying b or not, that just isn't acceptable l.

    Don't hate me for saying this lol but!..... As wrong as it is for the person to not pay for the tattoo....I feel the artist should have just stopped right there. Not done any more. Taken the person to court. Then make sure to put this person's name out there in the community so nobody will ever finish their work. I just feel this might... Just a little. Be overboard lol.
    I only have one tattoo for the fact I can't afford to get more. I know the cost! I would never do something like this but they are also permanent.

      Your absolutely correct, what the artist did is not only immoral but illegal. The artist ceased to be the victim as soon as she started to tattoo with malicious intent. This is both assault and battery which would likely cost them their license and possible jail time, plus any civil filings the tattooed person decided to pursue. The only reason they likely got away with it is the tattooed person was too stupid (I mean after saying they weren't paying and getting the tattoo is pretty dumb) and possibly humiliated to go that route. One possibility is they did go after the artist, but we didn't hear THAT part of the story.
