This is BAD. I used to work at a casino. The casino can tell people they are no longer permitted to gamble and to leave the property. That's fine. The reason they didn't pay him out initially is because he refused to show ID. That's perfectly fine. Also, that gaming agent should know basic gaming laws. The officers still shouldn't be acting as the private security of the casino when they are on duty, but they probably work for the casino as security officers when they are off duty. They certainly shouldn't be harassing him and I believe purposely misstating the law.

Technically, due to title 31 compliance. Casinos may refuse to pay anyone out unless they provide identification. However, if you comply with showing your ID. They must cash you out. But if you refuse ID, they legally don’t have to pay you anything.

I own a small casino in Montana. This is absolutely ridiculous. Believe it or not, card counters also lose money because their success hinges on working through multiple decks. Easiest way to combat counters is just flat bet them. Be polite. Cash them out if they want to leave and move on. It's part of the business.
I've seen some card counting YT channels and the impression I get is that the police there are in the casinos all the time, and they get very chummy with the staff. The staff get indignant with card counters and so the police follow along. I'm betting an uninformed casino employee suggested to the officers that what the guy was doing was illegal, though of course I can't be sure. FWIW, I've also seen casinos pull the same crap with the ID. The casino operator is not asking if he is of age (he obviously is), the casino wants to record his personal information in case he returns (or potentially as the victim suggested, to share the information with other casinos). If the casino trespasses you, it is a crime to return. The casinos aren't allowed to refuse to pay out either, but it happens a lot. Most players I've seen simply take their chips with them and return at another time.

A casino does have the right to back you off the table. Their saying is usually "your play is too good for us". At that moment they either limit you to staying the same bet the whole shoe, or you need to leave. They cannot arrest you on the spot for this. Unless you refuse to leave, then you are trespassing. But card counting by no means is illegal.

Casinos are terrible. My employer throws a christmas party every year at a casino. It's sad to see so many desperate people all at once. I get weird vibes walking through.

I don't understand the benefit of being so aggressive with card counters to the point it incurs liability. Just be passive aggressive and give the dealer a new deck every other hand, card counters will leave on their own.

All casinos don’t like to pay when they loose this is a perfect example. Another is MGM getting cyber attacks? Maybe someone hit a big jack pot and they didn’t want to pay. People need to wake up and realize how these places cheat them.

Supreme Court already ruled card counting is legal so making a state law doesn't matter, and the casino can kick anyone out and refuse service, it's a private business

Technically, due to title 31 compliance. Casinos may refuse to pay anyone out unless they provide identification. However, if you comply with showing your ID. They must cash you out. But if you refuse ID, they legally don’t have to pay you anything.

False imprisonment is one. Courts have ruled that you can not handcuff or detain anyone for counting cards.

They can’t arrest him but they can ban him from the property, they should have cashed him out. Sue the shit out of them, they will end up losing more money this way.
I own a small casino in Montana. This is absolutely ridiculous. Believe it or not, card counters also lose money because their success hinges on working through multiple decks. Easiest way to combat counters is just flat bet them. Be polite. Cash them out if they want to leave and move on. It's part of the business.

I've seen some card counting YT channels and the impression I get is that the police there are in the casinos all the time, and they get very chummy with the staff. The staff get indignant with card counters and so the police follow along. I'm betting an uninformed casino employee suggested to the officers that what the guy was doing was illegal, though of course I can't be sure.
FWIW, I've also seen casinos pull the same crap with the ID. The casino operator is not asking if he is of age (he obviously is), the casino wants to record his personal information in case he returns (or potentially as the victim suggested, to share the information with other casinos). If the casino trespasses you, it is a crime to return. The casinos aren't allowed to refuse to pay out either, but it happens a lot. Most players I've seen simply take their chips with them and return at another time.

Blacklisting should also be illegal and subject to civil penalties. Can you imagine a star quarterback being banned from playing, a fishing champion being banned, a stock trader banned from buying because he makes too much, take your pick. Good luck trying to sue an Indian casino. They have their own rules that even judges can't do much about.
There are no tribal casinos in Blackhawk or Central City Colorado. They are all privately owned by U.S. corporations or private individuals.

Actually police saying that a law exists when it doesn't is fraudulent. Arresting or detaining someone under false pretenses is illegal.
A casino does have the right to back you off the table. Their saying is usually "your play is too good for us". At that moment they either limit you to staying the same bet the whole shoe, or you need to leave. They cannot arrest you on the spot for this. Unless you refuse to leave, then you are trespassing. But card counting by no means is illegal.
I unfortunately expect stuff like this from the casinos but for law enforcement to be saying that garbage is inexcusable

I got banned from casino tables for winning more often than losing, they were more honest with me by saying "we don't know what you are doing but you are not allowed to play table games" They didn't mind when I use to lose more often than win.
I see so many cops threatened to arrest people for things that are not even crimes. They can literally make anything up arrest you, and face no consequences. Even though that is false imprisonment, abduction, false arrest, and an egregious violation of many other rights...
In our county our council literally gives our police officers a small “cheat sheet” for local laws and ordinances so this type of issue doesn’t happen to our citizens or our officers And It helps.
Private businesses are generally allowed to refuse service to any customer as long as the reason isnt discrimination against a protected class. Card counting is not a protected class. I suspect he is trying to get/scam a settlement from the casino.

It should be illegal for them to ask you to leave because the house is losing.. the casino has ruined soooo many peoples lives, took peoples houses, runied peoples credit and even people taking their own lives due to losing everything.. but if someone wins big "there is a glitch" or you cheated.. its absolutely bullshit
