    Bolling v. Sharpe | 347 U.S. 497 (1954)
A fundamental constitutional principle is that everyone is entitled to the equal protection of the laws. It’s a key part of the Fourteenth Amendment, adopted after the Civil War. But, according to its literal terms, that amendment only applies to the states, as opposed to the federal government. So can the federal government deny people equal protection? The United States Supreme Court first addressed this issue in Bolling versus Sharpe.
In 1950, Spottswood Bolling and other parents of African American children living in the District of Columbia attempted to enroll their children in an all-white school in the district. The school refused based on the district’s policy of racial segregation that then existed. The school board upheld the school’s decision.
Bolling and other parents filed a class-action lawsuit against Melvin Sharpe and the other members of the D.C. Board of Education in federal district court, seeking an injunction requiring racial integration of the D.C. schools. The district court dismissed their lawsuit. Bolling and the other parents appealed to the United States Court of Appeals for the District of Columbia.
Bolling and the other parents successfully petitioned the United States Supreme Court before judgment in the Court of Appeals to review their case.
