  • The Supreme Court on Thursday heard arguments in Trump v. Anderson, a case that questions whether former President Donald Trump is ineligible for the presidency because of his conduct related to the assault at the U.S. Capitol on Jan. 6, 2021. The case, which stems from a lawsuit filed by six Colorado voters, cites Section 3 of the 14th Amendment as the reasoning for keeping Trump off the ballot.

    These judges are asking the lawyers questions about somethings they are appointed to decide. At times, they are cutting off the attorney's attempts to respond saying they are not staying on subject, then immediately after go off topic with a question that has NO RELATIONS to the subject at hand !!!!!!!!!!!

      It was WRITTEN specifically to prevent those serving in a recognized ARMY from later serving in the government it had fought against. It was specific to the Civil War era, hardly - if ever- used and left in place mainly due to Congressional disinterest.

      He never met Donald Trump. Respect has to be earned not given blindly . You can quote anyone you want… Wheeler was a justice in 1928. There was no 24 hr news, no internet which allows anyone to say anything and have it repeated a million times in a second. There’s no lie detector screening information as it comes in It reminds me of Trump who uses his right to free speech to lie, deceive, effect revenge on anyone who speaks out against him. He stirs up fear and anger and distrust of the government, law enforcement, the media, the military, lawyers, judges, women, the election process and the officials that run that process, he stirs up disdain and distrust against the Democratic Party, the constitution, NATO, our allies - he has pretty much torn apart everything America stands for. He trusts, tries to emulate and repeats the rhetoric of evil dictators, and war mongers and white nationalists. So if I scoff at the Supreme Court and question the fairness of their decisions, I have a right to. There is no built in integrity, honesty or nonpartisan justice that somehow deserves our blind allegiance. No, we have every right to insist that our freedom is built into the fabric of the laws of this nation and to have a voice and means to vote out politicians and invite in a government which has been equitably elected to serve knowing that they have a few years to get it right for the people. And they must not be deified and worshipped as the all knowing and all powerful answers to lifelong laws and not be held accountable for every decision they make

    51:41 The reason why legislators are specifically mentioned in 14.3 is because they are NOT offices of the United States. Instead they are offices OF the *_states_* themselves. Yes, they do meet in a federal congress, but they themselves are state-bound offices who are then sent TO congress. They can only speak, act, and vote on behalf of one state.
    The Presidency is different. It is an office of each and every state when speaking, acting, and voting/signing. That is, they are an officer of the UNITED states.

      some clear ignorance or absence of US history and the use of "insurrection" in US Law. Why would they ignore those precedence and contexts. Certain politicos have been itching to bring this very question to SCrOTUS, knowing it would get played this way. They're not foundationalists. They're playing legislators from the bench. It's unimpressive. And the interruptions and redirect essentially cutting off other Judges line of inquiry is a far cry from previous Courts. It's lame.       it's really pretty simple. They're wrangling about how to do (or not do) their own jobs and measure the weight of 14th Amendment, and whether or not it counts.
      It's not especially "legal" to prevaricate. It is, however, suspicious that they want to question a state's determination by a CO judge that under US Law an individual clearly has engaged in "insurrection." There's zero reason for the 1st, 3rd, or 14th Amendment to except anyone from US Codes which delineate what "insurrection" mean.
      It's completely false that we don't have any idea what "insurrection" means in both a criminal and legal sense.

    I feel that this is an admittance of guilt by requiring a removal of the disability for holding office should not place the onus of adjustment onto the US government, the person(s) guilty of insurrection should retain the disability until Congress removes such a disability. If a person was found to be guilty of any other crime the consequences would not be placed on the government, the guilty party would suffer those sanctions and adjustments!!

    Though there us term limits that doesnt bar the State to disqualify the insurrectionist becayse of tge change of power/ authority. The "term Officer" was meant to be genersl word during when the framers were drafting and meant to include everybody including the President as it was enumerated tge positions and it was only later after the framers wgen tgey differentiate the word "officers" & "official", timefrane is imfortant

    The issue is how does the 14th amendment affect Donald Trump’s behavior on January 6. One has to prove that Trump acted to overthrow the US government. Objecting to an election is a right any candidate can make. Emotions about any candidate is not cause for a hasty decision.

      There's no proof otherwise Merrick Garland would have prosecuted Trump under 18 usc §2383 and if convicted would then be disqualified from holding office along with being fined,jailed.
      That's the appropriate enforcement remedy for section 3 since section 5 only gives enforcement power to congress through legislation.
